SUBJECT: Tree Planting Project on Lincoln Boulevard from the
Santa Monica Freeway to Broadway - Resolution
Ordering the Work.
Introduction
This report recommends that the City Council approve the attached
Resolution ordering the planting of trees on Lincoln Boulevard
from the Santa Monica Freeway to Broadway.
Backe;round
The City Council at their meeting on May 24, 1977 adopted Resolu-
tion of Intention No. 4871 for the subject tree planting. This
resolution set a public hearing for June 28, 1977. Notices were
posted along Lincoln Boulevard as required. Written notices were
mailed to the property owners abutting the project, designating
the time and date of the hearing and the approximate cost to
them (see attached copy of the letter).
The City will do the p1antlng and participate in the cost. The
estimated cost to the abutting property owners is $1.50 per
front foot.
The property owners may do the planting and appurtenant work
themselves. They would have to plant the designated trees and
comwence the work within sixty (60) days from the date of adoption

Recommendation
It is recommended that the City Council:
1. Have the public hearing in accordance with the Resolu-
tion of Intention No. 4871 (eCS);
2. Close the public hearing; and
3. Adopt the attached resolution ordering the work.

WHEREAS, the Clty Council of the City of Santa Monica
is empowered by Section 5870, et seq. of the Streets and High-
ways Code of the state of California to plant trees at various
locations within the City of Santa Monica; and
NOW, THEREFORE, THE CITY COUliCIL OF T'rIE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Tnat the public interest requires and it
is the intention of the City Council of the City of Santa Monica
to order the following work to be done, to-wit: The planting
of trees along Lincoln Boulevard from the Santa Monica Freeway
to Broadway all in the City of Santa Monica. The estimated
assessment cost of the improvement is $1.50 per front foot.
SECTION 2. That said proposed work or improvement in
the opinion of the City Council of the City of Santa Monica is
of more than local or ordinary public benefit, and said CO~Dcil
hereby proposes that the district in the City of Santa Monica
to be benefited by said work or irr.provement and to be assessed
to pay the cost and expense thereof, includes all of the property
abutting Lincoln Boulevard between the Santa Monica Freeuay and
Broad"laY.
SECTION 3. Notice hereby is given pursuant to said
Section 5870 et seq. that on June 28, 1977~ at the hour of 7:30
p.m. in the Council Chambers in the City Hall of said City of

tion of L~tention in the manner and form prescribed by law.
The City Clerk hereby is directed to ~ail notices, in
the manner and form prescribed by law, of the adoption of this
resolution to all persons owning real property in the herein-
before described assessment district, whose nanes and addresses
appear on the last equalized assessnent roll for city taxes or
as known to the City Clerk.
SECTION 5. The city Clerk shall certify to the adop-
t tion of this resolution and thenceforth and thereafter the same
shall be in full force and effect.

Boulevard in eight separate assessment districts in accorda~ce
,.rl th Chaptel~ 21 of the Improvel1lent Act of 1911. The portion of
Lincoln Boulevard from the Freeway to Broad1..fay is the first of
the eight districts.

WHEREAS, the Clty Councl1 of the C1ty of Santa Monica 1S

the State of Callfornla to plant trees and construct sldewalks at various
locations w1thin the City of Santa Monica;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the publlC interest requires and 1t 15 the
lntention of the City Council of the City of Santa Monica to order the
followlng work to be done, to wit: The planting of trees and the eonstruc-
tlOn of concrete sidewalks along the east side of Neilson Uay from Pico
Boulevard to Hol1lster Avenue all in the City of Santa Mon1ca. The esti-
~ated assessment cost of the tr~e 1nprovement is $1.75 per front foot to
the abutting property owners and the balance of the cost 15 to be borne
by the City. The estlmated assessment cost of the sldewalk construction
15 $10.00 per front foot to the abutting property owners.
SECTION 2. That said proposed work or improvement, ln the
opinion of the City Councll of the City of Santa Monica, 15 of more than
local or ord1nary public benefit, and said Counell hereby proposes that
the district in the City of Santa Mon1ca to be beneflted by said work or
improvement and to be assessed to pay the cost and expense thereof includes
all of the property abutting the east slde of !\Jeilson l1ay bet\'/een P1CO
Boulevard and Holl1ster Avenue.

SECTION 3. Notlce hereby is given pursuant to sald Section
5870 et seq., that on November 11, 1980, at the hour of 7:30 p.m. in the
(ouncll Chambers of the Clty Hall of sald City of Santa Monica, situated
at 1685 Maln Street in sald Clty, any and all persons having any objections
to the proposed work or improvement may appear before the City Council and
show cause why the sald proposed ~"ork or lmproveMent should not be carried
out in accordance wlth said Resolutlon of Intentlon.
SECTION 4. The Superintendent of Streets immediately shall
cause to be conspicuously posted along the line of said contemplated
improvement notlce of the passage of thlS Resolution of Intention 1n the
manner and fonm prescrlbed by law.
The City Clerk hereby is dlrected to mail notlces, in the
manner and form prescribed by law, of the adoptlon of this resolution
to all persons owning real property in the hereinbefore described assess-
ment district. whose names and addresses appear on the last equal1zed roll
for Clty taxes or as known to the City Clerk.
