SUBJECT: Street Tree Planting on Lincoln Blvd. from Ocean Park Blvd. to the
South C1ty Limits - Resolution Order4ng the Work. (78-T-6)
Introduction
This report recommends that the City Council hold the Public Hearing and
approve the attached Resolution ordering the planting of trees on Lincoln
Boulevard from Ocean Park Blvd. to the South C4ty Limits,
Background
The City Council at their meeting on September 26, 1978t adopted Resolution
of Intent10n No. 5097 (CCS) for the subject tree planting, This Resolution
set a publlC hearing for November 14~ 1978, Notices were posted along
L1ncoln Blvd, as required. Written notlces were mal led to the property
owners abutting the project, designatlng the time and date of the hearing
and the cost. (See attached copy of letter dated November 3. 1978.)
As in the previous four street tree assessment distrlctst the property owners
may do the plant1ng and appurtenant work within 60 days of the adoption of
the Resolution Ordering the Work lf they wish to do so, If the property
owner does the work, there 1S no assessment fee. For all others, the City
will do the work and the assessment wlll be $1.50 per front foot,
The City has received no letters of protest concerning th1S tree assessment
district,

Recommendation
It is recommended that the City Councll,
1. Hold the Public Hearing in accordance with the
Resolution of Intention No. 5097 (CCS);
2. Close the Public Hearlng;
3. Overrule the protests~ if any; and
4. Adopt the attached Resolution Ordering the Work.

RESOLUTION NO, 5133
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ORDERING THE PLANTING OF TREES ALONG
LINCOLN BOULEVARD BETWEEN OCEAN PARK BOULEVARD
AND THE SOUTH CITY LIMITS IN ACCORDANCE WITH
RESOLUTION OF INTENTION 5097 (CITY COUNCIL SERIES)
WHEREAS, the City Council of the C1ty of Santa Monica, on
the 26th day of September, 1978, passed and adopted its Resolution of
Intention, being Resolution No. 5097 (City Council Series), to order the
work described therein to be done, which in accordance with said Reso-
lution of Intention duly and legally notices were posted along the line
of the proposed project and written notices of said improvement have
been given 1n the manner required by law and any and all written objec-
tions and protests to the proposed work or the extent of the district
to be assessed were heard and considered by the City Council.
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires, and the City
Counc1l of the City of Santa Monica hereby orders the tree planting
described in said Resolution of Intention to be done along Lincoln
Boulevard between Ocean Park Blvd. and the South City Limits within the
City of Santa Monica, That all of said protests and objections of every
kind and nature to the proposed work or to the extent of the district
to be assessed be and the same hereby are overruled and denied.
SECTION 2. The Street Superintendent hereby is directed
to commence the tree planting above described after a sixty (60) day
period wherever the property owners have not started the tree planting
project themselves.

Wherever said improvements were installed by the Street
Superlntendent. he shall prepare a Report of Cost therefor. as prescribed
by law.
SECTION 3. Reference hereby is made to said Resolution
of Intention for a map of the assessment distrlct, and for further par-
ticulars.
SECTION 4. The City Clerk shall certify to the adoption
of this resolutlon and thenceforth and thereafter the same shall be in
full force and effect.
