SUBJECT: Anti-Scavenging Ordinance for Curbside Recycling Program
Introduction
This report requests the City Council direct the City Attorney to prepare an
ordinance amending the present Interference with Collections Ordinance.

One crucial element in the fiscal stability of the Curbside Recycling Program
lS the Control of scaveng1ng act1vities in the recycl1ng ne1ghborhoods. The
eXisting anti-scaveng1ng ordinance entitled "Interference with Collectionsl1,
Article V, Chapter 2, Section 5229, is not broad enough in scope to include
recyclable materials.
The ordinance would establ1sh the following regulations:
. All recyclable materials, includ1ng glass, cans and
newspapers, left at the customary residential or
business refuse collection point, shall be the property
of the City of Santa Monica.
. It shall be unlawful for any person, firm, or corpor-
ation to remove recyclable mater1als from any container
placed at the customary col1ectlon point or from specially
designated recycling contalners.
The penalties descrlbed in the Violat1ons Notice, Sect10n 5232, would be enforced
for recycling v1olations. The intention of the ordinance is not to displace the
low income person dOlng minimal scavenging, but to curb the active professional
scavenger. Staff 1S working with the Police Department to develop an enforcement
program sensitlve to the low income scavenger,
yet protective of designated
recycl1ng areas, as shown on the attached map.
