In response to this dlrectlon, the acconpanYlng Staff Report has been prepared. ThlS Staff Report wlll analyze state and federal laws that prohlblt dlscrimlnation in employment, houslng and serVlces. Thereafter, the Staff Report wlll analyze approaches taken by other munlcipalities ln this area. Flnally, the Staff Report will analyze optlons available to the City Council. JUN 2 6 1IS4 Callfornia Constltutlon. In Gay Law Students Associatlon v. Paclflc Telephone & Telegraph Co., 24 Cal. 3d 458, 595 p.2d 592, 156 Cal. Rptr. 14 (1979), the Callfornla Supreme Court stated: [W]e begln froD the pre~ise that both the state and federal equal protectlon clauses clearly prolllb1 t the state or any governmental entity from arbltrarlly dlscrlmlnating agalnst any class of indlvidua1s in employment decislons. Moreover, past decisions of thlS court establish that thlS general constltutional applies to homosexuals as princlple well as to all other members of our polltYi under Callfornla law, the state may not exclude homosexuals as a class from employment showing opportunltles wlthout a that an lndlVldual's homosexuality renders hlm unflt for the Job from WhlCh he has been excluded. Id. at 467, 595 P.2d at 597, 156 Cal. Rptr. at 19 (cltatlons omltted and emphasls deleted). 2. Tltle VII of the C1Vll Rights Act. Title VII of the civll Rights Act of 1964 wakes lt unlawful for most employers to discrlITinate against an lndlvldual because of race, color, 2 re11g10n, sex or natlonal orlgln. 42 D.S.C. ~ 2000e-2. Although Tltle VII prohlbits dlscrmination on the basls of sex, the 9th Clrcult Court of Appeals has held that the deflllltlon of sex withln Tltle VII applies only to gender and does not apply to sexual orientatlon. DeSantls v. Paclflc Telephone & Telegraph Co., 608 F.2d 327 (9th cir. 1979). See also Smlth v. Llberty Mutual Insurance Co., 569 F.2d 325 (5th Clr. 1978); Holloway v. Arthur Andersen and Co., 566 F.2d 659 (9th Cir. 1977). 3. Callfornla Falr Employment and Housing Act. The Callfornla Falr Eouslng and Employment Act prohiblts emploYRent dlscrlminatlon on the baS1S of race, religlous creed, color, natlonal orlglD, ancestry, physlcal handicap, medical condition, marital status, sex or age. Government Code Section 12900 et seq. The Callfornia Supreme Court has held that thlS Act does not prohibit dlscrimination on the Dasls of sexual orlentatlon. See Gay Law Students Assoclation v. Paciflc Telephone & Telegraph Co., 24 Cal. 3d 458, 595 P.2d 592, 156 Cal. Rptr. 14 (1979). 4. The Unruh C1Vll Rlghts Act. The Unruh clvil Rights Act prohlblts arbltrary dlscri~inatloD by business establlsh~ents houslng. (The employment.) ln the sale of goods Unruh C1Vll Rlghts The Unruh C1Vll Rlghts or serVlces, including Act does not apply to Act clearly prohlblts dlscrlminatlon on the baS1S of sexual orlentatlon. In Stoumen v. Rellly, 37 Ca1. 2d 713, 234 P.2d 969 (1951), the Supreme Court stated that the Unruh Act prohlblted the excluslon of 3 homosexuals from a public bar or restaurant. In Hubert v. Williams, 133 Ca1. App. 3d Supp. 1, 184 Cal. Rptr. 161 (1982), the Super~or Court Appellate Department held that under the Unruh C~v~l R~ghts Act, "landlords may not refuse to rent an apartment to a homosexual solely because of that person's sexual preference." LOCAL ORDIKANCES Many local c~t~es and countles have established pol~c~es prohlbltlng d~scrlmination based on sexual orlentatlon. The follow~ng ~s a summary of some of these ordinances: Berkeley. In Munlc~pa1 Code was Berkeley, Chapter 13.28 of the Berkeley enacted ~n 1978 to make dlscrlffilnatlon based on sexual or~entat~on unlawful ~n all circumstances ln which discrirnlnatlon based on race, color, relig~on, sex or national orlgln are unlawful under state and federal law ThlS Chapter prohibits such discri~ination public and pr~vate employment practices, within in the the C~ ty . areas of houslng pract~ce and other real estate transact~ons, bUSlness practlces, c~ty fac~lities and services and educatlona1 lnstltutlons. In addltlon, the Chapter provides for C1Vl1 remedles lnc1udlng damages and inJunctive rellef. the Berkeley law is contalned ln Appendlx A.) (A copy of Los Angeles. In 1977, the City of Los Angeles enacted Los Angeles Munlcipal Code Seetlon 49.70 through 49.80 which prohlbits dlscrlmination based on sexual orlentation and WhlCh 4 covers the same areas as the Berkeley law. (A copy of the Los Angeles law lS contained ln Appendlx E.) County of San Mateo. The County of San Mateo enacted Ordinance NuMber 2334 WhlCh contalns a declaratlon of pollCY against varlOUS forms of dlscrlmlnat1on, 1ncludlng discrlmlnation on the baS1S of sexual orientatlon. Remedies are Ilm1ted to investlgation by a Human Relations Com~lsslon. (A copy of the San Mateo law is contalned 1n Appendlx C.) County of Santa Cruz. ~he County of Santa Cruz, by Ord1nance Number 2847, dated January 22, 1980, provided for equal emp10Yffient opportunities for all persons regardless of the1r sexual preference. The law is linited to employment practlces of the County of Santa Cruz. (A copy of the Santa Cruz law 1S contalned in Appendix D.) C1ty of Oakland. In 1984, the City of Oakland enacted Ordinance Number 10427 prohibiting discrimination on the basis of sexual orlentation. In addition to provldlng for varlOUS C1Vl1 remedies, the law provldes for crlIDlnal sanctlons. (A copy of the Oakland law is contained in Appendix E.) Clty and County of San Francisco. The City and County of San FranC1SCO has by ordinance provided equal econonic, politlcal and educatlonal opportunltles for homosexuals, equal accommodatlons ln all buslness establlshments In the Clty and County and for equal serVlce and protection by publlC agencles for homosexuals. No prlvate civil remedies are contained in 5 the law. (A copy of the San FranC1SCO law lS contalned In Appendlx F.) Clty of LagQDa Beach. In 1984, the Clty of Laguna Beach added Chapter 1.07 to the Laguna Beach Municlpal Code to prohlb1t var10US foms of dlscrlIillnatlor::. on the bas1s of sexual or1entatlon. The law lS Slmllar to the laws adopted by the Clty of Berkeley and the Clty of Los Angeles. (A copy of the Laguna Beach law 18 contalned 1n Appendix G.) City of Sacr~ento. Sacramento, by the adopt1on of Resolutlon Number 83-1012, amended the City's affirmative actlon plan to proh1blt employ~ent d1scrlIDlnatlon based on sexual orlentation. The affirmatlve actlon plan app11es only to hlring practlces of the Clty of Sacramento. (A copy of the Sacramento law 1S contalned In Appendlx H.) LOCAL OPT IO;o.;rS The Clty Councll has ava11able to lt two princlpal optlons to cons1aer: 1. Take no act1on. In the event no action lS taken, the C1ty of Santa Monica and other public entities and ut1lltles would De the only employers 1n the City of Santa t>lonlca prohiblted frolT' discrirr>inatlng on the basls of sexual orlentation. However, all buslness establlshments subJect to the Unruh Act would be prohlblted from dlSCrliTIlnatlng on the bas1s of sexual or1entatlon 1n the sale of goods or serV1ces. 6 2. Adopt an ordinance s~m~lar to the City of Berkeley, the City of Los Angeles, the C~ty of Oakland, or the City of Laguna Beach. It seems reasonably clear that the C~ty of Santa Monica has legal author~ty to adopt legislation ~n th~s area. In 1979, the C~ty of Santa Mon~ca adopted a Fa~r Hous~ng for Children Ordlnance. This ordinance prohibited dlscrlmlnatlon agalnst fam~l~es w~th ch~ldren in the rental of residential un 1 t s . Hon~c a At the time, ~t was argued that the C~ty of Santa lacked Jur~sd~ct~on because these matters were excluslvely covered by the Unruh Act and the Fa~r Employment and Housing Act of the State of Cal~forn~a. In San Jose Country Club Apartments v. County of Santa Clara, 137 Cal. App. 3d 948, 187 Cal. Rptr. 493 (1982), the Court of Appeal held that a Fair Hous~ng for Ch~ldren Ordlnance of the County of Santa Clara was not pre-empted by State law. In that case, the landlord argued at the local ordlnance was proh~b~ted by the Unruh civll Rlghts Act and the Falr Employment and Hous~ng Act. In connectlon wlth regulat~on of prlvate employment practices, the Clty lacks the authority to regulate matters encompassed by the Falr Employment and Housing Act. Goverr~ent Code Sectlon 12993 provides in subdlV1Slon (c): While lt lS the lntention of the Leglslature to occupy the fleld of regulatlon of disc rllnlnatlon in employment and houslng encompassed by 7 the provislons of thlS part, exc1uslve of all other laws banning discrimlnatlon in employment and houslng by any Clty, city and county, county, or other pOll tical subdivision of the state, nothlng contalned ln this part shall be construed, ln any manner or way, to 1lmlt or restrict the app1lcatlon of Section 51 of the C1Vl1 Code. Although there lS no appellate decision squarely on thlS point, munlclpa1 legal officers throughout thlS State have taken the posltion that this Section pre-empts local regulation only lnsofar as the regulatlon lS "encompassed by the provls1ons" of the Fair Employment and Houslng Act. Slnce prohloitlons on dlscrlIDlnation on Act the does not contain the Falr Employment and Housing baslS of sex ua 1 orientation, any local regulation which limlted its scope to the prohibltlon of dlscrlmination not covered by the State law would not be pre-empted. NotWithstanding the above, the prOViSIons of this sub- section may be complied WIth by addmg the words "sexual onentation" to all " "'--- , J notIces required by federal or state law, and indIca+mg on the notice that discnmmation on the basis of sexual orientatIon is prolubited by the Berkeley MuniClpal Code, Sections 13.28,010 through 13.28.100. 3. Penalty for Noncompliance. Wilful violatIons of this subsection shall be punIShable by a fme of not more than fifty dollars for each offense. Transactions Generally. It shall be an unlawful real estate practIce for any person to mterrupt, termmate or faIl or refuse to whate or conduct any transactIon in real property, including but not hm.1ted to the rental thereof, to require different terms for such transaction, to mclude in the terms or condItions of a transaction 10 real property any clause, conditIon or restnction, or falsely to represent that an mterest in real property is not ava.dable for transaction, on the basis of any indIvidual's sexual onentabon. 2. Credit and Insurance It shall be an unlawful real estate practIce for any person to refuse to lend money, guarantee the loan, accept a deed of trust or mortgage, or otherwise refuse to make available funds for the purchase, acqUlSl- tion, constructJ.on, alteratlOn, rehabih- tabon, rep3lI' or mamtenance of real property, or impose d1ff~rent conmtJons on such fmancmg, or refuse to provide title or other InSurance relatIng to the ownership or use of any mterest m real property, on the b3S1S of any mdividual's sexual onentatlOn. 3. Tenant's Services. It shall be an unlawful real estate practice for any person to refuse or restrict facilities, serVlces, repairs or improvements for any tenant or lessee on the baSlS of any individual's sexual onentation. 4. Advertismg. It shall be unlawful to do any of the actions mentioned in subsections (A)(!) through (A)(4) for any reason that would not have been asserted but for th.e sexual onentation of any individual. C_ ExceptJons. 1. Owner Occupied and Small Dwellings. Nothlng in this chapter shall be con- strued to apply to the rental or leasmg of any hOUSIng umt m which the owner or lessor or any member of his or her fanuly occupies one of the living units and eIther: (a) it is necessary for the owner or lessor to use either a bathroom or kItchen facility in common WIth the prospective tenant; or (b) the structure contains less than three dwelling umts. 2. Effect on Other Laws. Nothing In th~_'r.. chapter shall be deemed to pernut any rental or occupancy of any dwelling urn t or commerCIal space otherwise prolublted by law. It shall be an unlawful service practice for any person to deny any individual the full and equal enJoy- ment of. or to place different terms and conditions on the availability of, the use of any city facility on the b8SlS of such indiVIdual's sexual onentat1on. 2. City Services. It shall be an unlawful service practJ.ce (or any person to deny any individual the full and equal enJoy- ment of, or to impose different terms or conditions on the aV:llil~bi1ity of. any city service on the basis of such mdi- vidual's sexual onentation. 3. Supported Facilities and Services. It shal1 be an unlawful seroce practice for any person to deny any indiVidual the full and equal enjoyment of, or to impose different terms and condro.ons upon the availability of. any service, program or facility wholly or parti'Qtly funded or otherwise supported by the city on the baa5 of such individual's sexual orientation. This subsection shall not apply to any facility, service or program which does not receIve any assistance from the city wtuch is not provided to the public generally. 4. AdvertJ.slI1g. The rules prescrlbed by the C1V1l SerVlce Commission shall provlde for a perlod of probation not less than SlX months nor more than one year immed1ately followlng appolntment or promot1on before such appointment or promotion 1S made complete, during which perlod a probatloner may be discharged, suspended, or reduced to hlS prevlous work without rlght of hearlng ln the matter, and h1S name may be removed from the eligible 11st. SECTION XXII Section 4.05.540 of the Santa Cruz County Code is hereby amended to read as follows: 4.05.540 REJECTION DURING PROBATION AFTER PROMOTION. The rules ~rp~~rlbed and enforced by the Civil Service Commission shall provlde that any employee reJected during the probation perlod from a pos1tlon to which he was promoted shall be relnstated to the position from which he was promoted. Any employee in the Classifled Servlce who is promoted or transferred to a posit1on not lncluded 1n the Classified Service shall be reinstated to the class from Wh1Ch he was promoted or transferred if within six months after such promotlon or transfer act10n is taken to dism1ss him. However, 1n either of the cases provided for in this section, the employee may be discharged from the class in the ~lassified Servlce from which he was promoted or transferred in the manner provided and the rules established hereunder for the discharge of employees from the 21assified Service. The rules prescribed and enforced by the "C1vil Service Commission shall provide for temporary appointment of persons on suitable eligible lists for a period not to exceed 1039 hours in a fiscal year in a department. The acceptance or refusal to accept such temporary appointment on the part of the persons on the eligible list shall not be a bar to appo~ntment to a permanent position from such elig1ble llStS. SECTION XXIV Section 4.05.560 of the Santa Cruz County Code is hereby amended to read as follows: 4.05.560 PROVISIONAL APPOINTMENTS PENDING EXAMINATION. In the absence of an appropriate el1g1ble llst, provlsional appointments may be made without examlnation, wlth the consent of the Co~~ission, but no such provlsional appointments shall continue longer than the follow1ng: (a) For Department Head pos1tions - 180 days. (b) For other pos1t~ons - 90 days. Successive provlsional appolntrnents shall not be allowed; except that one addltlonal temporary authorization for the same length of t1me as the origlnal provlsional appointment may be approved. SECTION XXV Sect~on 4.05.570 of the Santa Cruz County Code is hereby repealed. SECTION XXVI Section 4.05.600 of the Santa Cruz County Code is hereby amended to read as follows: ~05.600 SEPARATIONS FROM CLASSIFIED SERVICE, DISCIPLINARY ACTIONS--AND LEAVES. The rules prescr~bed and enforced by the Civil SerVlce Co~~ission shall provide for the separation from the Classified SerVLce of employees through layoff, suspension, or dismlssal, and for demotions or leave of absence for incapacity or inabllity to perform required duties. l~ -6- ( ) SECTION XXVII Sectlon 4.05.610 (b) of the Santa Cruz County Code is hereby amended to read as follows: (b) The offlcer or employee within seven days after presenta- tion to h~m of the order may appeal through the County Personnel Director to the Civil SerVlce Commission from the Order. Upon filing of the appeal, the County Personnel Director shall forth- with transIDlt the order and appeal to the Civil Service Commission _for hearing. SECTION XXVIII Sectlon 4.05.635 is hereby added to the Santa Cruz County Code to read as follows: 4.05.635 STATUS DURING LEAVE OF ABSENCE -- SUBSTITUTE APPOINTMENTS No new employee or probatloner taklng the position of a permanent employee in the Classified Service who has been granted a leave of absence shall acquire other than probat~onary status in the Classlfied Serv~ce In such position until the expiration of such leave of absence, and any extension or renewal thereof. Any permanent employee In the Classified Service who requests reappoint- ment to the position held by hlm prior to the time he was granted leave of absence, dur~ng the per~od of such leave of absence, or any extens~on or renewal thereof, shall be reappointed to such positlon. In event of severance from serv~ce by reason of such reappolntment of such permanent employee, the probationer shall have hlS name returned to the ellgible lists. Appolntment to a probatlonary status by a new employee taking such pos~tion during the leave of absence granted a permanent employee shall not be a bar to such probatloner mak~ng applicatlon for examination held under the provislonS hereof for appointment to any position declared open for such examination. All applicants for appo1ntment shall apply to the Personnel Department. Qualified applicants shall be exam~ned as provided in the Ordinance of the County of Santa Cruz establishing a Limited Civ~l Service (Chapter 4.05) and the regulations adopted thereunder. Currently before the Cahfornia State Legislative is a bill, AB 1 (Agnos), to make dIscriminatIOn on the baSIS of sexual orIentation an unlawful employment practice. It would, if passed, change the Fair Employment and Housing Act to require most employers to treat their employees and appbcants for employment without regard to sexual orientation (AKA sexual preference). At the request of CouncJlmernber Shore, staff has researched the issue and are proposing three amendments to the CIty's Affirmative Action Plan to make sexual orIentation discriminatIon an Improper employment practice. The amendments would: ~ ~7 1. Add the term "sexual orientation" to the list of dIscrIminatory employment practIces. (Paragraph 1 of the Equal Employment Opportumty General PolIcy Statement - Exhtbit A). 2. Add a 11st of defimtions to the Affirmative Action Plan. The list mcludes a deftmtion of the term "sexual ortentation". (Exhtblt B) 3. Add language to make a violatIOn of the City's "Equal Employment Opportunity General Policy Statement" a factor under WhICh a person could fIle an mternal dIscrIminatIOn complamt. However, there are a couple of thlngs about that ordinance I would like to comment on. Flrst I think the definition of sexual orientation used in Los Angeles ordInance, is better replaced by the definition provided In the ordInance from the CIty of Oakland. It is both much clearer and understandable than the CIty of Los Angeles'. I am not sure qUI te what 1 t means. Secondly, one of the key Issues in this ordInance I would lIke to hear from Councll people about has to do with the nature of the penaltIes involved to assure complIance - 1 - wIth an ordInance the CouncIl adopted. The City of Los Angeles provIdes that any person may seek cIvil actIon or that the Ci ty itself may seek CIVIl actIon. It also prov ides that the CIty or the ... person may seek InJunctive relIef in a court. I would lIke to ask the City Attorney if he would comment on thIS. The ordInance In Oakland provIdes, ItS major difference from other ordInances IS that it also provIdes for crimInal penalties. It seems to me that, I would llke the Clty Attorney's comment on thIS, that the provIsIon of lnJunctlve rellef, should the inJun- tion, HI fact be VIolated provldes the approprlate occasion for any crIminal penaltIes, should they be Invoked because it indi- cates a pattern of practice. I personally think that criminal penaltIes should be reserved for Instances where there is a sig- nifIcant patter of practIce, rather than an occasion. Could the CIty Attorney comment on that? City Attorney: If the CIty Councll is inclined to adopt an ordInance, we would recommend both CIVll and crImInal penaltIes. FIrst of all, the measure that we are consIder lng IS not a measure that simply prohi bI ts d is- crImInatIon against gays by presumably heterosexuals, but in fact it also prohlb1ts such discrimination by gays agaInst het- erosexuals. It is a questIon of faIr- ness. We are not seek 1 ng to establIsh special privIleges for anybody, whatever, but rather to establIsh fair condItIons that all people can pursue theIr lIves, the pursuIt of happIness In thIS country wIthout unfaIr treatment. I think that whatever your feelIng about the appropriateness or Inappropr iateness of one sexual orIentation or another that the prIncipal of fairness to all people In these areas ought to apply. Throughout the debate and dIScussion, one thing has always been held to firmly and that is the value and worth of every human being and I thInk that It is the responsibIlity of government In a faIrI1Istic (spelling??) and democratIC socIety to protect the rIghts that are assocIated wIth the valueIng of every human beings lIfe and so I Intend to support thIS ordInance because I believe that in fact, elImInate or at least protect those people who are some of the victims of dIscrImInatIon where there shouldn't be dlscrIminatIon, even if In fact It doesn't elimInate that dlscr~minatlon. - 7 - MPT Press: Well, bas~cally I support Councllmember Reed's suggest~on that, and I th~nk that ~t meets the most serious con- cern of those persons from churches who testifIed about freedom of assoc Iation. I see no harm whatsoever ~n excluding churches and church schools. I feel as 1 f, yes, that 1 f one has a par- tIcular rellgIon and chooses to aSSoclate wIth people of like relIgion and IS willlng to accept the prIncIpals Involved in that religIon, that IS a matter of free associatIon. Where I cannot agree IS where It brIngs Into play, restaurants that are open to the publIC, which to me means anyone who is not Intoxicated or actIng In a fashIon that would be horrIbly disruptIve to the rest of the people there, so that means people of all races, ages, etc. I don't thInk that a publIC place that puts up a sign and goes In to bUSIness and says we are open to the publIC has any partIcular rIght to be making any kind of InqUIries about that persons sexuali ty of those people that enter. When you put up the SIgn, then that says you are open to the publIC and thIS is part of the publIC. As far as publIC accomodatlons, I thInk that IS very very clear that gay people pay taxes lIke the rest of us Into the City and that the CIty does not have the rIght then to d~scrlmlnate agaInst any class of people on what the CIty, the kInds of recreational faCIlItIes or publiC accomodations the CIty funds. That they should be truly open to all of the pUblIC. So I have read, my only concern IS with a word which universally was not acceptable to those persons, gay persons that I discussed this WIth at all and who had the opportunIty to read thIS since 1 t has been opened, this proposed ord inance has open to the - 8 - public for quite some time, and unIversally people were not par- tIcularly satIsfied or felt that the word or1entat1on was an up- dated word and that 1S was more acceptable to use the term preference, sexual preference. So that 15 semantIcs. em Epstein: I guess that as occasionally happens on this Councll, I am going to be a minorIty of one. I am not going to support this legislation and I want to explain why and I want to explaIn carefully because thIS IS an area WhIch evokes deep feel- ing 1n people on all sides of the Issue and I thought long and hard on th1S lssue. I want to say what I have to say very care- fully. I mlght add that I dld receive several communlcatlons from var ious reI igious groups, one or two In favor of the or- dInance and several opposed to it, esentially along the same lInes as the people who testIf1ed. I have not rece1ved any com- mun1catIons from anybody who says there are being discriminated agaInst or beIng oppressed or they are belng denIed opportunItIes by VIrtue of theIr sexual orientatIon, preference. I think In fact, as far as Santa Mon1ca 1S concerned (tapes sWItched here) . . . . . . Councllmember Press' statement that one expression was not updated and the other was, not up to date. I think th1S IS beIng promoted, not out of a real grass roots demand, not be- cause there is a major problem, but out of a Idealogical pre- dlSposltlon that some people have. If in fact there is no maJor massive dlscrlmination agaInst homosexuals, then what In fact IS belng sought IS an endorsement by the Councll of the pOSl tion - 9 - that some spokesman for the gay movement have a symoollc endorse- ment, If you will, of the View that homosexuality IS Just as good as heterosexualIty and the issue IS symbolIc and educatIonal, if you wIll, propagandlstlc rather than an Issue protecting IndI- v Iduals from d i scr iminat lon. Some people think that homosexual conduc t is wrong, some people think it IS wonderful. I don f t pretend that we should get Into that questIon. But, I don't think the Councilor government should put itself in the posi- tIon, of In essence when there is not a large group of people who are In fact being oppressed, aggrIeved or whatever, when It real- ly IS not gOIng to have a great deal of practIcal effect. I don't think the Counc 11 should put I tsel f In the pOSl tion of saying to one very large group of people who are angered and many many generatIons of tradItIon, that your VIews are not gOIng to be taken serIously and we are not gOlng to respect and then we are gOlng to say that, endorse the VIew which I st1ll thInk 1S a mInor1ty view in our SocIety, that heterosexuality and homosexuality are just the same. I don't think they are the same and I don't thInk there is any presslng need for us to adopt the pOInt of VIew that they are. Now, there is one or two techinal quest10ns I would urge the Counell to consider SInce it 1S ap- parent they are going to adopt an ordinance. FIrst of all you are talkIng about an exemption for church related InstitutIons. I think you also should an exemptIon for employment in people's homes, people'S reSIdences. Otherwise, you are going to reqUIre people who maybe deeply offended let say to h1re child care work- ers or nurses in theIr very homes. I thInk that 1S certainly an - 10 - ~ --t ~ ~\ ~nvaSlon of people's pr~vacy and an inapproprlate restrlctlon and I thInk the same applies to small famIly owned bUSInesses. While there maybe a case for saying to Von's or Lucky's or whatever, a large lnstItutlon that hIre people wlth regard to this. I don't think a small family bUSIness have the same responsibility, I think people should have the rIght to run them however they want. Cm Zane: I would like to make a motion to place before the Counci 1, I would lIke to that the Council direct the CIty Attorney to draft a measure 1 an ord Inance of the CIty of Santa Monica prOhibItIng discrimination on the baSIS of sexual, I am going to use the language orientatIon at thIS point because I have talked WIth several attorney's who have been working In the field and the language orlentat~on 15 In fact thought to be bet- ter because it is neutral as to the issue of whether thIS is a question of chOIce or a question of nature or a questIon of what and that 18 their adVice to remaIn neutral, the ordinance to re- main neutral to that question and so I am USIng that language at thIS pOInt, and would substItute the definition for sexual orien- tatIon, the CIty of Oakland's defInitIon, which ~s clearer, more d lrect, and to accept the adVIse of the Cl ty Attorney that the provision of misdemeanor penaltIes, for VIolatIon of the ordiance IS the most appropriate assurance the measure IS In fact effec- tlve, and would include that, and with that that 1S the motIon. So to create a scenarIO where six or more or less gay people go Into a restaurant and they tell them that It is a two hour walt and it IS ObVlOUS that other people are beIng taken before them, etc. f and that they are beIng mistreated and dIS- crImInated agaInst, and if they have no recourse, if they have no place to go WIth that complalnt where It will Yleld some kInd of effecti ve change In that at tl tude, then what do they do wi th that. So 1 t IS lIke Councllmember Epstein suggested that there be no place for there to go, and Just because there has not been some major organized or unorganized serIes of complaInts that we - 12 - should presume that no problem exists and everything is Just dan- dy In Santa Monica. Well, I don't believe that for a moment, and I don't think It is possIble to generate statistics to prove thIS statistically eIther. ~m Reed: Well, I just wanted to pOInt out for the bene- fi t of those who do have before them the compilatIon of ordl- naces. What Councilmember Zane IS IntroducIng here, does In fact already provIde several exceptIons or exemptIons and the, and then as Councilmember Zane indicated, he IS proposing to add more in. One of the exemptIons WhIch is provided In the Los Angeles Law and WhICh would be provIded In the Santa Monica Law havIng to do with the housIng section, IS an exemption for owner occupIed and small dwellIngs WhICh basIcally exempt from thIS law, persons who rent bedrooms out of their homes and persons who live on owner occupIed parcels of three units or less that IS the way in the Los Angeles Law. That along with Councllmember Zane's Inclu- SIon of the exceptIon or exemptIon for In-home employment, such as, I suppose, nursIng personnel or cleaning or ChIld care per- sonnel and the exemptIons of the churches and church related schools and day care centers. It seems to me to provide a level of exemptIon to gIve those persons who might be concerned that they would not be able to make some decisIons that would affect them very closely In theIr personnel lIfe, gIves them a right to make those decIslons In theIr homes and If they wIsh to discrlrnl- nate In their homes they WIll be allowed to do so baslcally. However, what thIS law is saYIng is those persons who are In - 13 - bus iness in the communI ty WIll not be able to dl scr iminate and they wIll not be able to dIscrImInate based on people they employ nor wIll they be able to dIscrImInate based on whom they deliver serVIces and I thInk that IS approprIate. I supported AB 1 and I urged the governor to sIgn It and I don I t see any particular problem at all wIth the CIty of Santa MonIca havIng its own lit- tle particular one, which IS what we are about to do. em Jennines: I also wanted to point out that one of the provISIons in this proposal IS that is says that nothing con- tained in this section, will be deemed to prohibit selection or rejectIon for employment based upon bona fIde occupational qualIfIcatIons so If the person doesn't meet what the reasonable quali ficatlons for the job are tit doesn I t mean the per son is entItled to get the Job. It IS Just that dIscrIminatIon based upon only someone's sexual preference 1S not allowed. If you have to be able to 11ft 500 pounds to get the job, you stIll have to be able to 11ft 500 pounds to get the Job, if it has something to do with the Job. And there are alot of other exceptions In here that basically I think except the things that are of greatest concern to people, and they should be treated l1ke everybody else. em Epstein: I would like to respond very brIefly to what Councllmember Press sald. I am not suggestlng that there not be places for everybody that wants to go and I look around the com- munIty and I don't see that there are no places for people to go. On the con trary, I see a very vIsable, vocal pol i tlcally actl ve - 14 - and mlll tant commun 1 ty or communl ties of homosexual s. I see homosexuals, who don't have, In many cases, the same kind of fam- lly responsibllltles as heterosexuals, often dOlng better In the economlC compet i tlon than people who have tradl tlonal famllies. The fact is that I have before me no evidence whatsoever not just that there 1.5 not a 100 complaints. There are no complaints whatsoever. There are no letters, no telephone call s. Correc- tIon, there was one telephone call. Now, I have an amendment to this, an addItIonal thing, I would move that we exempt bUSInesses that employ five persons or less.
