Introduct1on
Th1S report requests C1ty Counc1l hold a public hear1ng for the
plant1ng of trees on Broadway between 20th Street and 26th Street.
Background
The C1ty Councll at its meeting on October 12, 1982, adopted
Resolut1on
No.
6574 for the subJect tree plant1ng.
ThlS
resolutlon set a public hearlng for November 9, 1982. Written
notlces were malled to the property owners abutting the proJect.
des1gnatlng the t1me and date of the hearlng and the approximate
cost to them and were posted as requlred by law.
The City will do the plant1ng (except for owners who may w1sh to
do so) and wlll participate 10 the cost. The estlmated cost to
the abutt1ng property owners 1S $3.00 per front foot.
The property owners w1shing to do the plantlng and appurtenant
work themselves must plant the des1gnated trees and commence the
work w1thln 60 days from the date of adoptlon of the resolutlon
order1ng the work.
If the work is done by any property owner,
there wil J be no assessment to that property.
Selectlon of the type of trees to be planted is done in accordance
with the approved Clty Tree Plan.

NOTICE TO IMPROVE
At a regular meeting held on October 12, 1982. the City Council
adopted Resolutlon No. 6574 (CCS) WhlCh instructs the Street Super-
1ntendent to order property owners to plant trees along the property
frontlng Broadway between Twent1eth and Twenty-Sixth Streets. The
materlals and work shall be In accordance with the standards of the
Clty of Santa Monica. If construct1on 1S not begun with1n 60 days
from the date of th1S not1ce and d1ligently and without lnterrupt10n
prosecuted to completion. the Street Superlntendent shall cause the
constructlon to be done and the cost shall be assessed agalnst and
a lien on the property.
The Clty CounC1l wlll ~ear and pass upon objections or protests to
the order to plant trees. if any. by any property owner or other
lnterested party at the followlng date. tl~e and place:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE PLANTING OF TREES
ALONG 20th STREET AND 26TH STREET ALL WITHIN
THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa Monica, on the
12th day of October, 1982, adopted Resolution No. 6574 (eCS)
setting a public hearing; and
WHEREAS, written notices of said improvement have been given
in the manner required by law; and
WHEREAS, any and all written objections and protests to the
work or the extent of the district to be assessed were heard and
cons ~de red by the Ci t Y Counci';
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
That
the public convenience and necessity
requ~re the planting of trees along Broadway between 20th Street
and 26th Street, all within the City of Santa Monica.
SECTION 2.
That all protests and objections of every kind
and nature to the planting of trees along Broadway between 20th
and 26th Streets, all with the City of Santa Monica, be and the
same are hereby overruled and denied.

SECTION 3.
Section 5880,
That pursuant to
Streets and Highways Code
the planting of trees above described if the planting is not
the Street Superintendent is directed to commence
commenced and prosecuted to completion with due diligence by any
property as required by Streets and H1ghways Code Section 5879.
SECTION 4.
That
the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be 1n full force and effect.
