Introduction This report recommends that City council hold a pUblic hearing for establishing an assessment district for the implementation of alley improvements to 4th Court between Colorado Avenue and Broadway, and to 9th Court between Olympic Boulevard and 476' North. The improvements consist of replacement of asphalt pavement with concrete pavement and appurtenant work. Backqround . The existing asphalt pavement on the two courts has deteriorated significantly in places creating numerous open cracks, extensive potholes, and water drainage problems. Traffic flow is impeded as rainfall runoff is restricted. Portions of the 4th Court have been repaved with concrete, are in good condition, and will remain. Due to the extent of the damage on the remaining concrete, patching with asphalt is not economical. The reconstruction of 4th and 9th Courts is proposed, consisting of improving drainage flow, improving drywell on 9th Court and replacing the existing deteriorated asphalt paving with new - 1 - fVG n 3 1993 10- f3 JUL 13 J993 Jut ~) n 1993 .. . concrete paving. The installation of a concrete alley wll1 result in reduced maintenance costs, elimination of water infiltration from drywell to existing sewer line on 9th Court, enhanced road travel, and reliable stormwater drainage. The useful life of the proposed concrete alleys is estimated to be in excess of 50 years. Second and Third Courts between Broadway and wilshire Boulevard, and Lincoln Court between Olympic Boulevard and Mich~gan Avenue were similar alley assessment projects that were completed in 1992. ~ The estimated cost to property owners for 4th and 9th Court improvements is $72.00 per lineal foot on each side of the alley. There are eleven parcels on 9th Court and nine parcels on 4th Court. The average assessment for a 50 foot lot is approximately $3,600.00. All assessments relate to commercial/industrial properties. There are no affected residential properties within the boundaries of this assessment. ~ On April 27, 1993, the city council adopted Resolution No. 8577 (CCS) setting a public hearlng on July 13, 1993 to hear protests concerning the proposed work. The assessment district will be administered in accordance with the procedures set forth in the Government code and the Improvement Act of 1911 in the California streets and Highways Code. On May 27, 1993 notices were mailed to all affected property owners and posted along the affected areas. The Resolution of Intention stated that no bonds will be issued: - 2 - however, staff recommends council offer the bond payment method as one of two payment options to property owners. The first option to property owners is to pay in cash (cash payments would be excluded from hond issuance). The second option lS to make debt service payments plus interest over la-years as a part of bond financing for these improvements. The notice mailed to property owners discussed both these options. These payment options are similar to those offered to participants of streetlighting assessments. ~ Budqet/Financial Impact The cost of the reconstructing both alleys is approximately $116,000.00. The amount of $77,000 for 9th Court is available in CIP Account No. 31-760-661-20092-8900-99208, tlDrywell Improvements, II and the amount of $39,000 for 4th Court is available in 01-770-421-20093-8900-99152, "street Repair/Resurfacing. " The assessment district will generate revenues of approxlmately $116,000.00 for FY 1993-94 which wlll ~ be deposited in Revenue Account Nos. 31-500-661-00000-0263-10000, "Misc. Non Operational Revenue" and 01-500-401-00000-0l24-10000, "Street Resurfacing Assessment District" respectlvely. Adapt establishing the attached Resolution assessment district for the reconstruction of 4th Court between Colorado Avenue and Broadway, and 9th Court from Olympic Boulevard to 476' North. Despl.te reference in Resolution 8577 (CCS) to the contrary, bonds will be issued for noncash assessments. Serial bonds bearing interest at the rate of 9% per annum shall - 5 - be issued to represent each assessment of One Hundred Flfty dollars ($150.00) or more remaining unpaid for thirty (30) days after the recordl.ng of the warrant. said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st following this date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the city Treasurer and the same shall be disbursed by him/her or as provided in the "Improvement Act of 1911" hereinafter referred to. In accordance with streets and Highways Code Section 6442, the first two percent (2%) delinquency penalty authorized by such section shall be retained by the City controller for the cost of servicing the . delinquency. SECTION 4. Pursuant to streets and Highways Code Section 5880, the Street Superintendent is directed to commence the reconstruction of the alleys sixty (60) days after giving notices wherever the property owners have not initiated the alley reconstruction themselves. . SECTION 5. The city Clerk shall certify to the adoption of this Resolution, and thereafter the same shall be in full force and effect. The alley behind my buiiding was redone when the Ken Edwards Center was built and it is in EXCELLENT condition. Any consideration of the CITY will do to delay this work would be greatly appreciated.
