IntroductlOn
This report is requesting the Clty Council to hold a Public Hearing for
the assessment of costs of Tree Planting Districts No.3 and 4 on Llncoln
Blvd. between Broadway and Wilshire Blvd. and between PieD Blvd. and Pacific
Street, and to adopt the attached Resolution conflrmlng the assessment of
costs thereof.
Background
On November 28, 1978, the Clty Council set a Public Hearing for December 12,
1978, on the assessment of costs of tree planting on Lincoln Blvd. between
Broadway and Wllshlre Blvd., and between P1CO Blvd. and Pacific Street.
Indlvidual letters stating the cost of this improvement were mailed to each
property owner on November 30, 1978. Attached is the Staff Report of
November 16~ 1978, and the Resolution No. 5145 (C.C.S.) setting the date
of the Public Hearing.
Recommendation
It 15 recommended that the Council hold the Public Hearing and confirm
the assessment charges against the various properties involved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPERIN-
TENDENT OF STREETS REGARDING TREE PLANTING DISTRICTS
NO. 3 and 4.
WHEREAS, the City Council of the City of Santa Monica, pursuant
to Section 5870, et seq.. of the Streets and Highways Code, commended
proceedings to cause the planting of trees on Lincoln Boulevard between
Broadway and Wilshire Blvd., and between Pico and Pacific Street in the
City of Santa Monica, and
WHERE~S, a publlC hearing was held on said matters, and there-
after said City Council ordered said planting to be accomplished; and
WHEREAS, sixty (60) days after said order was served, the work
had not been completed by the owners or persons in possession of the
affected propertles. and the Superlntendent of Streets caused the work to
be done; and
WHEREAS, the Superintendent of Streets did flle with the City
Council of the City of Santa Monica his reports of such work, and a hearing
thereon was called by Resolution No. 5145 (C.C.S.); and
WHEREAS~ the City Council conducted a noticed hearing to
consider any protests or objections to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Reports of Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
confirmed.

SECTION 2. That all of said protests and objections of every
kind and nature to the planting or to the assessments and all appeals
therefrom to sald City Council be and the same hereby are overruled and
denied.
SECTION 3. That the cost of the planting, as set forth 1n said
Reports, shall be assessed against the properties herein described, which
properties front upon the improvements so planted.
SECTION 4. That if such assessment is not paid w1thin the
time permitted by law the same shall constitute a special assessment and
lien aga1nst the properties therein described, in the amount set forth in
said Reports, WhlCh lien shall continue until the assessment and all
interest thereon is pald.
SECTION 5. That If the assessment is not paid wlthln the time
permitted, the City Clerk shall deliver a Notice of Lien, slgned by the
Superintendent of Streets, as provided 1n Section 5891 of the Streets and
Highways Code of the State of Californla, to the County Assessor and Tax
Collector, who, 1n accordance with applicable law, shall collect said
assessment, together with all other taxes re1atlng to such property.
SECTION 6. That the City Clerk shall certify to the adoption
of thlS Resolution.
