SUBJECT: Public Hearing on Assessment of Costs for Tree Planting
Distrlct No.5 on Lincoln Boulevard between Paciflc
Street and Ocean Park Boulevard
Introduction
This report is requestlng the City Council to hold a Public Hearing for the
assessment of costs of Tree Planting Dlstrict NO.5 on Lincoln Blvd. between
Pacific Street and Ocean Park Blvd., and to adopt the attached Resolutlon
confirming the assessment of costs thereof.
Background
On March 13, 1979, the Clty Council set a Public Hearlng for Apr1l 24, 1979,
on the assessment of costs of tree plantlng on Lincoln Blvd. between Pacific
Street and Ocean Park Blvd. Indlvldual letters stating the cost of th1S
improvement were mailed to each property owner on March 30, 1979. Attached
is the Staff Report of February 28, 1979, and the Resolution No. 5221 (C.C.S.)
sett1ng the date of the Publ1C Hear1ng.
Recommendation
It 15 recommended that the Council hold the Public Hearlng and conflrm the
assessment charges aga1nst the varlOUS propertles lnvolved.

RESOLUTION NO. 5290
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING TREE PLANTING
DISTRICT NO. 5
WHEREAS, the City Council of the City of Santa Monica, pur-
suant to Sectlon 5870, et seq., of the Streets and Highways Code, com-
mended proceedings to cause the planting of trees on Lincoln Boulevard
between Pacific Street and Ocean Park Boulevard in the City of Santa
Monica, and
WHEREAS, a public hearing was held on said matters, and
thereafter said City Council ordered said planting to be accomplished;
and
WHEREAS, sixty (60) days after said order was served, the
work had not been completed by the owners or persons in possession of
the affected properties, and the Suoerintendent of Streets caused the
work to be done; and
WHEREAS, the Superlntendent of Streets dld file with the
Clty Council of the City of Santa Monica his reports of such work, and
a hearing thereon was called by Resolution No. 5221 (C.C.S.); and
WHEREAS, the City Council conducted a noticed hearing to
consider any protests or objectlons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Reports of Work of the Superintendent
of Streets heretofore filed and above descrlbed, be and the same is

hereby conf,rmed.
SECTION 2. That all of said protests and obJections of
every k1nd and nature to the planting or to the assessments and all
appeals therefrom to said City Council be and the same hereby are over-
ruled and denied.
SECTION 3. That the cost of the plantin9t as set forth
1n said Reportst shall be assessed against the propert1es herein describedt
which properties front upon the improvement so planted.
SECTION 4. That if such assessment 1S not paid within the
tlme permitted by law the same shall constitute a special assessment
and lien against the properties therein descrlbed, in the amount set
forth 1n said Reports, which lien shall continue unt1l the assessment
and all interest thereon is paid.
SECTION 5. That if the assessment is not paid within the
time permitted, the C1ty Clerk shall dellver a Notice of Lien, signed
by the Superintendent of Streets, as provlded in Section 5891 of the
Streets and Highways Code of the State of California, to the County
Assessor and Tax Collector, what in accordance with appl1cable law, shall
collect sa1d assessment, together with all other taxes relating to such
property.
SECTION 6. That the City Clerk shall certify to the adoption
of this Resolution.
