Background Attached hereto you wl1l flnd a copy of the staff report subm1tted on September 13, 1977, w1th regard to proposed he1ght lim1tations In the C3 and C4 commerclal zones. The Plannlng Commlss1on recommendatlons are set forth In that staff report and are attached here for the Council's lnformatlon. At the Councll Meetlng of September 13, 1977, Councllman Scott moved that the matter be sent to the C1ty Attorney for preparat10n of an ordinance for Counell considerat1on that provldes for i helght Ilmlts as recommended by the Planning CommlSS1on and that In returnlng the ordlnance lt lS to be accompanled by an oplnlon of the Clty Attorney that the ordlnance lS drafted 1n 'lJJ OCT 2 5 1977 -1- '- '- such form that if an appllcant meets the condltions of the Plannlng CommlSSlon and the Clty Councll and If the appllcant's documentatlon and lmpact report lndlcates that there are no adverse flscal or environmental lmpacts and hlS poslt1on lS reasonably supported, that nelther the Planning COITm1SS~On or the Clty Council can unreasonably wlthhold permlss10n to construct a structure 1n excess of SlX (6) storles or III excess of twelve (12) stor1es as requested; and that the standards prepared by the C1ty Attorney to prevent unreasonable w1th- hold1ng of approval be clearly supportable. The manner of draftlng the accompanY1ng ordinance, 1n my oplnion, 18 sufflClent to set forth preclse guidellnes and to compel the granting of a perm1t if the requested standards are met. Alternatlves The alternatlves are elther to pass the ord1nance or to amend it or refuse to pass It. Recommendatlon It 1S hereby recommended that the City Council lntroduce for f1rst reading and subsequent adoptlon the accornpanYlng ordlnance by tltle only and that further reading be walved.
