Introductlon
ThlS report requests City Council hold a publlC hearing to hear
protests on the work done in Tree Planting District No. 5 on Santa
Monlca Boulevard between 17th and 20th Streets and to confirm the
assessments.
Background
On November 13,
1979, the City Council ordered the planting of
trees on Santa Monica Boulevard between 17th and 20th Streets
(Item 7B). The work has been completed and the property owner's
share of the costs LS now due. A public hearing must be held
pursuant to SeetLon 5882 of the Callfornla Streets and Highway
Code.
On October 29,
1980, the Clty Council set ~ovember 25,
1980, as the publlC hearlng date (Item 61).

It is recomMended the Clty Councll:
1. Open the publlC hearlng;
2. Close the public hearing and overrule any protests; and
3. Adopt the attached resolutlon.

STREET SUPERINTENDENT'S REPORT
TO THE CITY COUNCIL
COMPLETION OF TREE PLANTING DISTRICT NO. 5
Pursuant to the provis1ons of Sectlon 5882 of the
Streets and Highways Code of the State of Californla,
Reso1utlon of Intention No. 5406 (CCS), adopted
September 25, 1979, and Resolution Ordering Work No.
5441 (CCS), adopted November 13, 1979, the followlng
work was completed prlor to October 1, 1980, to wit:
The planting of 29 trees along Santa
Monica Boulevard between 17th and
20th Streets, all within the City of
Santa Monica.
The total proposed assessment to the property owners 1S
$1,487.50. The assessment was made on the basis of
$1.75 per front foot.

Made to the attached sheets for a
descrlption of the real property in front of WhlCh the
work has been done and the assessment against each lot
or parcel of land proposed to be levied to pay the cost
thereof.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA CONFIRMING
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING TREE PLANTING
DISTRICT NO. 5 ON SANTA MONICA
BOULEVARD.

WHEREAS, the City Council of the City of Santa
Monica, pursuant to Sect10n 5870, et seq., of the
Streets and Highways Code, com~enced proceedings to
t
cause the plant1ng of trees on Santa Monica Boulevard
from 17th to 20th Streets 1n the City of Santa Monica;
and
\YHEREAS, a public hearing was held on said
matters, and thereafter the City Council ordered the
planting to be accomp1ishedj and
WHEREAS,
sixty days after the order was
served, the work had not been completed by the owners or
persons in possession of the affected properties, and
the Superintendent of Streets caused the work to be
done; and
,
WHEREAS, the Superintendent of Streets did
file with the City Council of the City, h1s reports of
such
work,
and a hearing thereon was called by
Resolution No. 6112 (C.C.S.}j and
WHEREAS, the City Council conducted a noticed
hearing to consider any protests or objections to the
Report of Work;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SEC'l'ION 1.
That the Report of Work of the
Superintendent of Streets heretofore filed and above
descr~bed, be and the same is hereby confirmed.
SECTION 2.
That all of the protests and
ob]ect~ons of every kind and nature to the planting or
to the assess~ents and all appeals therefrom to the City
Council be and the same hereby are overuled and denied.
SECTION 3. That the cost of the planting, as
set forth in the Report,
shall be assessed aga~nst the
properties herein descr~bed, which propert~es front upon
the improvement so planted.
SECTION 4.
That if such assessment is not
pa~d with~n the time permitted by law, the same shall
const~tute a special assessment and lien agalnst the
propert~es there~n described, in the amount set forth in
the
Report,
wh~ch lien shall continue until the
assessment and all interest thereon is paid.
SECTION 5. That if the assessment is not pald
within the time permltted, the City Clerk shall deliver
a Notlce of Lien,
signed by the Superintendent of
Streets, as provided in Section 5891 of the Streets and
Highways Code of the State of California, to the County
Assessor and Tax Collector, who, in accordance with
applicable law, shall collect the assessment, together
with all other taxes relatlng to such property.
SECTION 6. That the Clty Clerk shall certlfy
