Public Hearing for Tree Planting Project
on Broadway Between 14th Street and 20th Street
SUBJECT:
Introduction
This report requests City Council hold a public hearing for the
planting of trees on Broadway between 14th Street and 20th Street.
Background
The City Council at its meeting on September 28, 1982, adopted
Resolution
No.
6564 for the subject tree planting.
This
resolution set a public hearing for October 26, 1982. Written
notices were mailed to the property owners abutting the project,
designating the time and date of the hearing and the approximate
cost to them and were posted as required by law.
The City will do the planting (except for owners who may wish to
do so) and will participate in the cost. The estimated cost to
the abutting property owners is $3.00 per front foot.
The property owners may do the planting and appurtenant work
themselves and they will have to plant the designated trees and
commence the work within 60 days from the date of adoption of the
resolution ordering the work. If the work is done by any property
owner, there will be no assessment to that property.
Selection of the type of trees to be planted is done in accordance
with the approved City Tree Plan.

Recommendation
It is recommended that the City Council:
1. Open the public hearing;
2. Close the public hearing and acknowledge any protests; and
3. Adopt the attached resolution ordering the work.

NOTICE TO IMPROVE
At a regular meetlng held on September 28, 1982. the City Councll
adopted Resolution No. 6564 (CCS) which lnstructs the Street Super-
intendent to order property owners to plant trees along the property
frontlng Broadway between Fourteenth and Twentieth Streets. The
materlals and work shall be in accordance with the standards of the
City of Santa Monlca. If constructlon lS not begun within 60 days
from the date of this notlce and dill gently and wlthout interruptlon
prosecuted to completion, the Street Superintendent shall cause the
constructlon to be done and the cost shall be assessed agalnst and
a llen on the property.
The City Counel1 wlll hear and pass upon objectlons or protests to
the order to plant trees. lf any. by any property owner or other
interested party at the following date. time and place:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE PLANTING OF TREES
ALONG FOURTEENTH AND TWENTIETH STREETS ALL
WITHIN THE CITY OF SANTA MONICA
WHEREAS, the Ci ty Council of the Ci ty of Santa Monica, on the
28th day of September, 1982, adopted Resolution No. 6564 (CCS)
setting a public hearing; and
WHEREAS, written notices of said improvement have been given
in the manner required by law; and
WHEREAS, any and all written objections and protests to the
work or the extent of the district to be assessed were heard and
con sid ere d by the City Co u n c il ;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the public convenience and necessity
require the planting of trees along Broadway between Fourteenth
and Twentieth Streets, all within the City of Santa Monica.
SECTION 2.
That all protests and objections of every kind
and nature to the planting of trees along Broadway between
Fourteenth and Twentieth Streets, all with the City of Santa
Monica, be and the same are hereby overruled and denied.

SECTION 3.
That pursuant to Streets and Highways Code
Section 5880, the Street Superintendent is directed to commence
the planting of trees above described if the planting is not
commenced and prosecuted to completion with due dfligence by any
property as required by Streets and Highways Code Section 5879.
SECTION 4.
That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
sal'le shall be in full force and effect.
