Pacific Street - Resolution Ordering the Work. (78-T-4)
Introduction
This report recommends that the Clty Council hold the Public Hearing and
approve the attached Resolution orderlng the planting of trees on
Lincoln Boulevard from Pico Boulevard to Pacific Street.
Background
The City Council at their meeting o~ May 9~ 1978, adopted Resolution of
Intention No. 5016 (CCS) for the subject tree planting. This Resolution
set a public hearing for June 27, 1978. Notices were posted along Lincoln
Boulevard as required. Written notices were mailed to the property owners
abutting the project, designating the time and date of the hearing and
the approximate cost to them (see attached copy of letter dated June 7, 1978).
As in the previous three street tree assessment districts, the property
owners may do the plantlng and appurtenant work within 60 days of the
adoption of the Resolution Ordering the Work lf they wish to do so. If
the property owner does the work, there lS no assessment fee. For all
others, the City will do the work and the assessment will be $1.50.
The City has received no letters of protest concerning this tree assessment
district.

Recommendation
It 15 recommended that the C1ty Council:
1. Hold the Public Hearing in accordance with the
Resolution of Intention No. 5016 LeCS};
2. Close the Public Hearing;
3. Overrule the protests, if any; and
4. Adopt the attached resolution ordering the work.

STREET IN ACCORDANCE WITH PESOLUTION OF INTENTION 5016

WHEREAS, the City Council of the City of Santa Monica, on the

9th day of t1ay, 1978, passed and adopted its Resolution of Intention,
being Resolution No. 5016 (City Council Series), to order the work
described therein to be done, which in accordance with said Resolution of
Intention duly and legally notices were posted along the line of the
proposed project and written notices of said improvement have been given
in the manner required by law and any and all written objections and
protests to the proposed work or the extent of the dlstrict to be assessed
were heard and considered by the City Council.
NOW, THEREFORE, THE CITY COUNrTI OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires, and the City
Council of the City of Santa Monica hereby orders the tree planting described
in said Resolution of Intention to be done along Lincoln Boulevard between
Pico Blvd. and Pacific Street within the City of Santa Monica. That all
of said protests and objections of every kind and nature to the proposed
work or to the extent of the district to be assessed be and the same hereby
are overruled and denied.
SECTION 2. The Street Superintendent hereby is directed to
commence the tree planting above descrlbed after a sixty (60) day period
wherever the property owners have not started the tree plantlng project
themselves.
