To: Mayor and Clty Councll From: Cl ty Staff SUbJect: Undergrourd Tank Regulatlons ard Fee Schedule INTRODUCTION ThlS report recommerds that City Councll adopt by resolutlor the attached regulatlons and procedures ard adopt fees for urder ground stor age 0 f hazardous mater lal s to ful fill Sectlors 8602 and 86D5 of OrdlJ"ance No. 1291 CCS, the Clty'S underground tark orduar.ce. BACKGROUND On December 13, 1983, the CIty Courcll adopted emergency ordlnarce No.1291 CCS, to regulate the storage of hazardous substances Ir underground taJ"ks. The purpose of the Ordlnance lS to estabhsh a mardatory undergrourd tank lnspectlor. and mOJ"ltorlng program to rcduce the chances of envlrormental damage resul tu,g from leakug tal"ks. Urder Sectlon 8602 and 8605, the Clty Courcll may establlsh by resolutlor, stardards, regulatlors and fees to Implement the ordlrarce. The Department of General SerVlces IS responSIble for admlJ"lstratlo~ of the ordlrarce. REGULATIONS AND PROCEDURES Staff has based the Regulatlons ard procedures Ol" the most currert pertlnent lrformatlon ard the pYellml~ary regulatlons prepared by the State Water Resources Control Board and the Los Argeles Courty Department of Erglneers. II-A - 1 - m19. GS:SS;EL:a Councll HeetH'g: F.uary 19, 1985 Santa Mllrca, Californla The Regulatlor:s ar:d Procedures Ir:clude sever chapters ard flve appendlxes. The flrst chapter explalrs general provlslons such as appllcablllty of the regulatIons. Chapter two and three speclfy the requlremer:ts that must be met by new tanks ard eXlstlng tanks respectIvely. The fourth chapter detaIls the requlremerts for laboratory aralysis of water ar:d sOlI samples Ir: the viclrlty of the tanks. Chapter flve explalr:s the requHements of a slte ir:vestlgatlon should a follow-up study be reeded to lrvestlgate posslble contamir'atlor of the erVlror:mer:t by a tank. Ir: chapter SIX, requlrements to permanently abardor a tank are gIver and chapter sever: explalns the ge~eral steps of the permlt process. The apper:dlxes Irclude Santa Morlca's Urderground Tank Ordlnar:ce ard standards used by the Sarta Honica Flre Departmert, a copy of the Los Ar:geles County Department of Health Services well permlttlrg POllCY, ard a descrlptlon of lnventory recorclllatlon. The formulatlor of the Regulatlors and Procedures for Sarta Morlca has been delayed awaltlng the promulgation of regulatlons by the State ard Ccur,ty. The State and County Regulatlons form the framework of Sarta Mor:lca's regulatlons. Complete and updated copIes of the Regulatlors and Procedures will be on flle at the Santa Mor:lca Llbrary, City Cour'cll Offlce ard In the offlce of the DIrector of Gereral SerVlces. ~~ghlights of Regulatlons Several features of the regulatIons are: Honltorlng wlll be requlred for all undergrour'd tarks cortalr:lng hazardous materials - no exemptlors. - 2 - GS:SS:EL:a Counc Il Meet H.g: F.uary 19, 1985 Santa ~"lca, Callforrla RelIrlrg of eXlstlrg tanks wlll rot be permltted; The lntel"Slty and frequency of monltorlng varIes accordlng to the tark' s poter'tlal for contamiration of the grourdwaterj Varlarces wIll not be automatIcally granted for secordary contaInment of plplng Slnce many leaks occur In the pipIng; An lnterlm monltorlrg program consIstIng of stringent tank testIng and Irvertory reconclllatlOl" will be allowed for up to three years for small buslnesses, ron-proflt organlzatlons ard governmental agercIes wlth non-leakIng tanks If they commlt to close (remove), replace wlth new tarks, or Ir'stall the requlred morltorlrg equlpmeY't On eXlstlY'g tarks. ~~onomlc Impact of Regulatlons or BusIness Staff antlclpates that some busInesses, especlally small ones, may be slgrlflcantly effected by the flscal impact of any undergrourd tank regulatlons. The costs of brInglrg a taY'k lnto complIance wlth any of the proposed regulatIons deperds upor the hydrogeology of the slte where a tank lS located. In a flscal Impact statement prepared by the State Water Resources Control Board, flve alterratlve costs were glver to brlrg an eXIstlrg tank up to stardards, dependlrg on the hydrogeology of the tank's locatlons. Staff artIcIpates that many small bUSiresses wlll not have enough capltal avallable to Immedlately meet the Clty'S undergrourd tank ordlnance. Staff therefore, has lrcluded ar InterlID ~1orltorlng Program for up to three years to allow buslnesses wlth nOI"-leaklng tanks to conform wlth the regulatlol"s wlthln thlS perlod or to remove (close) thelr underground storage facllltles. Proposed Admlnlstratlon of Underground ra~~ Regula~ions Staff estlmates that approxlmately 200 entltles ln the Clty own or operate urderground tanks Including: bUSlresses, utllltles, schools, ard 6 Clty departmerts. Permlts will be lssued for all of these tarks, although multiple tar'ks at one locatlon can be put or the same permlt. Based on a reVlew of past records, there wlll be about 10 new tank lnstallatlon permlt appllcatlons annually. Stafflng requlrements to process permlts fall lnto three dlfferert categorles: pIal" checklng, on-slte lnspectlons, and general admInIstratIve work. - 4 - GS:SS:EL:a CouncIl MeetlJ'lg: . If the County admlplsters the Clty's program, Staff has beer' told the total fIve year cost to the Clty would be approxImately $232,328 (lnformatlon from the County Ergu;eer) compared to a cost of approxlmately $110,000 for a Clty-admlr.lnstered program (over the flrst flve years). Slr:ce a Cou~ty admlr.istered program would be much costller ard the County lS r:ow already overburdened by the - 7 - GS:SS:EL:a Cour:cll Meetlng: FaUary 19, 1985 Sar:ta ~ca, Callfornla undergrourd tank demands of other cItIes, thlS alternatlve lS rot recommended. A fee wlll be charged for each perml t ar:d each t lme the permit lS rer:ewed or amended. These fees wlll offset costs incurred by the Clty to admlrlster the program. Present Clty Fees Pertalnlrg to Underground Tarks The fue department charges and wlll contInue to charge operators of certalr urdergrour:d tarks annual fIre permlt fees. These annual flre fees cover record keeping costs only and no annual lnspectlons are performed. Auto fuellng stations are charged $10 and storers of hazardous materlals $15. Addltlonally, rew tark lrstallatlons are charged a one-tlme fee of $45 per tark and there lS a $15 per tank fee for removal, both of WhlCh are charged by the Flre Department. However, all other types of buslr.esses, such as car dealers and dry cleaners wlth a flammable gasollne tarks are rot charged any arnual fee. Ir summary, many buslnesses In Santa Monlca are operatlng ur:dergrourd tank wlthout paYlng any kir:d of fee. - 8 - GS:SS:EL:a Cour'cll t1eetH:g; . February 19, 1985 . Santa MonIca, Callfornla Proposed Fee Schedule The proposed fee schedule lS deslgned to recover all adml~lstratlve costs related to thlS program. Staff anticipates that lt wIll take more tlme lnltlally to bring a busHiess u,to complla~ce with the underground tark ordlnarce because plar checks and Sl te lrspectlons wlll be requlred of leak detectlon ard monltorlrg systems. Therefore, the proposed fee schedule has hlgher fees for lnltlal permlttlng as compared to renewal permits. Although the ordirance mandates lnspectiors o~ly orce every three years, staff belleves ar effectIve program reqUlres more frequent ir.spectlons. Other local government programs of WhlCh staff lS aware call for arnual lrspectlons.
