Subject: Resolution Ordering Planting of Trees on
Broadway between 20th Street and and 26th
Street
Introduction
This report recommends the formation of an assessment district to
plant trees on Broadway from 20th Street to 26th Street. It also
requests the Council to set a public hearing for November 9, 1982.
Background
The Ci ty previously has assessed prope rty owners on Lincoln
Boulevard and Santa Mo n 1 c a Boulevard fa r tree planting and a tree
planting assessment district has been fo rmed as part of the
Wilshire resurfacing project. As a continuation of the City I s
tree planting beautification project, staff believes it is
appropriate to form assessment districts along Broadway to plant
trees. All street and sewer work in Broadway has been completed.
The assessment district will be formed in compliance with Chapter
27
of
the Streets and Highways Code and assessments are
recommended as a continuation of past practice to recover the full
cost of the tree planting which is $3.00/front foot. The attached
resolutlon directs the Street Superintendent to order the work
done and, in addition, sets a public hearing for November 9, 1982,
at which time public protests will be heard. Funds will have to
be appropriated at the time of public hearlng. The assessments
collected will reimburse the above fund.

The planting of these trees as well as any future street trees
planted by City staff on other parts of Broadway, 20th Street~
Santa Monlca Boulevard, Wilshire, Olympic and other streets will
result in additional maintenance costs in future years. These
additional costs are of concern to the City staff. The cost of
tree maintenance is presently covered by the General Fund. The
staff has presented a plan to fund these costs by a City-wide
assessment district.
Recommendation
It is recommended that the City Council adopt the attached
resolution directing the Street Superintendent to order the
planting of trees along Broadway between 20th Street and 26th
Street and setting a public hearing for November 9, 1982.

WHEREAS. in accordance with Section 5870 !! seq. of the
Streets and Highways Code procedures exist to notify property--
owners of their duty to plant or cause to be planted trees and to
permit the Superint~ndent of Streets to plant the trees if not
planted or caused to be pl~nted by the property owners; and
WHEREASj the Ci ty Council of the Ci ty of Santa Monica
on its own motion may order the planting of trees;
NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of the Streets and
Highways Code. the City Council of the City of Santa Monica
orders the planting of trees along Broadway from 20th Street and
26th Street.
SECTION 2. Pursuant to Section 5876 of the Streets and
Highways Code. the Superintendent of Streets shall notify. in the
manner required by law. the owners of property along Broadway
from 20th Street to 26th Street to plant or cause to be planted

The notice shall contain the information required by
Section 5879 of the Streets and Highways Code and shall also
specity the day~ hour and place, as set forth in Section 3 of

this Resolution, where the City Council of the City of Santa
Monica will hear and pass upon objections or protests. if any.
which may be raised by any property owner or other interested
persons.
SECTION 3.
T~at pursuant to~~tion 5878.1 of the
Streets and Highways Code~ the Clty Council of the City of Santa
Monica does hereby order and declare that on the 9th day of
November~ 1982. at 7:30 p.m.. in the Council Chambers of City
Hall, it will hear and pass upon objections or protests, if any,
which may be raised by any property owner or other interested
person.
SECTION 4.
The City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter'the 'l."
