SUBJECT: Public Hearing on Assessment of Costs for Tree Planting

Introduction
Th1S report is request1ng the C1ty Councll to hold a Public Hear1ng for the
assessment of costs of Tree Planting Distrlct No.6 on Lincoln Boulevard
from Ocean Park Boulevard and the South City Llm1ts, and to adopt the
attached Resolut10n confirmlng the assessment of costs thereof.
Background
On May 8, 1979, the C1ty Council set a PubllC Hearlng for June 26, 1979, on
the assessment of costs of tree plantlng on Lincoln Boulevard between Ocean
Park Boulevard and the South City Lim1ts Indlvidual letters stating the
cost of thlS lmprovement were malled to each property owner on May 9, 1979.
Attached lS the Staff Report of April 23, 1979, and the Resolution No
5300 (C.C,S.) settlng the date of the Public Hearing.
Recommendatlon
It is recommended that the Council hold the Publ1C Hearing and conflrm the
assessment charges aga1nst the various properties involved,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CO~FIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING TREE PLANTING
DISTRICT NO. 6 ON LINCOL~ BOULEVARD
WHEREAS, the City Councl1 of the City of Santa Monlca, p~r
suant to Section 5870, et seq., of the Streets and Highways Code, commended
proceedings to cause the planting of trees on Lincoln Boulevard from Ocean
Park Boulevard to the South City Limits ln the City of Santa Monica, and
WHEREAS, a public hearing was held on said matters, and
thereafter said Clty Councll ordered sald planting to be accomplished; and
WHEREAS, sixty (60) days after said order was served, the
work had not been completed by the owners or persons in possesslon of the
affected properties, and the Superintendent of Streets caused the work to
be done; and
WHEREAS, the Superlr.tendent of Streets did file with the City
Council of the City of Santa Manica his reports of such work, and a hearing
thereon was called by Resolution No. 5300(C.C.S.); and
WHEREAS, the City Council conducted a noticed hearing to consider
any protests or objections to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S~NTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
confirmed.
SECTION 2. That all of sald protests and obJections of every
kind and nature to the planting or to the assessments and all appeals therefrom
to said City Council be and the sarie heY'eby are overruled and denied.

SECTION 3. That the cost of the planting, as set forth in
said Reports, shall be assessed aga1nst the properties hereln described,
which properties front upon the improvement so planted.
SECTION 4. That if suc~ assessment is not paid wlthin the
time permltted by law the sa~e shall constitute a special assessment and
lien against the properties therein described, in the amount set forth
1n said Report, which llen shall continue until the assessment and all
1nterest thereon is paid.
SECTION 5. That if the assessment is not paid within the
tlme permitted, the City Clerk shall dellver a Notice of lien, signed by
the Superlntendent of Streets, as provided in Section 5891 of the Streets
and Highways Code of the State of California, to the County Assessor and
Tax Collector, who, in accordance with applicable law, shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the C1ty Clerk shall certlfy to the adoption
of this Resolution.

Dear Property Owner:
The City Councll, at lts meeting held May 8, 1979, adopted
Resolution ~o. 5300 (CCS) setting a publlC hearing date for the
purpose of hearlng protests regarding the Report of Work of the
Superintendent of Streets and the amount of assessment asslgned
against certain properties in the above named tree planting
dlstrict.
The hearing will be held as follows:
