SUBJECT: Recommendation to Adopt Resolution in Opposition to
Offshore Continental Shelf (OCS) Lease Sale #95
INTRODUCTION
The Department of Interior has initiated a "Call for Information"
for Lease Sale #95 offshore drilling proposal for Southern
California.
During this phase, concerned agencies, groups,
businesses, industries, and individuals are directed to submit
either positive or negative "nominations" for tracts included
within the "Call" area.
This report is in response to the
Department of Interior's "Call for Information."
It provides
background information as well as a recommendation for adoption
of a resolution in opposition to the Lease Sale.
BACKGROUND
On Thursday, July 2, 1987, Interior Secretary Donald Hodel gave
final approval to his "Five-Year OCS Leasing Program."
This
program attempts to establish new offshore drilling along the
southern California waters. Prior to leasing, however, pre-lease
planning steps for each of the California sales must be taken.

Hodel also announced on JUly 2, the initial "Call for
Informationtl step for Lease Sale #95.
The "Call for Information" step is intended to solicit
expressions of oil industry interest ("Positive Nomination") as
to which tracts should be opened to drilling. The "Call", at the
same
time,
concern
("Negative
solicits
expressions
of
Nominations") from communities and interest groups which feel
that they will be adversely affected by the proposed OCS leasing
activities.
The official "Call for Information" notice appeared in the July
9, 1987 Federal Register. Forty-five days are allowed for public
comment. During this comment period (comments must be received
by August 21, 1987) affected parties are asked to submit
duplicate copies of their comments to both the Regional
Supervisor of the Office of Leasing and Environment and the Chief
of the Offshore Leasing Management division.
Local concerns
should also he expressed to the California Congressional
Delegation and the Governor.
Although the "call" is an early
step in the leasing procedure, it is important in establishing an
effective record.
Concurrent with issuance of the "Call for Information," the
Interior Department has also filed the requisite "Notice of
Intent to Prepare an Environment Impact statement (EIS)." This
has the effect of announcing the "Scopingtt process for preparing
an EIS for Sale #95.

As noted above, September 1989 has been set for the actual
leasing of tracts to the industry.
Description of the Area
The geographic area which is included in the Lease sale #95
encolllpasses approximately 5 million acres, or 1,375 individual
tracts.
These tracts range from approximately 3 to 130 miles
from shore and lie in water 30 to approximately 900 meters deep.
The affected area stretches from the San Luis Obispo/Monterey
County Line to the Mexican Border (See Map I).
The tracts most likely to be leased under Sale #95 include areas
which are located off Santa Monica Bay, near Palos Verdes

Penninsula, offshore San Diego and Orange counties, and along the
southern portion of the Big Sur coastline.
RECOMMENDATION
In view of Santa Monica's long-standing opposition to both the
substance and process of the Department of Interiorfs OCS
development program, the city should go on record as opposing the
lease sale. It is respectfully recommended that the city Council
adopt a resolution (attached) in response to the "Call for
Information" for Southern California OCS Lease Sale #95 stating a
negative nomination.

. BACKGROUND - THE FIVE-YEAR OCS LEASING PROGR~~:
Very qU1etly, on Thursday July 2, Interior.Secretary Donald Hodel kicked off hlS
efforts to bring a vast new offshore drll1ing plan to sensltlve southern Callfornla
waters. The actlon was taken lmmedlately preceedlng the long July FOll th weekend,
apparently In order to take advantage of the gap 1n media coverage which always
accompanles a long hollday weekend.
Iiodel's July 2 actlon took rlace ln two parts. He flrst gave flusl avproval to nls
controverslal new "Flve-Year OCS Leaslng Program". In finallZl.ng the Flve-Year
Program, Hodel never returned to the prlnclp1es embodled ln the compromlse agreement
which he reached wlth the Callfornla Delegation in July 1985 and subsequently
repudlated. In f1nallzlng hlS oes Program, Hodel reJected comments on his Program
whlch had beer. submltted eBrller thlS year by 32 members of the California Delegat1on.
Hodel also falled to lncorporate the comments of numerous local governments throughout
Callfornia which had requested a more moderate approach to new oes leasing. In
addltlon, Hodel 19nored a recent letter by 70 members of the CongreSSlonal Delegat10ns
of Washlngton, Oregon, Callfornla, Florlda, Massachusetts, Connectlcut, Ma1ne, and New
Jersey which stated that his Program lacked the balance between the environment and
resource potentlal requlred under the OCS Lands Act.
The Flve-Year OCS Program was flnal1zed when the Congress as a whole falled to obJect
to the Program, an actlon wh1ch would have requlred adoptlon of concurrent "Resolutlons
of D1sapproval" by maJorlt1es of both the Hou~e and the Senate. Because the 60-day
Congresslonal reVlew of the OCS Program 1S malnly a formal1ty 1n whlch "no actlon" >

s~gnals Congress~onal approval, even the earl~er Watt F~ve-Year DCS Program d~d not
meet w~th reJect~on by the Congress. Largely due to tne predom~nance of inland states
over coastal states in tne Congress, even the high degree of controversy wh~ch has
character~zed the formulat~on of the Hodel F1ve-Year OCS Program did not result ~n
outr1ght Congressional re]ect1on of the plan. Instead, the real leg1slat1ve f1ght will
come over probable Congressional overtures a1med at blocK1ng implementation of the DeS
Program at the lease sale stage. This ~ill likely be 1nit1ated during the spr1ng of
1988 through the reimposit1on of leasing restr1ctions or Morator~a applied to the
Appropriations process. The House Appropriat~ons Comm1ttee this year ~ncluded "Report
Language" in the FY 1988 Interior Appropriations Bill which notes that negot1at10ns
between Congress and the Interior Department over new Cal1forn1a leasing have been
1nconclus1ve. The Report Language adopted hy:the Committee once again d~rects the
Interlor Department to continue efforts to try to reach a resolution to this issue.
Continued lack of good-fa1th partiClpation ~n the negot1at~on process by Interior will
set an appropr~ate stage for restoral of the Morator1um for FY 1989. On the legal
front, Callfornla Attorney General John Van deKamp has lndicated that he may sue
Interlor over the Five-Year OCS Program.
.. HODEL GIVES GREEN LIGHT TO SOUTHERN CALIFORNIA LEASE SALE #95:
Meanwhlle, Secretary Hodel has made ~t abundantly clear that he has every ~ntention of
proceed1ng agressively w~th all of the pre-lease plann~ng steps for each of the 1nlt~al
Callfornia sales ~n the Five-Year OCS Program. Thus, concurrent w~th his approval of
the ne~ F1ve-Year Program, Hodel also announced on July 2 the ~nlt~al "Call for
Informat1on" step for Lease Sale #95. The tracts most l1kely to be leased under Sale
#95 lnclude areas previously protected by Congressional Morator1um wh~ch are located
offshore San D1ego and Orange Count1es, near Palos Verdes Penninsula, off of Santa
Monlca Bay, and along the southern portion of the B1g Sur coastl~ne.

comments to each of the two addresses above. This is also an appropr1ate time to
express local concerns over the Lease Sale #95 proposal to the Cal~fornia Congressional
Delegation and the Governor. Close communlcat10n and coordlnation between your agency
and your Congressmember will be critical throughout the pre-lease planning process and
should be lnstituted now.
Although the "Call" is an early step in the leasing procedure, ~t is cntical that all
parties of interest partl.cl.pate act1vely 1n the "Call" 8S part of building an effect1ve
legal reC9rd. S~nce the Interior Department appears to have timed their announcement
1n such'a way as to mln1mize public awareness of the Sale #95 proposal, aetlon on the
issue by local Boards of Supervisors and City Councils wl1l also help to cultivate a
broader publ~c awareness of the plan. No~ that the pre-lease plann~ng process is
actually underway, planning m1lestones will proceed regularly and sequent~ally.
September 1989 is set for the actual leasing of tracts to the oil industry, so the next
Adminlstrat~on ln Washlngton wlll make that actual decision as to whether or not to
proceed \oath leasing. Expressions of o~l industry 1nterest in response to the "Call"
are l~kely to be concentrated on nearshore tracts in areas previously protected under
Congress~onal Moratorium. For th~s reason, coastal areas wlth a hlgh degree of
env~ronmental sens1t1v1ty can be expected to be leased unless Congress or the next
Presldent intervenes at SOIDe point in the process. The nearshore focus of lndustry
lnterest ~s part1cula.ly c.angerous since Governor DeukmeJiail has already 1nd:l.cated in
hlS comments on the Flve-Year Program that he wlll go along wlth Inter10r Department
plans for leas1ng wlthln prev10Us Moratorium areas offshore southern Cal~forn1a and has
repeatedly stated h~s Opposltlon to the Morator1um.
. THE "CALL" AREA I HOW TO Rr:sPOND~
The total geograph1c area which lS lncluded in the Sale #95 "Call for. Informat10n"
encompasses approxlmately 5 million acres, or 1375 indivldual tracts. These tracts
range from approxlmately 3 to 130 miles from shore and l1e in water depths from 30 to
approx1mately 900 meters. No add~tlonal subarea deferrals beyond those originally
incorporated 1n the Flve-Year OCS Leasing Program have been mcluded in the "Call".
Since the Reagan Administrat~on has recently reduced the ffilnlmum acceptable bid for OCS
leases from $150 per acre to $25 per acre, tracts which have even marginal resource
potential can now be expected to be leased, even in the mldst of a glut in the 011
market when exploration budgets have been cut substant1ally.

OTHER RELATED DEVELOPMENTS-
+ Occ1dental Petroleum received approval on July 7 from the californIa Coastal
Comm1ssion to drIll two exploratory wells onshore at Paciflc Palisades adjacent to Will
Rogers State Beach. The Commission approval came ~n a 5-7 vote, and is a v1rtual
guarantee that further litigation Will ensue over this controversial project. During
the same meeting. the Coastal Commission granted approv~l for the proposed
~raaslocation of 3 portl~n of the Big Sur p0pulation of California Sea Otters to San
N1colas Island, also on a 5-7 vote. The intent of the otter translocation 18 to ensure
cont1nued recovery of this oilspll1-sensitive threatened species.
+ Governor DeukmeJlan has again taken his blue pencil to the budget of the Coastal
COWIDlssi0n. ThlS year he has elimlnated the Santa Cruz and Santa Barbara offices of
the Commission altogether, by slashing eight staff positlons. This actlon may well be
almed at trying to help smooth the way for controversial new federal OCS leasing
overtures off the central California coast and offshore new areas of northern San Luis
Ob1spo County. The Governor's action comes shortly after Interior Secretary Hodel has
asked Secretary of Commerce Malcolm Baldrlge to decertify the California Coastal Zone
Management Plan and aholish the Callforn1a Coastal Co~sBlon.

IN RESPONSE TO THE "CALL FOR INFORMATION" FOR SOUTHERN
CALIFORNIA OUTER CONTINENTAL SHELF (oes) LEASE SALE #95
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLONS:
NHEREAS, the Department of Interior has solicited comments
and nominations from interested parties on their proposed
Southern California outer Continental Shelf (OeS) Lease Sale #95
offshore drilling plan; and
NHEREAS, comments and nominations will be accepted by the
Department of Interior until August 21, 1987: and
IVHEREAS, the eity of santa Monica relies to a significant
degree on a coastal-dependent economic base which requires a
clean and healthy marine environment: and
WHEREAS, coastal-dependent tourism is a mainstay of the City

WHEREAS, the nearshore focus of the Lease Sale #95 proposal
is considered to be precedent-setting with regard to other
proposed federal oes leasing actions elsewhere offshore
California; and
WHEREAS, two years of efforts by the Congress to resolve the
controversy over federal OCS leasing plans offshore California
through negotiations with the Department of Interior have been
met with a lack of good-faith commitment on the part of the
Secretary of Interior.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1: The City of Santa Monica does hereby submit to
the Department of Interior negative nominations for all tracts
included in the "Call for Information" for proposed OCS Lease
Sale #95.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA
IN RESPONSE TO THE "CALL FOR INFORMATION" FOR SOUTHERN
CALIFORNIA OUTER CONTINENTAL SHELF (OCS) LEASE SALE '95
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
WHEREAS, the Departm~nt of Interior has solicited comments
and nominations from interested parties on their proposed
Southern California outer Continental Shelf (OCS) Lease Sale #95
offshore drilling plan~ and
WHEREAS, comments and nominations will be accepted by the
Department of Interior until August 21, 19871 and
WHEREAS, the City of Santa Monica relies to a significant
degree on a coastal-dependent economic base which requires a
clean and healthy marine environment~ and
WHEREAS, coastal-dependent tourism is a mainstay of the City
of Santa Monica's economy and conflicts between OCS impacts and
tourism-related employment are anticipated1 and
WHEREAS, adverse impacts on onshore air quality expected to
result from OCS activities in the proposed Lease Sale *95 area
are regional
in nature and likely to adversely impact
socioeconomic conditions in coastal and inland communities~ and

WHEREAS, the present lack of adequate oil spill response
capability indicates that OCS leasing in the Lease Sale #95 area
will pose a high ~egree of risk to coastal environments~ and
WHEREAS, ocean discharge of drilling wastes has cumulative
impacts which degrade nearshore water quality and which have
remained unaddressed in the Five-Year OCS Leasing program~ and
WHEREAS, critical commercial fishery tracts are encompassed
by the Lease Sale ~95 proposal and significant conflicts are
anticipated between the fishing industry and OCS activities~ and

An additional copy of' this Resolution shall be transmitted
