SUBJECT: OrdInance AmendIng Uniform AdmInIstratIve Code and
UnIform FIre eode RegardIng Permlt ProcessIng Fees
The accompanYIng ordinance will amend the UnIform
AdmInIstratIve Code and the Uniform FIre Code to Increase
permIt proceSSIng fees 1n accordance with the fee schedules
proposed for the 1985 ed1tIons of the uniform technIcal
codes.
Health and Safety Code Section 17951(c) authorIzes
the CIty to establish permIt proceSSIng fees prOVIded such
fees
do not exceed the amount reasonably reqUIred to
admInIster
or
process
such
permIts
IncludIng
code
enforcement.
The C~ty IS currently applYIng the fee schedules
contalned In the 1976 edltIon of the unIform technlcal codes
as adopted by OrdInance Number 1055 (CCS) on January 25,
1977.
These fees were not amended when the CIty adopted the
1979 editions of the un~form technIcal codes. ThIS ordInance
would apply the fees schedules contaIned In the 1985 edItIons
of the unIform technIcal codes WIth very mlnor modIficatIons
roundIng off cumbersome percentage f1gures.
Based on the
revIsed fee schedules,
it IS antICIpated that CIty permlt

revenues wIll Increase by 50%, thereby makIng up the current
shortfall In fees to cover costs.
The BUIldIng and Safety Department has prepared a study
WhICh Illustrates the relatIonshIp between proJected CIty
costs and the proJected revenues under the eXIstIng and
proposed fee schedules. ThIS study Includes a table of
proJected CIty operating costs (Attachment 1) and a table
demonstrat1ng present and proJected perm~t revenues IncludIng
a comparison to CIty of Los Angeles permIt fees (Attachment
2). The study concludes that based on present bUIlding
actIVIty levels, proJected annual CIty permIt proceSSIng
costs will be $640,000 and current CIty permIt fees would
generate $432,000. Based upon the proJected 50\ Increase In
the fee schedules, proJected CIty revenues WIll closely
parallel foreseeable City costs. It 1S not antICIpated that
applYIng the proposed fees WIll generate any CIty revenues
beyond the costs necessary for permit proceSSIng. In the
event that revenues were to exceed costs, a corresponding
reduct~on 1n future fees would be requ1red.
The fIrst readIng of th~s ord1nance was ~nlt~ally
scheduled for February 26, 1985, to correspond w~th the first
read2ng of the ord~nance adoptlng the 1982 technlcal codes.
The f1rst readlng of both ordinances was rescheduled for
March 12, 1985. In accordance WIth Government Code Sectlon
54992, a copy of the staff report was malled on February 21,
1985, to any person requestlng such notIce.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING THE UNIFORM ADMINISTRATIVE
CODE AND THE UNIFORM
FIRE CODE WITH REGARD TO
PERMIT PROCESSING FEES
WHEREAS, the BUlldlng and Safety Department has not
revIsed Its bUIlding permIt fees SInce 1977; and
WHEREAS, the cost of enforcIng the bUIldIng codes has
Increased substantIally SInce 1977; and
WHEREAS, Health and Safety Code SectIon 17951 prOVIdes
that
the CIty may Increase permIt fees by the amount
reasonably reqUIred to admInister and process the necessary
permIts and to defray the cost of enforCIng the buildIng
codes; and
WHEREAS, the CIty has complIed WIth Government Code
SectIon 54992 and gIven notIce of the tIme and place of this
hearIng by maIlIng such notIce at least 14 days prIor to thIS
hearIng to any person reqUestIng such notIce; and
WHEREAS, at least 10 days prIor to thIS hearIng data was
avaIlable to the publIC IndIcatIng the amount of cost, or
estImated cost, of the serVIce for WhICh the fees are leVIed
and the revenue sources antlclpated to provide such serv~ce,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Table Numbers 3-A through 3-F of the UnIform
Adm1n1stratIve Code, 1982 EdItIon, adopted by Mun1cIpal Code
SectIon 8101, are hereby amended to read In accordance WIth
the attached Exhlbltg A through F WhICh are Incorporated
here1n by thIS reference as If set forth In full.
SECTION 2. SectIon 4.108 of the Uniform FIre Code, 1982
EdItIon, adopted by Mun1c1pal Code SectIon 8105, IS hereby
added to read as follows:
Section 4.108(a)
PermIt Fees. The
fee for each permIt shall be as set forth 1n
Table Number 4-A.
(b) InvestIgatIon Fees. Whenever any
work tor WhICh a permIt IS requIred by thIS
code has been commenced WIthout fIrst
obtainIng saId permIt, a speCIal
InvestIgatIon fee shall be made before a
permIt may be Issued for such work. An
InvestIgatIon fee, In addItIon to the
permIt fee} shall be collected whether or
not a permIt IS then or subsequently
Issued. The InvestIgatIon fee shall be
equal to the amount of the permIt fee
requIred by thIS code. The mInImum
InvestigatIon fee shall be the same as the
mInImum fee set forth In Table Number 4-A.

The payment of such ~nvest~9atlon fee shall
not exempt any person from compl~ance w~th
all other provIslons of thlS code nor from
any penalty prescr1bed by law.
(c) F~e R~tunds. The Flre Marshall
may author1ze the refundlng of any fee pa1d
hereunder Wh1Ch was erroneously paId or
collected.
SECTION 3. Table Number 4-A of the Uniform F1re Code)
1982 Edltlon, adopted by Munlclpal Code Sectlon Bl05, is
hereby added to read In accordance w1th the attached Exh1bit G
WhlCh lS 1ncorporated hereln by th1S reference as If set forth
In full.
SECTION 4. Any provislon of the Santa Monica Munlcipal
Code or appendlces thereto lnconslstent wlth the provlslons of
th1S ordlnance, to the extent of such inconslstencles and no
further, are hereby repealed or modlf1ed to the extent
necessary to affect the proviSIons of thlS ordinance.
SECTION S. If any sectlon} subsectlon} sentence,
clause, or phrase of this ordinance 1S for any reason held to
be Invalld or unconstltutlonal by a deCISIon of any court of
competent Jur1sdlctlon, such dec1sIon shall not affect the
valldity of the remaInIng portlons of the ordInance. The CIty
eouncil hereby declares that It would have passed thIS
ordInance and each and every sectIon, subsect1on, sentence,
clause or phrase not declared 1nvalld or unconst1tut1onal

w~thout regard to whether any port~on of the ord~nance would
be subsequently declared 1nval~d or unconst~tut1onal.
SECTION 6.
The mayor shall sign and the city Clerk
shall attest to the passage of th~s ord1nance. The C~ty Clerk
shall cause the same to be publ~shed once In the offlc~al
newspaper wlth1n 15 days after lts adoptlon. The ord~nance
shall become effect1ve 30 days from ltS adoptlon.
