A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPERIN-
TENDENT OF STREETS REGARDING TREE PLANTING DISTRICTS
NO. 3 and 4.
WHEREAS, the City Council of the City of Santa Monica, pursuant
to Sectlon 5870, et seq., of the Streets and Highways Code, commended
proceedings to cause the planting of trees on Llncoln Boulevard between
Broadway and Wilshire Blvd., and between Pico and Pacific Street in the
City of Santa Mon1ca, and
WHEREAS, a public hearlng was held on said matters. and there-
after said City Councll ordered said planting to be accompllshed. and
WHEREAS. sixty (60) days after said order was served, the work
had not been completed by the owners or persons in possession of the
affected propertles, and the Superintendent of Streets caused the work to
be done; and
WHEREAS, the Superintendent of Streets dld file with the Clty
Council of the City of Santa Monica his reports of such work~ and a hearing
thereon was called by Resolution No. 5145 (C.C.S.); and
WHEREAS, the City Council conducted a notlced hearing to
consider any protests or objections to the Reports of the Work.

DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Reports of Work of the Superintendent of
Streets heretofore filed and above described, be and the same 1S hereby

Introduction
This report is requestlng Clty Councll to set a public hearing for the assess-
ment of the costs of Tree Planting Distrlcts 3 and 4 on Llncoln Blvd. between
Broadway and Wilshire Boulevard, and between Pica Blvd. and Paclfic Street.
Background
On December 29, 1977, the City Counell ordered the planting of trees on Lincoln
between Broadway and Wilshlre Blvd., and on June 27, 1978, the City Council
ordered the plantlng of trees between Pico Blvd. and Paclflc Street. The work
has been completed and the property owner's share of the costs wlll now be
due. A public hearing must be held pursuant to Section 5882 of the Streets
and Highway Code of the State of California. A resolution eonfimllng the assess-
ments and settlng the publlC hearing is attached,
Recommendatlon
It is recommended that the City Councll adopt the attached resolution setting
a public hearing for December 12, 1978, on the assessment of costs of the sub-
ject tree plantings.

STREET SUPERINTENDENTS' REPORT
TO THE CITY COUNCIL
BE: COMPLETION OF TREE PLANTING DISTRICT #3 & #4
Pursuant to the provisions of Section 5882 of the Streets and
Highways Code of the State of California, Resolution of Intention No.
4949 C.C.S., adopted November 22, 1977, and No. 5016 C.C.S. adopted
May 9, 1978, Resolution Ordering No. 4965 C.C.S., adopted January 10,
1978, and No. 5046 C.c.s. adopted June 27~ 1978, the following work
was completed on November 8, 1978, to wit:
The planting of ninety nine trees along Lincoln Boulevard,
between Wilshire Boulevard and Broadway and between Pico Boulevard
and Pacific Street, within the City of Santa Monica.
The total cost of the work was $7,8l~.20. The proposed assessment
is $7,8l4.20. The assessment was made on the basis of $1.50 per
front foot.
Reference is made to the attached sheets for a description of
the real property in front of which the work has been done and the
assessment against each lot or parcel of land proposed to be levied
to pay the cost thereof.

Superlntendent of Streets and the arount of the assessment asslgned against
the real property described in sald report.

22nd day of November, 1977, passed and adopted its Resolution of Intention,
being Resolution No. 4949 (City Council Ser1es), to order the work
described therein to be done, which in accordance with said Resolution of
Intention duly and legally notices were posted along the line of the
proposed project and written notices of said improvement have been given
in the manner required by law and any and all written objections and

SECTION 1. That the public interest requires. and the City Council
of the City of Santa Monica hereby orders the tree planting described in
said Resolution uf Intention to be done along Lincoln Boulevard between
Broadway Avenue and Wilshire Boulevard with1n the City of Santa Monica.
That all of said protests and objectlons of every kind and nature to the
proposed work or to the extent of the distr1ct to be assessed be and the
same hereby are overruled and denied.
SECTION 2. The Street Superintendent hereby is dlrected to
commence the tree p1antlng above descrlbed after a Slxty (60) day period
wherever the property owners have not started the tree planting project
themselves.

Wherever said improvements were installed by the Street
Superlntendent, he shall prepare a Report of Cost therefor, as prescribed
by law.
SECTION 3. Reference hereby is made to said Resolution of
Intentlon for a description of the work, the assessment district, and
for further particulars.
SECTION 4. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
