Introduction
ThlS report is requesting the City Council to hold a Public Hearing for
the assessment of costs of Tree Plantlng District No.2 on Lincoln Blvd.
between the Santa Monica Freeway and Pica Boulevard and to adopt the
attached Resolution confirming the assessment of costs thereof.
Backgrouns!.
On May 9, 1978, the City Council set a Public Hearing for June 27, 1978,
on the assessment of costs of tree planting on Lincoln Blvd. between the
Santa Monica Freeway and Broadway. Individual letters stating the cost
of this improvement were mailed to each property owner on May 23, 1978,
Attached is the Staff Report of April 26, 1978, and the Resolutlon No. 5012
(C.C.S.) settlng the date of the Public Hearing,
Recorrrnendatlon
It is recommended that the Council hold the PubllC Hearing and confirm the
assessment charges agalnst the various properties involved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING TREE PLANTING DISTRICT NO.2.

WHEREAS, the City Council of the City of Santa Monica, pursuant
to Section 5870, et seq., of the Streets and Highways Code, commended
proceedings to cause the planting of trees on Lincoln Boulevard between
the Santa Monica Freeway and Pico Blvd. in the City of Santa Monica, and
WHEREAS, a public hearing was held on said matters, and thereafter
said City Council ordered said planting to be accomplished; and
WHEREAS, sixty (60) days after said order was served, the work
had not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of Streets cau~ed the work to
be done; and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Monica his reports of such work, and a
hearing thereon was called by Resolution No. 5012; and
WHEREAS, said City Council conducted a noticed hearing to
consider any protests or objections to the Reports of the Work.
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Reports of Work of the Superintendent of
Streets he~etofore filed and above described, be and the same is hereby
confirmed.

SECTION 2. That all of said protests al'1d oL2ectio'1s of every
kind and nature to the planting or to the assessments and all appeals
therefrom to said City Council be and the same hereby are overruled and
denied.
SECTION 3. That the cost of the planting, as set forth in
said Reports, shall be assessed against the properties herein described~
which properties front upon the improvements so planted.
SECTION 4. That if such assessment is not paid within the

time permitted by law the same shall constitute a special assessment and
lien against the properties therein described, in the amount set forth in
said Reports, which lien shall continue until the assessment and all
interest thereon is paid.
SECTION 5. That if the assessment is not paid within the time
permitte~, the City Clerk shall deliver a Notice of Lien, signed by the
Superintendent of Streets~ as provided in Section 5891 of the Streets
and Highways Code of the State of California, to the County Assessor and
Tax Collector, who, in accordance with applicable law, sha1l collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certlfy to the adoption
of this Resolution.
