Resolution Terminating Proclamation of
Local Emergency
On January 27, 1983, as a result of a severe storm, the
City of Santa Monica's Director of Emergency Services declared a
local emergency pursuant to Municipal Code section 2305.
This
declaration was ratified by the city council on February 1, 1983,
in Resolution Number 6621 CCCS).
On March 1, 1983, the Director of Emergency Services
proclaimed the existence of a local emergency due to another
severe storm. This proclamation was ratified by the City Council
on March 8, 1983, in Resolution Number 6632 cecs).
A proclamation by the City Council declaring the existence
of a local emergency is authorized by the Emergency Services Act,
Section 8630 of the Government Code. This provision of law also
requires the governing body to review:
[E]very 14 days until such local emergency
is terminated, the need for continuing the
local emergency and shall proclaim the
termination of such local emergency at the
earliest possible date that conditions
warrant.

A "local em!ency" is defined by sec!n 8558 (cl of the
Government Code as follows:
[T] he duly proclaimed existence of
conditions of disaster or of persons and
property within the territorial limits of
a . . . city caused by such conditions as
. storm . . . which conditions are or
are likely to be beyond the control of the
services,
personnel,
equipment,
and
facilities of that political subdivision
and require the combined forces of other
political subdivisions to combat
At the recommendation of City staff, the city council
continued to renew the resolution to ensure financial assistance.
It has been determined that this action is no longer required.
The "Disaster Assistance Procedure Manual" (November 1977),
published by the California Office of Emergency Services,
explains in Section III that a local entity's request for
financial assistance should be preceded by a declaration
proclaiming
a
local
emergency.
Notwithstanding
such
a
proclamation, the State's Office of Emergency Services (OES)
determines, for purposes of financial assistance, the beginning
and ending dates of the emergency and whether the compensable
damage occurred within this period.
Thus, the continued
proclamation of an emergency, well after the initial damage has
resulted, will not impact upon the City's ability to receive
financial assistance to repair the damage occasioned by the
storm.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA PROCLAIMING THE TERMINATION
OF THE LOCAL EMERGENCY
WHEREAS, Municipal Code section 2305 authorizes the
Director of Emergency Services to proclaim the existence or
threatened existence of a local emergency when the City of Santa
Monica is affected or likely to be affected by a public calamity
and the City council is not in session; and
WHEREAS, commencing on January 27, 1983, conditions of
extreme peril to the safety of persons and property have arisen
within the City of Santa Monica caused by storm, high tides, and
heavy surf; and
WHEREAS, the city council was not in session on January 27,
1983; and
WHEREAS, on January 27, 1983 , the Director of Emergency
Services of the city of Santa Monica did proclaim the existence
of a local emergency within the city of Santa Monica; and
WHEREAS, on February 1, 1983, the City council adopted
Resolution Number 6621
(CCS) ,
ratifying, confirming, and
approving the proclamation of local emergency by the Director of
Emergency Services; and

WHEREAS, on March 8, 1983, the city Council adopted
Resolution Number 6642
(CCS),
ratifying,
confirming,
and
approving the proclamation of local emergency by the Director of
Emergency services~ and
WHEREAS, pursuant to Government Code Section 8630, the City
Council has reviewed the need to continue the local emergency;
and
WHEREAS, the situation resulting from conditions of extreme
per i1 is now deemed to be wi thin the control of the normal
protective services, personnel, equipment, and facilities of the
city of Santa Monica,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
The local emergency as proclaimed by the
Director of Emergency services on January 27, ~983, and ratified
by the City council on February 1, 1983, is proclaimed to be
terminated by the city Council of the City of Santa Monica.

SECTION 2 .
The local emergency as proclaimed by the
Director of Emergency Services on March 1, 1983, and ratified by
the City Council on March 8, 1983, is proclaimed to be terminated
by the City Council of the City of Santa Monica.
SECTION 3. The city Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

WHEREAS, commenCIng on January 27, 1983, conditIons of
extreme perIl to the safety of persons and property have arIsen
WIthin the City of Santa MonIca caused by storm, hIgh tIdes, and
heavy surf; and
WHEREAS, the CIty CounCIl was not In se9SIon on January 27}
1983j and
WHEREAS, on January 27, 1983} the DIrector of Emergency

WHEREAS, on March 1, 1983, the Director of Emergency
Services of the City of Santa Monica did proclaim the existence
of a local emergency within the CIty of Santa Monica; and
WHEREAS, on March 8, 1983, the City Council adopted
ResolutIon

6642
(CCS), ratifying, confirmIng, and
approving, the proclamation of local emergency by the Director of
Emergency Services; and
WHEREAS, pursuant to Government Code Section 8630, the City
Council has reVIewed the need to continue the local emergency,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The local emergency as proclaimed by the
DIrector of Emergency Services on January 27, 1983, shall be
deemed to contInue to eXIst In the CIty of Santa Monica until its
termInation IS proclaImed by the CIty CounCIl of the CIty of
Santa MonIca.
SECTION 2.
The local emergency as proclaimed by the
DIrector of Emergency SerVIces on March 1, 1983, shall be deemed
to contInue to eXIst In the City of Santa Monica untIl its
termInatIon IS proclaImed by the City CounCil of the CIty of
Santa MonIca
