tNTRODUCTION
This repart recommends that the Crty Councii adopt a resolutEOn exempt~ng child care
facilities (centers, and large and small family day care homes} from paying any planning
fees t~cludrng costs associated wrth the preparatron of er~~rronmental ana~ys~s m
accordance with the California Environmenta! Quality Act
DISCUSSIQN
In 1991 CEty Council adopted the Child Care Master Plan which calls for remo~ing barriers
to the development of child care facilit~es ~n the C~ty This pol~cy stemmed from the
inadequate supply o€ child care to meet #he needs of work~ng parents, a s~tuat~or~ which
pers~sts taday To effect that policy, i~ ~ 992 the City Council adopted a resol~tion
exempting large family day care facifat~es from Plann~ng appl~ca#ion fees lt has
subsec~uently been the C~ty's practice to wa~ve fees for all child care facilities ~n the c~ty
The proposed resoluttan ~s intended to ciar~fy this practice a~nd specifically identify that t~is
exemption applies to al! plannGng fees including costs related to environmental review
under the Califarnia Environmental Quality Act ~CEQA~, whether performed by staff or

Thcs recommendation stems from an application fiied for a 4600 sq ft child care facility at
2702 Virginia Avenue in the R-2 distr~ct. The pra~ec# w~1f be sub~ect to afl appl~cabl~ City
approved procedures The issue has not arisen previausly since all the ch~ld care facilities
that have opened withm the city since 1992 have either be~n part of a larger affice
development that was sub~ect to CEQA re~iew or involved the remodel of an ex~st~ng
facility w+th negligible expansian of use makmg ~t categorically exempt under CEQA S~nce
ar~y extra costs are a burden on child care facilit~es wF~ich may F~ave minimal discretionary
funds to use in oper~ir~g the~r doors #o accommodate the children who w~1~ be cared ~or,
staff believes that it would be prudent to exempt these owners from these costs, which the
City would absorb

$4,000 It is antic~pated that CEQA will not be triggered m the ma~ority of thes~ pro~ects

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA M4NICA ~XEMPTING OWNERS OF ALL
CHLLD DAY CARE FACILIT~ES FRDM PAYING ANY PLANNING
APPLICATION F~ES AND ENVIR~NMENTAL COSTS
WHEREAS, existing City policy authorizes Che waiver of various
costs and fees as they apply ~o day care faciliti~s in order to
effectua~e the goals of the City af Santa Monica's city-wide child
care plan; and
WHEREAS, prospective owners and aperators of child day care
facilities are often disco~zraged from pursuing applications to open
these centers because of the cost involved; and
WHEREAS, the City Council af the City af Santa Monica wishes
to encourage the creatiion of additional child day care facilities
in the Ci~y of Santa Monica and wishes to remove any unnecessary
abstacles to their development,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HERESY RESOLVE AS FOLLOWS:
SECTION l. Owners or operators of child day care facilities

shall be exempt from paying any planning appl~cations fees and
environmental costs, which would otherwise be required to be paid
pur~uant to Resolution N~mbers 76Q7 (CCS} and 8~82 (CCS), in
conjunction with the owners or operators seeking City apprpval or
permission to open such centers.
SECTION 2. Any Resolut~ons of the City of Santa Manica, or
any parts thereof, inconsistent with the provisions of this
Resolution are hereby repealed.
SECTION 3. The City Clerk shall certify to the adaption of
this resolution and thenceforth and thereafter the same sha~1 be in
full force and eff~ct.
