Ordinance Adding Chapter 5A to the Santa Monica
Municipal Code to Prohibit the Sale and
Possession of Assault Weapons and Declaring the
Presence of an Emergency
At its meeting on February 14, 1989, the city council
directed the City Attorney to prepare an ordinance prohibiting
the sale and possession of assault rifles. In response to this
direction, the accompanying ordinance has been prepared and is
presented to the City Council for its consideration.
The accompanying ordinance adds Sections 3520-3524 to the
Santa Monica Municipal Code. Modeled after an ordinance adopted
by the city of Los Angeles, these sections define assault rifles,
prohibit their sale and possession, and establish various
exemptions.
The sale of assault rifles will be prohibited immediately.
Possession of assault rifles will be prohibited starting on May
1, 1989. A longer time period for possession is established so
that individuals have adequate time to dispose of any assault
rifle in their possession.
The ordinance is presented as an emergency ordinance.
