Subject: Street Tree Planting on Lincoln Blvd. from Ocean Park Blvd.
to Pacific Street - Resolution Ordering the Work, (78-T-5)
Introduction
This report recommends that the City Council hold the Public Hearing a~d
approve the attached Resolution ordering the planting of trees on Lincoln
Boulevard from Ocean Park Blvd. to Pacific Street.
Background
The City Council at their meeting on July 11, 1978, adopted Resolution of
Intention No. 5057 (CCS) for the subject tree planting. Th1S Resolut1on
set a public hearing for August 22, 1978. Notices were posted along
Lincoln Blvd. as required. Written notices were mailed to the property
owners abutting the project, designating the time and date of the hearing
and the cost. (See attached copy of letter dated August 4, 1978),
As in the previous four street tree assessment districts, the property
owners may do the planting and appurtenant work within 60 days of the
adoption of the Resolution Ordering the Work if they wish to do so, If
the property owner does the work~ there 1S no assesSMent fee. For all
others, the City w11l do the work and the assessment will be $1.50 per
front foot.
The City has recieved no letters of protest concerning this tree assessment
district.

Recommendation
It is recommended that the City Council:
1. Hold the Public Hearing in accordance with the
Resolution of Intention No. 5057 (CCS);
2. Close the Public Hearlng;
3. Overrule the protests, if any; and
4. Adopt the attached Resolution ordering the work,

CITY COUNCIL SERIES
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ORDERING THE PLANTING OF TREES ALONG
LINCOLN BOULEVARD BETWEEN OCEAN PARK BOULEVARD AND
PACIFIC STREET IN ACCORDANCE WITH RESOLUTION OF
INTENTION 5057 (CITY COUNCIL SERIES)
WHEREAS, the City Council of the City of Santa Monica, on the
25th day of July, 1978, passed and adopted its Resolution of Intention,
being Resolution No. 5057 (City Council Series), to order the work
described therein to be done, which in accordance with sald Resolution of
Intention duly and legally notices were posted along the line of the
proposed project and written notices of said improvement have been given
in the manner required by law and any and all written objections and
protests to the proposed work or the extent of the district to be assessed
~Jere heard and considered by the City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires, and the City
Council of the City of Santa Monica hereby orders the tree planting described
in said Resolution of Intention to be done along Lincoln Boulevard between
Ocean Park Blvd. and Pacific Street within the City of Santa t1onica. That
all of said protests and objections of every kind and nature to the proposed
work or to the extent of the district to be assessed be and the same hereby
are overruled and denied.
SECTION 2. The Street Superintendent hereby is directed to
commence the tree planting above described after a sixty (60) day period
wherever the property owners have not started the tree planting project
themselves,

Wherever said improvements were installed by the Street
Superintendent, he shall preplre a Report of Cost therefor~ as prescribed
by law.
SECTION 3.
Reference hereby is made to said Resolution of
Intention for a map of the assessment district, and for further particulars,
SECTION 4. The Clty Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
