(1) Existing law requires that, with specified exceptions,
materials in the possession of governmental agencies are to be
open to public mspection
This bill would additionally exempt from this requirement
the informahon required to be reported to a CIty or county,
pursuant to an ordinance, which concerns the possession,
stc~age, use, or disposal of hazardous waste, substances, or
materials. The bill would specify that the release of this
information to emergency response agencies does not waive
thiS exemption.
(2) The bill would take effect immediately as an urgency
measure.

16 robbery, vandalism, velucle theft, or a crime of violence
17 as defuled by subdivlSlon (b) of Section 13960, unless the
18 disclosure would endanger the safety of a 'Wltness or other
19 person involved m the invesbgation, or unless disclosure
20 would endanger the successful complebon of the
21 investIgation or a related investigation; provided,
22 however, that nothing herein shall require the disclosure
23 of that portion of those investigative files wlnch reflect
24 the analysis or concluslOns of the investigatmg officer.
25 Other provisions of this subdivision notwithstanding,
26 state and local law enforcement agencIes shall make
27 public the follOwing informahon, except to the extent
28 that chsclosure of a particular item of information would
29 endanger the safety of a person involved in an
30 mvesbgahon or would endanger the successful
31 completion of the mvestigahon or a related investigation,
32 (1) The full name, current address, and oCCupahon of
33 every individual arrested by the agency, the mdividual's
34 physical descriphon including date of bIrth, color of eyes
35 and hair, sex, heIght and weight, the tune and date of
36 arrest, the time and date of boolang, the location of the
37 arrest, the factual circumstances surrounding the arrest,
38 the amount of barl set, the time and manner of release or
39 the locatIOn where the mdividualls currently being held,
40 and all charges the individual IS bemg held upon,

17 examinaoon data used to administer a licensing
18 examination, exammatJon for employment, or academIc
19 examination, except as provIded for in Chapter 3
20 (commencmg with Section 99150) of Part 65 of the {
21 Education Code.
22 (h) The contents of real estate appraIsals, engmeering
23 or feasibility estimates and evaluatIons made for or by the
24 state or local agency relative to the acquiSition of
25 property, or to prospective public supply and
26 construction contracts, unhl such time as all of the
27 property has been acquired or all of the contract
28 agreement obtaIned, prOVIded, however, the law of
29 eminent domain shall not be affected by tlns proVIsion,
30 (i) Information reqUIred from any taxpayer in
31 connection WIth the collection of local taxes whIch IS
32 received m confidence and the disclosure of the
33 information to other persons would result in unfair'
34 competitive disadvantage to the person supplying such'
35 information.
36 (j) Library circulation records kept for the purpose of
37 identifying the borrower of Items aVaIlable m libranes,
38 and library and museum materIals made or acqUIred and
39 presented solely for reference or exlnbIhon purposes.

28 Financing Authonty shall adopt rules for review of
29 mdIvidual requests for confidentiality under this sechon
30 and for makmg available to the pubbc those portions of
31 an application whIch are subject to disclosure under this
32 chapter.

28 been transmitted to the Department of Health Services
29 pursuant to subdivision (b) of Section 1282 of the Health

31 (t) Information required to be reported to any city or
32 county, pursuant to an ordmance, which concerns the
33 possession, storage, use, or disposal of hazardous waste, (t
34 substances, or materials. The release of this mformation
35 to fire, health, police, or any other emergency response
36 agency does not waive the exemption pro..-ided by this
37 subdiviSIon.
