IntroductIon
This report recommends that Council adopt a resolution naming
persons authorized to execute documents in accordance with the
Federal CIvil Defense Act of 1951.
Background
The current CIvil Defense Resolution is outdated because of
personnel changes in the position of Emergency Services
Coordinator. It is necessary to update the resolution naming
persons authorized to execute documents for Santa Monica
Emergency Services.
Budget/Financial Impact
There IS no financial Impact associated with thIS recommendatIon.
Recommendation
It is recommended that the CIty Council adopt the attached
resolution designating John Jalili, City Manager; Lynne Barrette,
Assistant City Manager; James F. Keane, Chief of Police; and
Laura D. Hernandez, Emergency Services Coordinator; to execute
documents in behalf of Santa Monica Emergency Services pursuant
to the Federal Civil Defense Act of 1951.

Recommendation to Adopt state Emergency She 1 ter
Guidelines
INTRODUCTION
This report recommends that Council adopt the attached resolution
which would bring Santa Monica's guidelines for the rehabilita-
tion of buildings for use as emergency shelters into line with
state guidelines which were developed in response to the provi-
sions of AB 2579, Chapter 1691, 1984. This legislation allo\.,rs
the state of California to provide priority funding for emergency
shel ters in those jurisdictions which have adopted the state
guidelines.
BACKGROuND
On September 30, 1984 Governor Deukmej ian signed Assembly Bill
2579 into law. The purpose of AB 2579 is to address the special
housing needs of homeless persons and families living in the
State of California by providing guidelines and funding for emer-
gency shelters for the State's homeless.
Section 50a07(c) of the Health and Safety Code states that the
Department of Housing and Community Development may provide
priority funding for emergency shelters in those jurisidictions
that adopt the guidelines established by the Department.

The State Guidelines have been reviewed by the City's Building
and Safety Department which found that the guidelines are mod-
eled on Building Code provisions for dormitories and similar
"housing type II occupancies.
The gUldellnes address only baslC

safety and sanitation concerns but are less restrictive than per-
manent housing code provisions.
City Building and Safety staff
have no objections to local adoption of these guidelines.
BUDGETARY/FINANCIAL IMPACT
When and if monies are forthcoming from the State for emergency
shelters, Santa Monica would be given priority for funding if
these state guidelines are adopted.
RECOMMENDATION
It is recommended that Council adopt the attached resolution
regarding state emergency shelter guidelines.

LEGISLATIVE FINDINGS:

The Legislature finds and declares that because of economlC~
physical, and mental condltlons that are beyond t~e1r controlt
thousands of 1nd1vlduals and fam1lies in Callforn1a are homeless.
Churchest local governmentst and nonprof1t organ1zatlons prov1ding
ass1stance to the homeless have been overwhelmed by a new class of
homeless: famll1es wlth childrent individuals with employable
Sk111st and formerly middle-class fam,11es and indlvlduals w1th long
work h1storles.
The programs provided by the state, localt and federal governme~tst
and by pr1vate 1nst1tut1onst have been unable to meet eX1st1ng needs
and fu~ther action lS necessary. The Leglslature flnds and declares
that twa levels of houslng aS51stance are needed: an emergency fund
to supplement temporary shelter programst and a fund to facl11tate
the preservat10n of eXlst1ng hous1ng and the creat10n of new housing
Jnlts a&fordable to very lOW 1ncome households. It is 1n the publ1C
1~terest for the State of Cal,fornla to provlde th1S asslstance. The
Leg1slature further flnds and declares that there lS a need for more
lnfor~at1on on the ou~bers of ho~eless and the causes of
~omelessnesSt and for syste~at1c exploration of more co~prehenslve
Solutlons to the problem. Both local and state government have a
role to play io 1dentlfYl~g, understand1ngt and dev1s1ng Solut10ns to
the proJlem of homelessness.
102 AUTHORITY:
Pursuant to the authority of Section 50807 of the Health and Safety
Code the Department shall establlsh m1nimuM guidellnes for the
rehab111tatlon of emergency shelters to assure thelr min1mum
habitab1llty. The gU1del1nes may be adopted by any citYt county, or
Clty and county. The guidellnes shall assure that the puo11c healtht
safetYt and welfare 1S protected wh1le recognlzlng the temporary
nature of these facilitles and the urgent need for thelr
construct1on. These gUldelines shall be publlshed with1n 90 days of
the effectlve date of this statute.
(b) Notwlthstandlng any other provision of law, any Clty,
county, or Clty and county may waive or change elther, or botht of
the following:
(1) Any local changes or modiflcat1ons made pursuant to
Sect10n 17958.5.

(2) Requlrements for lnspectlon of constructlon by local
officials for structures rehabil1tated with funds provided pursuant
to th1S chapter 1f that w31ver or change does not lmpa1r the public
health and safety. However, no Clty, county, or clty and county
shall waive or change any provlsion contained in the State BUlld1ng
Standards Code or any state buildlng standard, or adopt any other
walver or change which would authorlze changes 1n the means of egress
or the adequacy of eXlts from bU1dings necessary for f1re protection
and prevention.
(c) The Department may provide priority to the funding of
emergency shelters in jurisdlctlons WhlCh adopt the gUldellnes
established by the Department pursuant to subd1vis1on (a) or which
adopt wa1vers or changes perm1tted by 5ubd1vis1on (b).
104 CONSTRUCTION AND MAINTENANCE:
flhere provi ded all tef11porary housing shall be canst ructed to provi de
safe and sanitary houslng for short duration, human hab1tation and
use. Projects compr1s1ng temporary houslng facl1ities may include
manufactured housing, commercial coaches, RVs, bUl1d1ngs and other
structures designed and constructed or lnstalled withln the followlng
gUldellnes and referenced requlrements.
Once constructed, all such facll1t1es shall be ma1nta1ned 1n such
manner as to assure a safe and san1tary llvlng environment for the
occupants.
106 SUPPLEtfENTAL STANDARDS:
Standards and requirements supplementing the provls1ons of these
gUldelines are contalned 1n the Callforn1a Adminlstrat1ve Code,
Tltle 25. Those chapters, as applicable. shall be referenced.

108 STRUCTURAL REQUIREMENTS:
(a) General. The exterlor walls and roofs shall have the
capac1ty to provlde shelter for the occupants from the elements and
to reSlst all lmposed loads designated for the geographlc reglon.
(b) Footlngs. Footings, foundations, or other supporting
systems shall be capable of support1ng all lmposed loads.
(c) Walls. Walls, partltions, and all vert1clal members shall
be of sufrlclent Slze to support lmposed loads.

(d) Horlzontal Members. Floors~ roofs, ceilings and other
horizontal members shall be of sufflClent Size to carry imposed
loads.
110 SANITATION REQUIREMENTS:
(a) General. TOilets, lavatories, bathtubs or showers shall be
prOVided in adequate numbers. Such facilities, including a kitchen
sink, shall be provided in all dwellings or dwellings units, where
community sleeping faci1itles are prOVided, there shall be tOilets.

shall be prOVided on the premises and in no case further than 200
feet from any sleeplng room or dormitory.

(J) Fixtures. All plumbing fixtures shall be connected to a

(c) Water Supply. There shall be a continuous supply of potable
wat~r at a mini~un 15 lb. pressure to all available water outlets and
plu~bing fixtures.
(d) Heatlnc. Heatlng facilities shall be installed to naintain
a tem~erature of 680 F. at a distance of 36 lnches above the floor
level of all habitable rooms.
{e) L19ht and Ventilation. Except where adequate lightlng and
mec1anlcal ventilation are prOVided, natural light and ventl1ation
snell be provlded for all habitable rooms. Exterior openlngs shall
be orovided In the ratlo of 1/12 of the total floor area of each room
wltn 1/2 of such area being openable.
112 SPACE AND OCCUPANCY REQUIREMENTS:
(a) Room Dimensions. Room and space dlmenslons shall be
calculated for each habitable room to avold over-crowdlng for
sleeplng areas and dormitories, there shall be a mlnlmum of 100
square feet for the first occupant plus 50 square feet for each
additlonal person to be exclusive of any eXlt way or other use wlthin
eacn sleeping room or dormitory.
(b) EXlts. EXiting faCillties approved by the local flre
depart~ent shall be provlded from each habitable room or occupied
area.
114 GAR8AGE:
Adequate garbage and rubblsh storage facillties shall be prOVided,
malntalned and serviced.

accordlng to the manufacturerls lnstruct1ons. Unvented gas
appllances shall not be lnstalled or used 1n habltable roo~s.
