Introductlon
Th1S report recommends formlng an asseSSment district to plant
street trees on Broadway between Fourth and Seventeenth Streets
and setting a publ1C hearing for October 22. 1985.
Background
As a cont1nuat10n of the Clty'S tree planting beaut1f1cation
program for commercial dlstrlcts. the Clty Council approved funds
1n the amount of $5.000
for FY 1 9 8 5 -1 9 8 6 top 1 ant t r e e sin
commerclal areas of the Clty wlth the cost of the trees to be
recovered by assessment d1strlct revenues.
Commercial property
owners wlll be assessed for the full cost of the trees. which is
approximately $3.00 per front foot.
Tree planting assessment
dlstr1cts in previous years have been conducted on port1ons of
Santa l10nlca Boulevard. Lincoln Boulevard and P1CO Boulevard.
The addltlon of these trees have slgnlflcantly lmproved the
aesthetlCS of these streets.
Staff 1S recommendlng that a tree planting assessment distrlct be
formed on Broadway between Fourth and Seventeenth Streets. In
1982
an
assessment
district
was
previously
established
on
Broadway. however. due to lack of funds the trees were not
planted and the property owners were not assessed.
Due to the
tlme lapsed Slnee the dlstrlct was set up. staff has determined

that the asseSSment proceedings should be repeated.
Property
owners will be not1fied of the pend1ng assessment d1strict ten
days pr10r to the public hear1ng 1n accordance w1th Chapter 27 of
the Ca11fornia Streets and H1ghways Code.
Any protests will be
heard at the public hearing to be held on October 22, 1985. An
assessment distrct for other port1ons of Broadway will be formed
at a later date.

Appropriation authority is available in the amount of $5,000 in
Account

Revenue

by this

01-907-177-000-000.
Recommendat1on
It is recommended that the C1ty Counc1l adopt the attached
resolution forming the assessment d1strict and sett1ng the pub11c
hearing for October 22, 1985.

WHEREAS, there 1S a need to plant trees along Broadway
from Fourth Street to Seventeenth Street, all w1thin the C1ty of
Santa Monlca: and
WHEREAS, 10 accordance with SectIon 5870 et _seq~ of the
Streets and Hlgnways Code procedures eXlst to notl.fy property
owners of thelr duty to plant or cause to De planted trees and to
permlt tne Superlntendent of Streets to plant the trees If not
planted or caused to be planted by the property owners; and
WHEREAS, the Clty Counell of the Clty of Santa Mon~ca on
its own motlon may order the plantlng of trees;
NOfl, TdEREFORE, THE CITY COUNCIL OF THE CITY OF SA~TA
MONICA DOES RESOLVE AS FOLLOwS:
SBCITON 1. Pursuant to Section 5875 of the Streets and
Hlghways Code, toe c~ ty Counc~l of the Ci ty of Santa Monica
orders the plantlng of trees along Broadway from Fourth Street to
Seventeenth.
SECTION 2. Pursuant to Sectlon 5876 of the Streets and
H~ghway Code, the Super1ntendent of Streets shall not1fy, in the

manner requlred by law, the owner s of proper ty along Broadway
from Fourth 3treet to 3~venteenth Street to plant or cause to be
planted trees. The notice shall contain the information required
by Section 5879 of the Streets and Highways Code and shall also
spec lfy the day, hour and place, as set forth In Section 3 of
this ResolutIon, where the CIty Councll of the Clty of Santa
MonIca wIll hear and pass upon ob] ectIons or protests, if any,
whlch may be raised by an property owner or other lnterested
persons.
SECTION 3.
That pursuant to Section 5878.1 of the
Streets and Hlghways Code, the Clty Councll of tne Clty of Santa
MonIca does hereby order and declare that on tne 22 day of
October, 1985, at 7:30 p.m., in the CounCIl Chambers of Clty
Hall, 2t WIll hear and pass upon obJectIons or protests, If any,
WhICh may be raIsed by an property owner or other lnterested
person.
SEcrION 4. The CIty Clerk shall certify to the adoption
of this resolutIon and thenceforth and thereafter the same shall
be In full force and effect.
