Authorization to Acquire Right-of-Way on Cloverfield Boulevard
Between Broadway and Schader Drlve
Introduction
This report recommends that the City Council approve the trade of a small piece
of Clty-Owned property on Cloverfleld Boulevard to facilitate a prevlously
approved intersection safety lmprovement.
Background
In 1973, the City CouncTl approved a major improvement plan for Cloverfield Blvd.
between the Santa Nonica Freeway and Santa ~1onica Boulevard. The portion bet\o'/een
Santa Monica Freeway and Broadway was bUIlt in 1977, and the portion between
Broadway and Santa Monica Boulevard was not improved because of right-of-way
acquisition problems. On August 22, 1978, (Item ll-A), the staff submitted and
received Council approval of a revised conceptual improvement plan which showed
the project at a reduced width to fit withln the existing rights-af-way, except
at Broadway where a transitlon in width is necessary. It is this portion of
the rlght-of-way which staff recommends be acquired at this tlme.
The construction of this last segment of the Cloverfield improvement is necessary
to eliminate the existing hazardous lntersection at Broadway. The slgnal has
been knocked down at least three times in the last three years at thlS location.
The property owner, after several months of negotiations, has agreed to sell
1,250 square feet of his property at the appraised price of $18/sq.ft.,

with the condition that the City trade to him a piece of property four feet
in width and pay for the net acquisition. The four foot piece 1S adjacent to
the northerly boundary of the sUbject property where acquisition 1S to take
place. The CitY-~/ned property is to be a City park, and was designated as a
park in the out-of-court settlement which was reached in the legal act10n of
Linda V1ta1e and Sharon Gi1pln vs. The City of Santa Monica.
The staff recommends that the four foot wide parcel be traded to Mr. Oldfield
and that a four foot strip at the northerly end of the proposed park site be
added to the park so that the net park site will be the same Slze as agreed to
in the legal settlement.
Recommendatlon
It 1S recommended that the Council authorize the right-af-way trade of 176.04
square feet with Mr. Oldfield as indicated in the attached drawing, that the
C1ty Manager be autharlzed to acquire 1240 square feet of Mr. Oldf1eld1s property,
and that the City waive the requirements of the Subdivision Map Act and authorize
the recordation of documents necessary to show that the 176.04 square feet
parcel is a part of Mr. Oldfield's property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AUTHORIZING THE ACQUISITION AND TRADE OF
PROPERTY FOR THE WIDENING OF CLOVERFIELD BOULEVARD
BETWEEN BROADWAY AND SANTA MONICA BOULEVARD.
WHEREAS, the City Council of the City of Santa Monica approved
a major improvement plan for Cloverfield Blvd. between the Santa Monica
Freeway and Santa Monica Blvd. in 1973, and the portion between the Santa
Monica Freeway and Broadway was improved in 1977, and the portion between
Broadway and Santa Monica Blvd. was delayed due to property acquisltion, and
WHEREAS, City Staff has negotiated a tentative agreement for
the final portion of property needed to complete the lmprovement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public safety and convenience require this
improvement and the City Council of the City of Santa Monica authorizes the
City Manager to trade 176.04 square feet of prlvate property for a four-foot
strip of equal size of adjacent City-Owned property and acquire an additional
1,240 square feet of needed property to complete the improvement.
SECTION 2. The northwesterly lot line of Lot 6, Block 4,
Schader's Addition as per map recorded in Map Book 6, Page 67 in the Office of
the County Recorder of Los Angeles County be adJusted northwesterly four feet
and the parcel map requirement is hereby walved in accordance with
Section 664l2(d) of the Subdivision Map Act of the State of California.

SECTION 3. The City Clerk shall certify to the adoption of
this resolutlon and thenceforth and thereafter the same shall be in full force
and effect.
