GS:SS:EHL:a October 6 Council Meeting: October 13, 1987 Santa Monica, California To: Mayor and City Council From: City staff Subject: Limited Recommendation to Adopt a Resolution to Permit Filmmaking at Woodlawn Cemetery and Mausoleum Introduction This report requests that the City Council adopt a resolution to permit limited filmmaking at Woodlawn Cemetery and Mausoleum and establish fees for such use. Background Currently the City does not permit filmmaking at Woodlawn Cemetery. Thi s pol icy was establ ished by the City Counc il in 1979 as the result of a complaint received from the then privately owned mausoleum located on the Cemetery property. Prior to and since the establishment of the non-filming policy, the Cemetery has received an average of two requests per week to film on the grounds. The City now owns the Mausoleum and, by imposing strict regulations, can eliminate public inconvenience during filming. The demand for filming permits could provide significant additional revenue to the Cemetery Funds. Of the eleven maj or cemeteries in the Los Angeles area , five allow filming and six including Woodlawn, do not. Westwood Memorial Park, the nearest to Santa Monica, has a $1,800 per day flat fee, and reports that their grounds are in great demand for filming since the City of Santa Monica has prohibited filming at Woodlawn. - 1 - ~~1> OCT 1 3 1981 . . staff believes that if filming were limited to the oldest part of the Cemetery, where the upright markers are presently located and where less than one burial a year occurs (see Attachment 2), no interference to the public would result. This arrangement would restrict movie makers to a remote corner of the Cemetery insuring that their activities would not disrupt funeral services or Cemetery visitors. The availability of this isolated area is the primary consideration in recommending the lifting of the filmmaking ban at the Cemetery. Filming in the Mausoleum would be permitted from 4 P.M. to midnight, Monday through Thursday only. since the building is closed to the public during this time, no interference with funeral activities or visitors would occur. Permits for filming at Woodlawn Cemetery would be issued by the General Services Department as provided in Resolution 7145 (C. C. S., Attachment 3) and filmmakers would be subject to the provisions therein. In addition, the following conditions specific to Woodlawn Cemetery would be required to prevent inconvenience to the public, disruption of funeral scheduling or the work of the Cemetery staff: REGULATIONS FOR FILMING AT WOODLAWN CEMETERY 1. All requirements of Resolution 7145 (CCS) and Commercial Film Permit (Attachment 4) application apply. 2. No film activity involving motorcycles is permitted, police escorts excepted. - 2 - . . 3. No "chase scenes" of any nature are permitted. 4. A police officer, or more than one as determined by the Chief of Police, shall be in attendance at all times while filming crews are in the Cemetery. 5. The costs of cemetery equipment or personnel required for the filming or in support of the filming shall be estimated and that amount deposited at the time the permit is issued. Additional unforeseen costs incurred are payable at the termination of the filming. 6. Filming is allowed only in areas of the Cemetery designated by the Cemetery Superintendent. 7. The Film company is required to pOlice and clean the area prior to leaving the Cemetery. Grounds are to be in the same or a better state of cleanliness then they were preceding the filming. 8. The Cemetery Superintendent retains administrative approval regarding all locations, methods, scenes, and content of any filming operation in the cemetery. 9. Any violation or non-compliance with any of the above regulations may result in withholding future permits. BUdget/Financial Analysis A fee of $1200 per day for filmmaking at the Cemetery or Mausoleum is equal to the median rate of other cemeteries (see Attachment 1). Conservatively assuming a rate of one film permit issued per week, an additional $62,400 annually would be generated for the Cemetary Fund. - 3 - . . Additional charges for overtime workers will be estimated by the utilities Manager and paid prior to issuance of the permit. Staff proposes that 60% of each use fee ($720) will be credited to either the Cemetery or Mausoleum Perpetual Care Fund, based on which facility is used. The remaining use fee ($480) and any charges for overtime or cemetery equipment use would be credited to the Cemetery Operating Fund. since the actual level of use is unknown at this time, revenue proj ection modifications and additional overtime appropriations will be made in the mid-year budget review after a use pattern has been established. Recommendation It is recommended that the City Council: 1. Approve the attached resolution permitting limited filming at Woodlawn Cemetery and Mausoleum; 2. Direct the Finance Director to credit 60% of each use fee to the Perpetual Care Fund of the facility used and 40% of the use fee and all of the charges for equipment and personnel use to the Cemetery Operating Fundi 3. Direct the Finance Director to adjust the Cemetery revenue accounts at the mid-year budget review based on the information available at that time~ and - 4 - . . 4. Direct the staff to adjust the overtime expenditure account for the Cemetery (37-500-641-000-150) during the mid-year budget review based on the information available at that time. RESOLUTION NO. (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA PERMITTING AND REGULATING FILMING AT WOODLAWN CEMETERY AND MAUSOLEUM WHEREAS, the city of Santa Monica has previously adopted Ordinance Number 7145 (CCS) providing regulations and fees pertaining to pictures for commercial purposes: and WHEREAS, the Director of the Department of General Services has recommended including portions of the Woodlawn Cemetery and Mausoleum as areas where permits for making pictures for commercial purposes may be issued, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Limited use of the Woodlawn Cemetery and Mausoleum shall be permitted for making pictures for commercial purposes subject to the following restrictions: A. All applicable requirements of Santa Monica City Council Resolution Number 7145 (CCS) and the Commercial Film Permit application shall be followed. B. No motorcycle activity, except police escorts shall be permitted. C. No "chase scenes" of any nature shall be permitted. D. One or more Police Officers as determined by the Chief of Police, shall be in attendance at all times while filming crews are in the Cemetery. - 1 - . . E. The costs of Cemetery equipment or personnel required for the filming or in support of the filming shall be estimated by the Permit Coordinator and that amount shall be deposited at the time the permit is issued. Additional unforeseen costs shall be invoiced at the termination of filming and unused deposit funds shall be refunded. F. Filming will be permitted only in areas of the Cemetery and Mausoleum designated by the Cemetery Superintendent. G. Filming will only be permitted in the Mausoleum on Mondays, Tuesdays, Wednesdays, and Thursdays between 4:00 pm and 12:00 midnight, except on holidays or when the succeeding day is a holiday. H. Filming will not be permitted in the Cemetery on holidays, weekends, or Fridays after 6:00 pm. I. Film applicant is required to clean and restore the permitted area to the original condition immediately after use. J. Cemetery Superintendent retains prior administrative approval over all locations, methods, scenes, and content of any filming activity in the Cemetery and Mausoleum subject to an appeal to the city Manager. K. Non-compliance with the regulations governing filming at the Cemetery and Mausoleum may result in the denial of future permits to applicants. SECTION 2. Notwithstanding any other provision of this Resolution or Santa Monica City Council Resolution Number 7145 (CCS) the schedule of fees to be charged for the issuance of - 2 - . . .. . . of a permit for the production of pictures for commercial purposes at the Woodlawn Cemetery or Mausoleum, which is City property, for each day or portion thereof are hereby established as follows: WOODLAWN CEMETERY USE FEE PER CALENDAR DAY CHARGE -- $1,200 WOODLAWN MAUSOLEUM USE FEE PER CALENDAR DAY CHARGE -- $1,200 SECTION 3.
