SUBJECT: Ordinance Amending 1979 Newsrack Ord~nance
At its meeting on September 1, 1981, the City Council
introduced for first reading an ordl.nance to enlarge the zone
subject to special newsrack provis~ons. The ordinance is
now presented to the City council for adopt~on.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMENDING
THE 1979 NEWS RACK ORDINANCE TO ENLARGE
THE AREA OF ZONE A
WHEREAS, Ordlnance Number 1131 (CCS) established
speclal requirements for newsracks located in a zone covering
Wllshire Boulevard and Flfth and Sixth Streets from Santa
Monica Boulevard to Wl1shire Boulevard; and
WHEREAS, Ordinance Number 1174 (CCS) enlarged the zone
to add Fourth Street from Wilshire Boulevard to Colorado
Avenue, Santa Monica Mall, Santa Monica Place, and Lincoln
Boulevard from Broadway to the Santa Monica Freeway; and
WHEREAS, the C~ty Council of the C~ty of Santa Monica
desires to enlarge the zone to add the area bounded by
Wl1shlre Boulevard on the north, Second Street on the east,
Colorado Avenue on the south, and Ocean Avenue on the west,
the area bounded by Colorado Boulevard on the north, Main
Street on the east, P1CO Boulevard on the south, and Ocean
Avenue on the west, and the area bounded by Pico Boulevard on
the north, Main Street on the east, the Clty limits on the
south, and Neilson Way and Appian Way on the west,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Ordinance Number 1131 ( CCS ) J.s hereby
amended to replace the map of Zone A wlth the map attached
hereto, enlarging Zone A to add the area bounded by WilshJ.re
Boulevard on the north, Second Street on the east, Colorado
Avenue on the south, and Ocean Avenue on the west, the area
bounded by Colorado Boulevard on the north, Main Street on
the east, P~co Boulevard on the south, and Ocean Avenue on
the west, and the area bounded by Pico Boulevard on the
north, Main Street on the east, the city lim1ts on the south,
and Ne1lson way and Appian Way on the west.
SECTION 2. Any provision of the Santa Mon~ca Municipal
Code or appendices thereto incons~stent with the provJ.s~ons
of this ordinance, to the extent of such inconsistenc~es and
no further, is hereby repealed or modified to that extent
necessary to affect the prov1sJ.ons of this ordinance.
SECTION 3. If any section, subsection, sentence,
clause, or phrase of this ordlnance is for any reason held to
be invalid or unconstitutional by a decision of any court of
competent jurisdlctlon, such declsion shall not affect the
val~dlty of the remalning portions of the ordinance. The
Clty Councl.l hereby declares that lt would have passed this
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared lnvalid or unconstitutional
without regard to whether any portlon of the ordlnance would
be subsequently declared J.nvalid or unconstitutional.

SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The Clty
Clerk shall cause the same to be publlshed once in the
offlclal newspaper within 15 days after its adoption. The
ordlnance shall become effective 30 days from its adoptlon.
