INTRODUCTION
Th~s report requests that Council adopt the attached Resolutlon
amend1ng the Execut1ve Pay Plan.
BACKGROUND
C1ty Department Heads and the execut~ve staff of the C1ty
Manager's Offlce are not represented by barga1n~ng un1ts.
The1r
salary and benefl t package 15 established by Resolutlon. The
C1ty Manager has requested amendment of the current Resolution to
prov1de salary adJustments totallLng 5% 10 July, 1986, and 3% 1n
January, 1987.
These salary adJustments are Ldent1cal to those
prov1ded for MTA and STA employees 1n their MOUs.
In add1t1on, the attached resolut1on prov1des for 1ncreases 1n:

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING THE EXECUTIVE PAY PLAN
WHEREAS, the Executive Pay Plan adopted by Resolution No.
7058 (CCS) has been 1n effect for one year; and
WHEREAS, certain of its provisions require updating to
reflect organ1zational changes and to update compensat1on and
benefits provisions;
NOli, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1 :
The City Council does hereby establish an
Execut1ve Pay Plan which def ines the wages and benefi ts of the
C1ty'S Department Heads and those members of the Executive Staff
of the City Manager1s Office who choose to represent themselves
1ndividually under Ord1nance No. 801 (CCS).
SECTION 2: The elements of the Executive Pay Plan shall be
as follows:
A. ~artici?ants. Participation in the Executive pay Plan
shall be limited to the ASs1stant City Manager, BU11ding Officer,
City L1brarian, Director of C1vic Auditorium, Director of
Community and Economic Development, Director of Finance, Director
of General Services, Director of Personnel, Director of Planning,

Director of Recreation and Parks, Director of Transportation r
Fire ChIef, Pol ice Chief, Director of Municipal Airport, and
Director of
Information SerVIces.
In addition,
the CIty
Manager's Office AdmInistrator, Council Office Administrator,
Budget DIrector, Senior Management Analysts, Management Analysts,
and RISk Manager on the City Manager's staff may partIcipate In
the Executive Pay Plan if they choose to IndIvldually represent
themselves under the terms of Ordinance No. 801 (CCS).

Hours of Work and Overtime.
Particl.pants ln the
Executl. ve Pay Plan are exempt employees under the Fa Ir Labor
Standards Act, work during normal business hours of the Clty and,
in addltion, devote whatever time is necessary to accomplish the
work
of
their
offices
without
overtlme
compensation.
Participants
in
the
Executive
Pay
Plan may
not
accrue
compensatory
time.
However,
the
Clty
Hanager1s
Office
Administrator and the Councll Office Administrdtor may recelve
overtime pay when work performed outside the normal business
hours of the Cl ty is also clearly outslde the scope of thelr
asslgned
departmental
responsibilltles.
Senior
Management
Analysts and Management Analysts asslgned to the budget process
will recelve 40 hours of pald leave upon completion of the budget
season Wh1Ch must be taken off prior to December 31 of the next
f lscal year 1n recognition of the long hours aSSOCla ted Wl th
budget preparatl.on.
Time not taken off by December 31 shall be
forfeited wlth no payoff.

F. Performance Based Compe_n_s_a_t_l_o_l"!.. The Clty Manager or
his designee shall evaluate the performance of particlpants in
the ExecutIve Pay Plan annually. The evaluatlon shall be made no
la ter than 45 days fol1owing the end of the f lscal year. Sald
evaluatlon shall lnclude an assessment of general management
skills and specific accompllshments of each indivldual employee.
The City Manager or his designee shall meet wlth each lndlvidual
employee to discuss the evaluation and shall establish mutually
agreed upon performance criteria upon which the following year's
evaluation shall be based. The oral evaluatlon shall be followed
by a written evaluation within 10 working days if the employee so
requests or if the City Manager or his designee deems It
advisable.
When, in the opinion of the Cl ty Manager, the capabll ities and
accomplishments of an lndividual employee have been exceptionally
merltorious, a cash payment of 1% to 10% of that employee's
annual salary on June 30 of the fiscal year for which performance
is being evaluated shall be made. The bonus shall be paid no
later than 30 days following the date of the evaluation. Sald
payments shall be regarded as one time bonuses and shall not
become part of the employee I s base salary. Said payments are
subJect to retirement contrlbutlons.
A merit pool not to exceed 5% of the base salaries of the
participants in the Executive pay Plan shall be established
annually from which any and all said payments shall be made.
Nothlng herein shall be construed as requiring that all pooled
funds be distributed in any year.

If an employee recommended for a cash payment prefers, the City
Manager may provlde paid time off in lieu of all or part of the
cash payment provlded that the value of the above alternative
shall not exceed the cash payment or1ginally proposed and the
"merIt pool" shall not be cons1dered to be 1ncreased by virtue of
election of this alternative.
If, 1n the opinion of the CIty Manager, no cash payment or paid
time off incentive is warranted by an employee's performance, the
employee shall have the opportunity to present, w~thin 10 days of
notificatIon that no payment is due, additional Information that
rnlght a1 ter the City Manager' s deC1S ion. The declsion of the
City Manager, after consideration of any such additional
information, shall be final and no appeal may be taken therefrom.
It is expressly understood by participants in the Executive Pay
Plan that the performance-based payments described in thIS
sectIon do not constitute a generally granted increase under
Section 1100 of the City Charter and Section 2l0SE of the
Municipal Code, and that denial of such payments does not
consltute a demotion.
G. ~e.f.err:ed_ _ COI!lP~~s~tion. Participants in the Executl ve
Pay Plan who particIpate ln the City's Deferred CompensatIon Plan
shall receive from the Clty an amount equal to the amount that
the employee is contrIbuting toward the Deferred Compensation
Plan, to a maximum of $150.00 per month.

H. ~nnual ~tJ.Y~!-<::~L _E_x_a_m.. Participants in the Executive
Pay Plan shall receive an annual physical examination at Clty
expense.
I. Mental Health Insurance. Part1c1pants 1n the Executive
Pay Plan shall receive mental health insurance coverage at City
expense.
J. ~on9 Te~l!l_ Disab11 i_ty _ ~nsurance. Participants in the
Executlve Pay Plan shall receive long term d 1sab111 ty insurance
coverage at City expense. SubJect to the usual prov1sions and
exclusions of such insurance plans, the coverage shall be for 60%
of salary after a 60 day el1m1nation period.
K. Health and Dental Insurance. The C1ty shall pay the
full premium of ex isting fee-far-service or health maintenance
organization (HMO) coverage for participants in the Executive Pay
Plan and eligible dependents.
L. Life Insurance. Participants in the Executive Pay Plan
shall recelve $100,000 term life 1nsurance at City expense.
M. Retiree rned1cal insurance. Participants 10 the
Executive Pay Plan whose combined retirement age and years of
City service equals or exceeds 70 shall be entitled to a
C1ty-paid medical insurance plan upon ret1rement. For el:lg:lble
retirees who are between ages 65 and 70, that plan shall be a
Med:lcare-supplement plan.
The City shall pay the premiums for the retiree only.
Payments shall cease when the retiree reaches age 70.

Municipal Code, provided, however, that they may accrue a maximum
of three times their annual accrual rate.

Manager may authorize the accrual of vacation beyond these limIts
l.n indivldual cases where the employee has been unable to use
vacation due to work demands.
Each employee covered herein shall accrue vacation leave on the
following basis:
l) FOllowJ.ng completion of the first six calendar months
of completed serVIce, six workJ.ng days.
2) Thereafter, up to and including fl.ve completed years of
service, one working day for each completed calendar
month of service.
3) Thereafter, up to and Including ten completed years of
service, one and one-quarter (1. 25) worklng days for
each completed calendar month of service.

A max~mum accrual limit of 130 days of sick leave is applicable
to any employee who has elected payoff at any time during hls/her
employment.
Q. Bereavement Leave. Bereavement Leave of not more than
40 hours with pay shall be provided for absence from duty due to
the death of a member of the employee's lmmediate family, meaning
spouse,
child,
brother,

parent,
step-parent,
step-brother,
step-slster,
parent-in-law,
son-1n-Iaw,
daughter-in-law, grandparent, grandchild or any relative living
in the same household.
R. Hqliday~. The Director of Transportatlon shall receive
those paid holidays provided in the UTU MOU. The City Librarian
shall recelve those pa1d holidays provided in the Library Guild
and Library Non-PrOfessionals MOU. All other participants in the
Executive Pay Plan shall receive the following paid holldays:

All Other Holidays Declared By The City Council
If the floating holiday is not taken off by June 30, it shall be
paid off in July of the new fiscal year at the rate in effect at
the end of the prior fiscal year.

Plan shall reimburse the City for any overpayment of wages or
benefits.
Sal.d reimbursement shall not be required until the
Ci ty notifies the affected employee in writing.
Reimbursement
may be accomplished by a lump sum deduction from the next payroll
warrant issued to the employee following notification, or by
other reasonable repayment method mutually acceptable to the
employee and the Cl ty, except that lum sum deduction shall be
required if the next payroll warrant issued to the employee is
the final or termination warrant.
SECTION 3 :
This Resolution shall be effective for the
period July 1, 1986 to June 30, 1987.
SECTION 4: The City Clerk shall certify to the adoption of
thls Resolution and thenceforth and thereafter the same shall be
in full force and effect.
