Resolutlon Order1ng Removal of Crane Prom
Santa Mon1ca Harbor
On February 1, 1983, pursuant to Contract Number 3872,
Healy Tlbb1tts Construct1on Company agreed to complete the
emergency demolltlon and removal of portions of the Santa
Monlca Pler superstrucTure between Bent Number 47 and Bent
Number 59 (end of pler). On March I,
1983, a 30 ton truck
crane and other equlpment owned and belng used by Healy
T1bb1ttS ln performance of the1r contract fell into the harbor
when the pler collapsed as a result of a catastrophic storm.
On
March 30,
1984,
Planet Insurance Company, the
1nsurance carrler for Healy T1bbltts,
served the Clty with a
co~plalnt seeklng to recover damages of $60,000.00 plus costs
and dlsbursements for the destructlon of the crane and other
equ1pment.
The lawsult alleges that on March 1, 1983, Healy
Tlbbitts was denled access to the crane or any other part of
the pler.
The complalnt further alleges the C1ty d1d not
not1fy Healy T1bbltts of develop1ng emergency condltions. The
Clty disputes these allegations.
It lS the City's positlon
that lt incurred no liabillty arislng from the loss of the
crane.

1983~
the contract was completed to the
extent posslble; on Aprll 5, 1983, a not1ce of completlon was
recorded.
Clty staff has requested that the C~ty Attorney take
legal actlon to cause the contractor to remove the crane.
Accordlngly,
1t 1S recommended the C1ty Caunell flnd that the
removal of the crane lS essential to protect the pUblic
health~
safety and welfare. Following the adoptlon of the
resolutlon~ If the contractor does not remove the crane wlthin
the des1gnated tlme, the C1ty Attorney's Off1ce w1l1 proceed
w1th appropr1ate legal actlon.
RECOMMENDATIO~
It 15 respectfully recommended that the accompanY1ng
r~solutlan be adopted.
