Introduction
This report is requesting City Council to adopt the attached resolution
setting a public hearing for the assessment of the costs of Tree Plantlng
District #2 on Lincoln Blvd. between the Freeway and Pico Blvd.
Background
On September 27, 1977, the City Council ordered the planting of trees on
Lincoln Blvd. between Pico Blvd. and the Freeway. The work has been com-
pleted and the property owner1s share of the costs wlll now be due. A
public hearing must be held pursuant to Section 5882 of the Streets and
Hlghway Code of the State of Cal1fornia. A resolution confinming the
assessments and setting the public hearing is attached, together with
assessment maps indicating parcels against which liens will be flled. The
owners I names and the amount of assessment against each are listed.
Recormnendation
It is recommended that the City Council adopt the attached resolution setting
a public hearing for June 27, 1978, on the assessment of costs of the SUbject
tree planting.

RE: COMPLETION OF TREE PLANTING DISTRICT #2
Pursuant to the provisions of Section 5882 of the Streets and
Highways Code of the State of California, Resolution of Intention No.
4914 C.C.S., adopted August 23, 1977, Resolution Ordering No. 4926
C.C.S., adopted September 27, 1977, the following work was completed
on March 23, 1978, to wit:
The planting of thirty five (35) trees along Lincoln Boulevard,
between the Santa Monica Freeway and Plea Boulevard, within the City
of Santa .t~onica.
The total cost of the work was $2,907.11. The proposed assessment
is $2,907.l1. The asseSsMent was made on the basis of $1.50 per front
foot.
Reference is made to the attached sheets for a description of
the real property in front of Which the work has been done and the
asses$ment against each lot or parcel of land proposed to be levied
to pay the cost thereof.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA APPROVING THE FILING OF REPORT OF
WORK AND SETTING A HEARING DATE FOR ANY PROTESTS
OR OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING TREE PLANTING ASSESSMENT
DISTRICT NO.2.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOllOWS:
SECTION 1. That the Superintendent of Streets has fl1ed a report
of work pursuant to Section 5882 of the Streets and Hlghways Code of the
State of Californiat relating to the construction of certain Improvements
completed on:
Lincoln Boulevard between the Santa Monica Freeway
and Pico Boulevard within the City of Santa t1onica.
SECTION 2. That pursuant to Section 5a70t et seq. of said cadet
the City Council does hereby order and declare that on the 27th day of
Junet 1978, in the Council Chambers of the City Hallt it will hear and pass
upon any and all objections or protests to the report of work of the Super-
intendent of Streets and the amount of the assessment assigned against the
real property described in said report.
SECTION 3. That all or any protests or objections must be in
writing and filed with the Clty Clerk on or before the time set for hearing
of protests and objections.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ORDERING THE PLANTING OF TREES ALONG
LINCOLN BOULEVARD BEnIEEi'~ THE SANTA t10NICA FREEL.JAY
AND PICO BOULEVARD IN ACCORDANCE WITH RESOLUTION OF
INTENTION 4914 (CITY COUNCIL SERIES).
UHEREAS, the City Council of the City of Santa Nonica, on the
23rd day of August, 1977, passed and adopted its Resolution of Intention,
being Resolution No. 4914 (City Council Series), to order the work
~
described therein to be done, which in accordance with said Resolution of
Intention duly and legally notices were posted along the line of the proposed
project and written notices of said improvement have been given in the
manner required by law and any and all written objections and protests to
the proposed \lOrk or the extent of the district to be assessed \'lere heard
and considered by the City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLO~S:
SECTION 1. That the public interest requires, and the City Council
of the City of Santa Monica hereby orders~ the tree planting described in
said Resolution of Intention to be done along Lincoln Boulevard between the
Santa Monica Freeway and Pico Boulevard within the City of Santa Monica.
That all of said protests and objections of every kind and nature to the
proposed work or to the extent of the district to be assessed be and the
same hereby are overruled and denied,
SECTION 2. The Street Superintendent hereby is directed to comTience
the tree planting above described after a sixty (60) day period wherever the
property owners have not started the tree planting project themselves.

Wherever said improvements were installed by the Street Superintendent,
he shall prepare a Report of Cost therefor, as prescribed by law.
SECTION 3. Reference hereby is made to said Resolution of
Intention for a description of the work, the assessment district, and
for further particulars.
SECTION 4. The City Clerk shall certify to the adoption of this
resolution and thenceforth and thereafter the same shall be in full force
and effect.

1v.HEREAS, the City Council of the City of Santa Monica
is empowered by section 5870, et seq. of the streets and High-
ways Code of the state of California to plant trees at various
locations within the City of Santa Monica;
.. NOH, THEREFORE, THE CITY COUNCIL OF TItE CITY OF
SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it
is the intention of the City Council of the City of Santa Monica
to order the following work to be done, to-wit: The planting
of trees along Lincoln Boulevard from the Santa Monica Freeway
to Pica Boulevard all in the City of Santa Monica. The estimated
assessment cost of the improvement is $1.50 per front foot to the

contemplated improvement notice of the passage of this Resolu-
tion of Intention in the manner and form prescribed by law.
The City Clerk hereby is directed to mail notices~ in
the manner and form prescribed by law, of the adoption of this
resolution to all persons owning real property in the herein-
