BACKGROUND
Under several sections a~ Santa Monica`s Zoning Ordinanc~,
properties a~ned for multi~aFnily resident~al d~velQpment can be
usea for parking in connectifln with adjacent comm~rcial and
industria~. dis~ricts_
PROVISI~NS REQUIR~NG NO SPEGZAL PER~4XT:
SECTIOid 9112. "A" Off-Street Parking District. These sections
9~12~~h~ough 9I12A3 pravide for ~he use of lafs in the R1A, R2A,
R3A and R4A distx-icts. This is a parking overlay aone wh~.ch
perr~its the aZternative use of of~--str~et parking in addztion
ta resiciential uses.
SECTION 9112A4. Automobile Parking Structures. This
section provides that au~o~nabile parking s~ructures r,iay b~ built
wh~re a parking 1ot cotxld be deve~oped groviaing certain heigh't
and yard requiremen~s are met.
SECTIpN 9129E. Autor.~obi~e Parking Adjacent to Business. This
~ section provides that any lvt except an "R1'' ~ot within 15~
feet o~ a carnmercial or i.ndustrial area may be used fvr paxking.

sections, commercia~ ox parking ~ses may be e~~~nded through
discretianary actions including ~ariances~ Use Permits, Canditional
Use Permits, and Zone Changes. Each of thes~ actions, howevex,
require public notificatian. puhZic hea~ing and s~eci~ic approva~
by the Planning Commission or City Council. These provisions
i~clude the follo~ing:
SECT~ON 91~5. Variance_ Under this section, non-residentia~
parking might be allow~d on a lot not automatieally eligible
foz such parking use. Fzndings of hardshig, unusual
circuinstances and lack of adverse impacts mus~ b~ ma~e.
SECTION 9346. Use Permit. Under Section 9146A7, a commercial
or indnstr~al use permitted in a C2, C3, C4, M1 or M2 district
may be extended no more than 50 feet into an abutting R2, R2A,
R3, R3A, R4, R~A, CA, CP district.
SECTION 9147. 5pecial Condi~ional Use Permit. This section
provi~es that the City Council may approve any R2, R3 or R~
area of a~least 4 acres for ~omm~rcial use. This section was
designed for a specific site several years ago and has never
been used.
SECTIO~ 914$. Canditianal Use Per~it. This sectian proviaes
~or extension of car~nercia~ or industrial and/or garkina, uses
in~o.a~u~ting multiple residential distric~s up to 50~ fee~ on
approval by the Flanning Co~~~ission appealable ~o ~he C~ty
CounCil.
SECTIQN 9~49. Zone Changes. IInder this section, the City Cauncil
may rec~assify any Iot to an "A" zone, thereby making it
elig~ble for parking use.
The Planning Department study, Car.~!ercial Pa~king in Resiaential
Areas, exa~ines ~he co3nmercial and industriaZ use af
residentially zoned pro~erty. The study ~dentifies the area
wh~ch cauld potent~ally be used for commercial or industrial
parking unn~r Sec}sons 91I2-9I12B and 9~29E, withaut a special
p~rmit; the extent to which these non-residential uses have
occuYred; and the remaining acreage presently residentially
developed, but sub~ect to future use for carunercial or industrial
parking, under those sections of the Code.

Th~ report identafies 160.0 ac~es of R2F R3 and R4 zaned la.nd
si'tuated within Z50 feet of commercial and industr~al dzstric~s
and subject to use for park~ng at the dzscretian of the property
owner if a11 parcels be-~ween an affected 1ot and the business
distri.c~ are so used. S1a.ghtly more than 14s af this land
(22.9 acres} ls already used for non-resident~al parkin.g and
other uses. There are an add~.tional 59.3 acres of residen~ia~
land which have been overla~d with an "A" Zone, allowing park-
ing as an a~terna~~ve u~e t4 residentia~. A~most 4E]o of the
"RA" zoned land (23.5 acres} is used for parking for ad~acent
COmmerCla~ ar i.ndustr~.al distr~cts. Thus, of a~otaZ of 219.3
acres of resident~al land potent~ally sub~ect to ~a~rnme~c~al or
a.ndustr~a~ parking, 46.4 acres are so used. The remaa.ning
172.'~ acres cou~d be tak~n as comi;~~~cial deveZopment a.ntens~-
fies along commercial streets, or ta meet ~ndus~~ia~ parking
requirements.
Any land wh~ch has block long C3 or C4 frontage could be subject

of the Ca~ifornia Envizonmental Quality Act. The Plar_ning

STATE~iENT OF PURPOSE
The purposes o~ an Initial 5tudy are to:
(~) Identify enviranmental ~mpacts;
(2) Allaw modification of a nro~ect, mitigating advers~
env.iron~nental impacts, so an EIR need nat be written;
{3) Focus ar_ ~IR, if on~ ? s reaua~redr on potEn~ial.ly
signi~~can~ enviran:nental ef~ects;
(4) Facilita~e environFnental assessment early in the
design of a p~aject;
(5) Provid~ documentation of a~actua~ basis for the
f~nding in a Nega~ive Declara~ion that a project w~J.J. not have
a s~gn~ficant ef~ect on the enui.~onment;
(6) E1im:~:~ate unnecessary EIRs.
~CC~E OF INIT~AL STC~DY
The primary concern ot the Planning Commissian has been the
ex~ension of business park~ne~ into resident~a~ districts as a
ma~ter of right. As zndicated abave, ~he Zoning Ordinance

also includes several provisians that aZlow use of this resi-
dential land for business parking if the appropriate approval
and pe~'mits, variances. etc. are secured, This ~nitiaZ study
and the proposed Zoning Ordinance amendments focus only on the
elimination of the au~amatic right to denelop parking or park-
ing st~uctures in multifamily residential dzstricts. It does
na~t consider restric~ing the use af "RA" zoned land for sur--
face parking lots.
DESCRIPT~O~I OF PROPOSED ACTION
The praposed act~on wou~.d delete Sections 9112A4, 9I29E, 913I
and 9Z47 from the Santa Monica Zoning Qrdinance. The propos~d
amendFnent to the Zoninc Ox'danance wauld elirn~na~e the a~lowance
of business-related parking as a matter of ~igh~ on i60.C3 acres
of resiclerftial land distributed thrcughout thE_ city (Section
9129E). Construct~on o~ autpmobi~e parking structures on an
additianal 59.3 acres of res~dential and/or parking l.and would
a7.so be eliminated (Section 91.12A4), Deletion of Section 9131

deletion o~ Section 9129E consist of thase multifamily
residential lats lying within 150 feet of a commercial ar
industzial zane which are so oriented with r~spect to thase __
districts that encroachment would occur from the side o~ the
residential lat. Those residential parcels which adjoin business
aistricts a~ the rear of the residential pareel are nat sub~ect
ta this non-residential extensi4n o~ use.
As indicated in Table ~, ~6fl.fl acres of 3and zaned exclusive~.y
for ~esidential use (R Zon°s} and 59.3 acres cf ~.and zoned ~or
residen~ial ar par;~c~.ng use (RA Zones), a tatal of 2I9.3 acres,

every b~ock hy an east-wes~ commercial or industria~ stree~,
combined with the s~xbject parking provisions of the Zaning
Ordiriance, could have serious implications ~or the continuation
of thzs area as a residentiaZ d.~strict, one in which man~= of the
more ~~der~tely priced rental housing opportuni-~ies are found.
In ~.his area, each block is abou~ 6Q0 feet long. Usually
carnmercial or industrial zanes extend ~5~ feet in~o the b~.ocks
~. from each end and the remaini.ng 300 feet ir~ ~he center af the
block is xesiden~ial_ In most cases, all of this residentia~
ianci is presen~ly sub~ect by automatic right to canversion to
business related parking.
Com~nex-czal and ~ndustrial parcels have an average depth o~ 150
feet. In order to mee~ the zaning Ordinance`s paxking require-
ments, developers of many co,-ar~ercial proaects have relied

are curren~ly used for residential purgoses. The restrictions
on demolition impased by the Ren~ Control Charter Amend~nen~
may explain why the adjoining residential land was not us~d for
parking zn connec~ion with these projects. Despite these
restrictians, however, development af cQmmercial proper~aes

THE CITY COJNCIL OF THE CITY OF SANTA MO1L'ICA DOES
ORDAIN AS ~'OLLOWS:

SECTION 2. Any provis.ion of the Santa Monica Municipal.
Code ar appendices thereto inconsister~t with the provisions
of th~s ardinance, 'to the extent of such incansistencies and -
no further, is hereby repealed or modified to that ex~ent
necessary to affect the prav~sions of this ordinance.
S~CTION 3. if any sectian, su~section, sen~ence,
clause, or phrase at this ardinance ~s for any reason held to
be invalid or unconstitut~anal by a decasion of any court of
competent auzasdiction, such deczsion shall not affec~. the
valzdity of the rernaining portions of the ordznance. The
City Council hereby declares that it would have passed this

off~cial newspaper within 15 d~ys after its adaption. ~~e
