Santa Monica, ~gi:~' 6o~-ooo PE:KLB Council Meeting: February 27, 1990 TO: SUBJECT: INTRODUCTION City Council adopted the City's initial Affirmative Action Plan (AAP) in 1977. For most of the subsequent years, an update of the city's AAP, including affirmative action goals and timetables for the upcoming year, has been submitted to Council for its re- view an~ adoption. The format of the 1989-90 AAP (7/01/89 - 6/30/90) has been changed from that of prior plans. These changes were made in order to bring the City's Affirmative Action Plan into compliance with state and Federal law, as further defined by U.s. Supreme court decisions. The 1989-90 AAP was considered by the Personnel Board at a spe- cial meeting on November 29, 1989. By a vote of 4 to 1, the Per- sonnel Board approved the 1989-90 AAP and recommended that it be submitted to the City Council for its consideration and adoption. The one dissenting vote on the Personnel Board was based on a concern that one Board member had regarding the format changes. Personnel Department staff made a commitment to do the additional tracking and reporting of Equal Employment Opportuni ty / Affirmative Action (EEO/AA) information that would be required to address the Board member's concern. - 1 - \I-A fEB 2 7 i9g0 I w . ~ . . , ~ The 1989-90 AAP was presented to the commission on the Status of Women at their regular meeting on December 13, 1989. The Co~~is- sion had the following concerns: 1) the AAP goals were presented in aggreqa~. (city-wide) rather than by department: 2) longitudi- nal comparisons with former reports was not possible as a result of the format changes made to the 1989-90 AAP; 3) there was no data on salary, recruitlllent, retention or promotions; and 4) there was no data on temporary employees. Even though this information could not ba directly incorporated in the AAP document itself due to the document format called for by fedetal law, Personnel Department staff indicated that they would be compiling some of this information on an annual basis and would submit it to the Commission along with each year's AAP update. In addition, a commi.tment was made to the Commission that the same AAP format would be used in subsequent years, un- less changes are required by state and/or federal law, to enable the Commissioners to compare each year's update with the preced- ing year. The Commission on the status of Women finished their review of the City'S 1989-90 Affirmative Action Plan at their regular meet- ing on February 14, 1990. The Commission approved the 1989-90 AAP and moved that it be sent to City Council for their review and approval. - 2 - I ~ ""-~ . . , DISCUSSION Format Chang.. One ot 'the chanqes that has been made to the format of the City's Aff irmati ve Action Plan is the settinq of AAP goals for each major job group on a city-wide, rather than departmental, basis. However, information on the breakdown of the city's work force on a departmental basis will still be provided in the Plan document. In addition, Personnel Department staff will continue to monitor the affirmative action progress of each City department and will develop an annual report detailing the success each department has had in helping the City meet its affirmative action goals. Another major change is the expansion of the job groups for which affirmative action reporting is done and for which affirmative action goals are established. In the previous Affirmative Action Plans, the City's work force was broken down in terms of only eight major job groups. The 1989-90 AAP, on the other hand, breaks the City'S work force down into fifteen major job groups. By increasing the number of job groups, a more accurate assess- ment of the City'S success in aChieving its AAP goals, and there- by more fully integrating its work force, will be possible. The Affirmative Action Plan chart titled ItGoals and Timetables" (following page 35 of the AAP document) provides an overall sum- mary of the City's Affirmative Action Plan in terms of AAP goals and the target dates that have been established for reaching those goals. This chart includes the following information: 1) a breakdown of the current City work force by race and sex for - 3 - I -~ . . 1 each major job group 1 2) a comparison ot the composition at the City's work torce, by major job group, to the availability of protected cla.. candidates in the relevant labor market1 3) proj- ected vacanc!e. tor each major job group during the current AAP year (1989-90) 1 4) a snmm~ry ot those job groups in which the data indicates protected classes (minorities and/or temales) have been "underutilized"; and 5) a listing of both short-term UP goals (for the current AAP/1989-90 plan year) and long-term AAP goals (target dates for full utilization of protected classes). Snmmllry of Affirmative Action Plan Progress The success of the City in achieving its AAP goals is impacted by three factors: 1) the aggressiveness of its affirmative action efforts; 2) the number of vacancies that occur in a particular job group; and 3) how well protected class candidates perform on the open competitive examination that is given for all classified positions covered by the City's Merit System. If there should not be any openings in a major job group of a sufficient number to even make it possible for the City to achieve its AAP goals or if protected class candidates should not score high enough on the open competitive examinations held for positions in that jOb group, the city's success in achieving its AAP goals for that major job group will be negatively impacted. A review of the "Goals and Timetables" chart indicates that the City has exceeded affirmative action utilization levels when it comes to employing Females in higher level job groups, such as Supervisors, Administrative Support; Professionals; and Technical - 4 - l' -.... . . , 4 paraprofessionals. For example, the' availability in the labor market of Female Professionals is 43.4%, whereas 70.3% of the city's Pro~..sional jobs are held by Females. For the Supervi- sors, Administrative support jOb group, the availability in the labor market of Females is 54.9' whereas 65.0' of the city's em- ployees in that job group are Females. For the protessionals job group, the City has filled 62.2' of its positions with Females whereas the availability in the labor market is only 39.2'. Even though the data indicates "underutilization" of Females in the Executive/Managerial job group, the City has made significant affirma~ive action gains in that area. Since the 1986-87 Affir- mative Action Plan update, the percentage of Females in the Ex- ecutive Managerial job group has increased from 16.4% to 28.4%. The City expects to reach at least full utilization of Females in that job group within the next two years. Although the d.ata indicates "underutilization" of Females in the secretarial job group, there are two underlying factors that one must take into consideration. The City has been aggressive in its attempts to place females and males in non-traditional jobs. Thus, whenever the City has been successful in filling a tradi- tionally female-dominated jOb, such as a secretarial job, with a male, the city could end up with a work force composition that would appear to indicate that there has been an "underutiliza- tion" of Females in the Secretarial/Clerical job group (88.9% utilization as opposed to 97.3t availability in the labor market). In addition, the City has been aggressive in its ef- forts to promote Females into higher level positions, which could - 5 - I ., . . t . also have what appears to be a negativ.e impact on the utilization of Female. in the lower level secretarial job qroup. A review o~ the "Goals and Timetables" chart indicates that the city has not underutilized Females in the Fire Fighter job group since Females consti tute 2 . 3% of the ci ty' s Fire F iqhter job group and there i. a 1.5' availability of Females in the labor market for that job group. However, even though from an AAP com- pliance standpoint, the City cannot establish AAP goals for Female Fire Fighters, the City will continue its program ot at- tempting to till traditionally male-dominated jobs with females. Thus, tne City will still aggressively recruit females for the position of Fire Fighter. Over the past 10 years, there have been significant gains in the achievement of AAP goals in the Santa Monica Police Department. On a department-wide basis for sworn positions, the percentage of Blacks has increased from 3.0% to 7.9%; the percentage of Hispanics has increased from 7.6% to 13.8%; the percentage of Asians has increased from 0% to .7%; and the percentage of Fe- males has increased from 4.5% to 11.2%. For the job group of Police Officer, the Santa Monica Police Department has achieved full utilization for Hispanics, Asians and Females. For the job group of Police Supervisor, the Santa Monica Police Department has reached full utilization for Hispanics and Asians. Even though the data indicates "underutilizationU of Blacks in the Police Department in both job groups (L e., Police Officer and Police Supervisor), significant gains have also been made in - 6 - 1 .. -... . . ~ that area. 'I'he percentaqe of Blac.ks '.in the police Supervisor job group has increased from ot to 3.8t, and the percentage of Blacks in the Police ofticer jOb group has increased from 3.0% to 9.7t. The city te.ls that its aqgressive affirmative action recruitment efforts should bring the police Department to at least full utilization in the employment of Blacks within the next one to two years. In addition, based on current Female incumbents in the Police Officer jOb group, it appears that the Police Depart- m.ent will soon achieve at least full utilization of Females in the Police Supervisor jOb group. The 1989-90 AAP contains a section titled "Complianoe with . Obligations for Disabled Workers" that outlines the city f s com- mitment and obligations regarding the recruitment and hiring of disabled workers. This past year, the city distributed a survey in an effort to get disabled City employees to self-identify themselves. The survey results indicated that the City currently employs 23 self-identified disabled workers. However, due to the fact that many disabled employees are reluctant to identify them- selves as being disabled, it is our assessment that the survey results do not accurately reflect the total number of disabled workers employed by the City. The City of santa Monica has taken a very aggressive stance in the area of affirmative action. Even though Affirmative Action Plan laws only require the City to establish AAP goals for those job groups in which there has been an underutilization of pro- tected class, as defined by availability in the labor market, - 7 - ( {: ~ . . ~ that does not preclude the Cit.y frQm cont.inuinq it.a aqqr..sive recruitment ot protect.ed class candidates for all job groups. In an effort to recruit protected class candidates for its jobs, the city current.ly sends all of its job posting. to over 200 or- ganizations representing various protected classes. As long as the City complies with the equal opportunity employment laws, administering the same test under the same conditions to all can- didates, regardless of race, sex, religion, etc., the City can still "affirmatively" recruit protected class candidates for all of its job openings reqardless of whether or not an AAP goal per se has been established for a particular job group. RECOMMENDATION It is recommended that Council approve the 1989-90 Affirmative Action Plan and adopt the Affirmative Action goals set forth therein. An analysis of the composition of applicant flow by minority group status and sex is kept on an ongoing basis to en- sure representative availability. 3. Our selection process includes the following: (a) Class specifications and titles have been examined and accurately reflect jOb content and qualifications. (b) Employment applications have been reviewed and do not request information which could be used for illegal dis- criminatory purposes. (c) Initial employment applications for permanent positions are received by the receptionist in the Personnel of- fice and are retained until the application deadline has passed. Applications are reviewed by the Personnel Analyst conducting the recruitment to make sure that applicants possess the minimum re- quirements for the position. Those who do may be invited to take a Job-related performance and/or written examination, if appro- priate, to determine which are the most qualified applicants for the position. These job-related tests may include typing and ten-key tests for certain clerical positions, equipment handling - 11 - . . tests for certaln skllled craft pos~tions, wrltten tests of caSle math and writing Skllls, etc. Appllcants who pass the ]ob- related exam, and those who have the requislte qualifications but are not required to take a wrltten or performance exam, are re- ferred to an oral board. The oral boards are generally composed of three indlviduals who are knowledgeable about the field for WhlCh the applicants are being interviewed. An effort is made to have an ethnic and gender mix on the oral boards. Neither the lmmediate supervisor of the position in question, nor the manager or department head of the department involved, is allowed to be on the oral board. The board assigns scores to the applicants based on their qualifications. An eligibility list is developed based on the total scores (for all examinations - written, per- formance and/or oral). The top three applicants are referred to the immediate supervisor, who must choose one of them. All hiring decisions are based on qualifications. (d) Any organizations referring candidates to the City are made aware of its equal opportunity posture. (e) No non-validated and employment tests are given by the city. non-jab-related pre- 4. The EEO/AA Coordinator monitors all transfers and pro- motions, has identified potential openings for the next year, and will encourage awareness of minorities and/or females who could be promoted to fill them. The City actively encourages promotion from within and routinely posts notices of job vacancies. - 12 - . . 5. None of the seniority provisions, nor the City's practice thereunder, have had any negative impact upon minorities or women, nor do they appear to have any potential for undercutting the City's affirmative action plan. 7. The city has no union apprenticeship program. S. All on-the-jOb training is done in a non-discriminatory fashion. 9. There are no discernible attitudes in the work force which mitigate against realizing the objectives of the City'S affirmative action policies. Where indicated, work force atti- tudes towards the affirmative action plan will be explored by managers during meetings designed to discuss those areas. - 13 - . . 10. Spec~al Corrective Action: 1. Underutilization of minorities and women in specific job groups is identified in the utilization Analysis and Goals and Timetables Sections, and special corrective action is outlined. 2. No evidence exists to suggest that either the lateral or vertical movement of minority or female employees occurs at a lesser rate, compared to the workforce mix, than that of non- minority or male employees. No evidence exists to suggest that the selection process eliminates a significantly higher per- centage of minorities or women than non-minorities or men. 3. All pre-employment forms are in compliance with state and federal legiSlation. 4. Position requirements are under continual review by the EEO/AA Coordinator to ensure that they reflect actual jOb func- tions and duties. 5. The City does not utilize any non-validated or non job- related pre-employment tests. - 14 - . . 6. The terms "underutilizedll or "underrepresented, II when used in this program, are terms of art which describe the City's wish to meet its own non-binding, voluntarily-adopted goals.
