BACKGROUND
On December 13,
1983, the CIty Courcll adopted emergency
ordlnarce No.1291 CCS, to regulate the storage of hazardous
substances Ir underground taJ"ks. The purpose of the Ordlnance lS
to

Staff has based the Regulatlons ard procedures Ol" the most
currert pertlnent lrformatlon ard the pYellml~ary regulatlons
prepared by the State Water Resources Control Board and the Los
Argeles Courty Department of Erglneers.

hydrogeology of the slte where a tank lS located.

Program for up to three years to allow buslnesses wlth
nOI"-leaklng tanks to conform wlth the regulatlol"s wlthln thlS
perlod or to remove (close) thelr underground storage facllltles.
Staff has provlded the Chamber of Commerce wlth a copy of thlS
Staff Report for reVIew, has met wlth the Chamber's Industrlal
Commlttee (Jaruary 18, 1985), has held a brleflrg for tark owners
(Jal"uary 24, 1985) and has dlstrlbuted a summary of the proposed
regulatlons to all underground tank owrers.
Proposed Admlnlstratlon of Underground ra~~ Regula~ions
Staff estlmates that approxlmately 200 entltles ln the Clty own
or operate urderground tanks Including: bUSlresses, utllltles,
schools, ard 6 Clty departmerts. Permlts will be lssued for all
of these tarks, although multiple tar'ks at one locatlon can be
put or the same permlt. Based on a reVlew of past records, there
wlll be about 10 new tank lnstallatlon permlt appllcatlons
annually.

dlfferert categorles: pIal" checklng, on-slte lnspectlons, and

Each perml t lS to be issued for a fl ve year

A fee wlll be charged for each
perml t ar:d each t lme the permit lS rer:ewed or amended.
These
fees wlll offset costs incurred by the Clty to admlrlster the
program.
Present Clty Fees Pertalnlrg to Underground Tarks
The

department charges
and wlll
contInue to charge
operators of certalr urdergrour:d tarks annual fIre permlt fees.
These annual flre fees cover record keeping costs only and no
annual lnspectlons are performed.
Auto fuellng stations are
charged
$10
and
storers
of
hazardous
materlals
$15.
Addltlonally, rew tark lrstallatlons are charged a one-tlme fee
of $45 per tark and there lS a $15 per tank fee for removal, both
of WhlCh are charged by the Flre Department. However, all other
types of buslr.esses, such as car dealers and dry cleaners wlth a
flammable gasollne tarks are rot charged any arnual fee.
Ir summary, many buslnesses In Santa Monlca are operatlng
ur:dergrourd tank wlthout paYlng any kir:d of fee.

Staff anticipates

checks and Sl te lrspectlons wlll be requlred of leak detectlon
ard monltorlrg systems. Therefore, the proposed fee schedule has
hlgher fees for lnltlal permlttlng as compared to renewal
permits.
Although the ordirance mandates lnspectiors o~ly orce every three
years, staff belleves ar effectIve program reqUlres more frequent
ir.spectlons.
Other local government programs of WhlCh staff lS
aware call for arnual lrspectlons.
The proposed fee schedule llsted lr Table 3 lncludes all the dlf-
ferert types of fees proposed lr the ordlrance:

estlmate of 200 tank permIts, staff estlmates that approxlmately
$110,000 wlll be gererated ln reverues over the flrst 5 years of
the program. To properly track these fu~ds, a separate reve~ue
ll~e-item 1r the water fu~d wlll be establlshed. Staff has estl-
mated the tlme reqUIred to lmpleme~t thlS program, however, the
actual lmpact or Staff tlme wlll be evaluated ard revlewed as the
program lS lmplemerted. Implemertatlon of the program wlll begl~
wlthl~ a mo~th of adoptIon, however, due to the u~certalnty over
the number of permlts to be lssued thlS flscal year, Staff will

State Surcharges

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ESTABLISHING STANDARDS AND REGULATIONS FOR
CONSTRUCTION, OPERATION AND MONITORING
OF UNDERGROUND STORAGE TANKS
WHEREAS, the Clty Councll may establlsh the standards and
regulatlons for the constructlon, operation and monltorlng of underground
storage tanks, pursuant to Munlclpal Code Sectlon 8602(c).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Munlclpal Code SectIon 8602 (c), the Cl ty
Councll of the City of Santa Monlca adopts the accompanYlng Standdrds and
Regulatlons for the Constructlon, OperatIon and Monltorlng of Underground
Tanks.
SECTION 2.
The Clty Clerk shall :oertlfy to the adoptlon of thls
Resolutlon, and thencefortr. and tr.ereafter tr.e same sr.all be ln full force

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ESTABLISHING AN UNDERGROUND TANK FEE SCHEDULE
WHEREAS, the Clty Courcil may establlsh and from
tlme to tlme amend the permlt fee to operate an underground
storage tank, pursuant to Sectlon 8605 of the Santa Monlca
MunlClpal Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Underground Tark Permlt Fee Schedule. The
fees for urderground tark perml ts, as provlded for IP Sectlon
8605 of the Sarta Morlca Munlcpal Code, shall be as follows:
Irltlal Permit Fee:
1 tank per slte - $340.
2-3 tarks - $470.
4 or More tarks per slte - $590.
Renewal Permlt Fee:
1 tank per slte - $320.
2-3 tarks per slte -$450.
4 or more tarks per slte - $570.
Amend Permlt Fee:
All cases - $50 per tark per charge.
