INTRODUCTION This report requests that the City Council adopt a resolution endorsing the Board of Supervisors' request that the Federal Government reallocate Federal anti-drug enforcement resources to Los Angeles County. The Board asked that all cities in the County adopt a resolution which recognizes that the area has a major drug problem and needs additional Federal support. BACKGROUND Los Angeles County has become a major drug importation and transshipment center for the United states with massive amounts of cocaine and Mexican heroin flowing into the area. It is also the principal manufacturing and exportation center for P.C.P. and crack furnished by Los Angeles street gangs, and the money laundering capitol of the United states for South American and Mexican drug traffickers. The current Federal resource allocation for drug investigation and enforcement agencies assumes that the East coast, - 1 - 12-e, AUG 0 8 1989 ~, e e particularly Miami and New York, is the major drug center of the United states. Unfortunately, the West coast is now competitive as a major drug center, particularly Los Angeles County. The need for personnel, technology and funding to meet the drug crisis and its related violence in the County is clear. The dramatic rise in drug trafficking and abuse has severely overburdened the justice and health care systems, as evidenced by the growing numbers of arrests, drug seizures, emergency room episodes and deaths. staff recommends that Council support the Board in the form of a resolution which urges the Federal Government to: 1. Reallocate resources, including personnel, technology and funding to Federal anti-drug enforcement agencies, to those areas of highest drug abuse and trafficking activity, particularly to those Federal agency offices working in the Los Angeles county area. 2. Expedite implementation of the Anti-Drug Abuse Act of 1988, targeting resources made available under the Act to those areas which have demonstrated the greatest need, including Los Angeles County, to assist with local law enforcement, health care, prevention and education efforts. - 2 - .. . e e RECOMMENDATION Staff recommends that the City Council adopt a resolution supporting the Los Angeles County Board of Supervisors' request that the Federal Government reallocate Federal anti-drug resources to Los Angeles County. J e e city Council Meeting August 8, 1989 Santa Monica, California RESOLUTION NUMBER 7860 (CCS) (City council series) A RESOLUTION SUPPORTING THE REQUEST BY THE LOS ANGELES BOARD OF SUPERVISORS FOR ADDITIONAL LOCALLY BASED FEDERAL ANTI-DRUG RESOURCES WHEREAS, the County of Los Angeles has a major drug problem and has inadequate federal resources to meet the crisis; and WHEREAS, the Los Angeles County Board of Supervisors recognized the severity of the drug problem which overburdened the local justice, educational and health systems; and has has care WHEREAS, the Board of Supervisors has requested that all cities in the County adopt a resolution which recognizes that the area has a major drug problem and needs additional federal resources, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City agrees and declares that the Federal Government should reallocate resources, including personnel, technology and funding of federal anti-drug enforcement agencies to those areas of highest drug abuse and trafficking activity, particularly to those federal agency offices working in the Los Angeles county area. SECTION 2. The City agrees and declares that the Federal Government should expedite implementation of the Anti-Drug Abuse Act of 1988, targeting resources made available under the Act to Los Angeles County to assist with local drug prevention, education, health care, and law enforcement efforts. The City council of the City of Santa Monica endorses the District Attorney's program aimed at cracking down on street drug dealers as set forth in Attachment A. SECTION 2. Calli~ for 8 change in tt1e pattern of lenient sentences for street drug dealers, the District Attorney instituted the following program: 1. ~_tRte Prison Sentp.nl!@s for Street DMlg' DeRh~l'~ In cases of possession for sale or sale of cocaine, beroin, or PCP, the District Attorney shall seek the maximum appropriate state prison sentence. On all cases of possession for sale of cocaine, heroin, or PCP, or sale of cocaine or heroin, where probation is legally permissible and which are first offenses involving nominal quantities, the District Attorney shall urge the sentencing judge to impose a suspended mid-term state prison sentence with, at the minimum, six to twelve months in county jail as a condition of a three--year probationary grant. On all subsequent cases involving the above described offenses, the District Attorney shall urge sentencing judges to impose immediate state prison sentences. 2. H2 County Parole for Street Drug Dealers In any dn1g case of pnuession for sale or sale where the defendant is sentenced to county jail, the District Attorney shall urge the court to order that the defendant is ineligible for parole. 3. li2 bail for_ _repeat streF,:t drllg' dealers Whenever a defendant is on probation for sale or possession for sale of narcotics and a petition for violation of probation is filed, it is the District Attorney's position that the defendant be held without ball until disposition of the case. The District Attorney's Office is also asking that: Special Narcotic Courts be established - courts which are devoted exclusively to cases involving street drug dealers. Special Probation Violation Courts be set aside to hear petitions for violation of probation. In this connection it is their aim to develop expedited procedures remanding the probation violator immediately to state prison. Bail be substantially incre8Sed for defendants charged with dealing narcotics. Presently many of these dealers are gettil,g out of custody on a $5,000 bond which means they are oat on the street in a matter of hours after their arrest by simply giving $500 to a bail bondsman. The citizens of La; Angeles County expect street drug dealer~ to be incarcerated. This message must be conveyed to all in the justice system. . .
