Introduction
The C1ty Council has set a Public Hearing and, after holding the hear1ng~
1t 1S recommended the attached Resolution ordering the plantlng of trees on
Broadway from Fourth Street to Lincoln Boulevard be approved.
Background
The C1ty Council at its meeting on July 22, 1980, adopted Resolution of
Intention No. 6047 for the subJect tree planting (Item 6-K). This resolution
set a publ1C hearing for August 26~ 1980. Notlces were posted along Broadway
as required. Wr1tten notlces were mailed to the property owners abutting the
project, designating the time and date of the hearing and the approximate
cost to them (see attached copy of the letter). The Public Hearing was con-
tinued to September 9, 1980.
The C1ty will do the planting (except for owners who may w1sh to do so) and
will participate in the cost. The est1mated cost to the abutting property
owners is $1.75 per front foot.
The property owners may do the planting and appurtenant work themselves and
they will have to plant the designated trees and commence the work with1n 60
days from the date of adoption of the resolut1on ordering the work. If the
work is done by any property owner, there will be no assessment to that property.

Recommendation
It 1S recommended that the City Council:
1. Hold the public hearing 1n accordance with the Resolution of
Intention No. 6047 (C.C.S.);
2. Close the public hearing; and
3. Adopt the attached resolution ordering the work.

The estImated assessment cost of the tree plantIng of 5l.75 per
front foot will be assessed to the dIstrIct benefItIng from the
improvement. ThIS Includes all of the property abuttIng
Broadway between 4th Street and LIncoln Boulevard.
In order for any and all persons obJectIng the the proposed tree
plantIng to have the opportunity to address the CIty Councll, a
publIC hearing has been set for August 26, 1980 at 7:30 P.~I.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTION TO PLANT TREES
ALONG BROADWAY aE~NEEN FOURTH STREET AND LINCOLN
BOULEVARD WITHIN THE CITY OF SANTA MONICA.
WHEREAS. the Clty Council of the City of Santa ~onica is
empowered by Section 5870, et seq., of the Streets and Hlghways Code of the
State of Californla to plant trees at var10US locations within the City of
Santa Monica;
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires lnd ,t is the
intention of the City Councll of the City of Santa Monica to order the following
work to be done, to wit: The plantlng of trees along Broadway from Fourth
Street to Lincoln Boulevard all in the City of Santa Mon1ca. The est1mated
assessment cost of the improvement 1S 51.75 per front foot to the abutting
property owners and the balance of the cost is to be borne by the City_
SECTION 2. That said proposed work or improveme~t. 1n the
oplnlon of the City Councll of the City of Santa Manica, 1S of more than local
or ord1nary public benefit, and sa1d Council hereby proposes that the district
in the Clty of Santa Monica to be benef1tted by said work or improvement and
to be assessed to pay the cost and expense thereof, i~cludes all of the
Droperty abutting Broa~fflY between Fourth Street and Lincoln Boulevard.
SECTION 3. Notice hereby is given pursuant to sa1d Sect10n
5870 et seq. that on August 25. 1980, at the hour of 7:30 p.m. 1n the Council
Chambe~s of the City Hall of said City of Santa Monica. situated at 1685 Maln
Street i~ said City, any and all Dersons having any obJections to the Jroposed

said proposed work or improvement should not be carrled out in accordance w1th

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
. SANTA MONICA ORDERING THE PLANTING OF TREES ALONG
BROADWAY BETWEEN FOURTH STREET AND LINCOLN BOULEVARD~
All WITHIN THE CITY OF SANTA MONICA.
WHEREAS, the City Councjl of the City of Santa Monica, on the
22nd day of July, 1980, adopted its Resolution No. 6047 (City Council
Series)~ bein~ the Resolution of Intention, which described the work to
be done; and
WHEREAS~ in accordance with the said Resolution of Intention
notlces were posted along the line of the proposed project and written
notices of the improvement were mailed in the ~anner required by law; and
WHEREAS, any and all written objectlOns and protests to the work
or the extent of the district to be assessed were heard and considered~by
the City Council;
NOW, THEREFORE~ THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the publlC interest requires~ and the City
Council of the City of Santa Monica hereby orders the tree planting desc:ibed
in said Resolution of Intentlon to be done along Broadway between Fourth
Street and Lincoln Boulevard within the City of Santa Monica. That all of
said protests and objections of every kind and nature to the proposed work
or to the extent of the district to be assessed be and the same hereby are
overruled and denied.
SECTION 2. That Street Superintendent hereby is directed to
commence the tree planting above described after a 60-day period wherever
the property owners have not started the tree planting project themselves.

SECTION 3. Reference hereby is made to said Resolution of
Intention for a map of the assessment district, and for further particulars.
SECTION 4. The City Clerk shall certlfy to the adoption of this
resolution and thenceforth and thereafter t~e same shall be in full force
