AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ESTABLISHING
FEES FOR USES OF THE PUBLIC LIBRARY,
REPEALING ORDINANCE Nu~mER 526{CCS),
AMENDING RESOLUTION NUMBER 2812 (CCS)
BY DELETING THEREFROM SECTION 5.1,
(PERTAINING TO LIBRARY FEES).
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Ord~nance Number 526(CCS), establ~shing
fees for borrow~ng privlleges by certa~n persons at the
public library, is hereby repealed.
SECTION 2.
Resolution Number 2BI2(CCS) as amended
by Resolutlons 2876, 3559, 3603 and 3734 lS hereby amended
by deletlng therefrom Sectlon 5.1, pertalnlng to the establ~sh-
ment of fees for borrow~ng prlvlleges by certa~n persons
at the publlc llbrary.
SECTION 3.
All persons who are not residents
of the C~ty of Santa Monlca except those who pay property
taxes to the C~ty of Santa Monlca, full t~me students In
schools located ~n the C~ty of Santa Monica or:attached to
the Santa Mon~ca Un~fled School Distrlct and persons who
are employed ln the City of Santa Mon~ca shall pay an annual
fee of twenty ($20) dollars for the privilege of borrowing
books and other matter from the public llbrary.

SECTION 4.
The following schedule of fines and
fees for use of the public library, establ1shed by the Library
Board, ~s hereby ratified and adopted:
A. The fine for overdue books and other
matter shall be ten ($.lO) cents per day
for adults and flve ($.05) cents per day
for chl1dren.
B. The fee for reserve post cards shall
be twenty f~ve ($.25) cents.
c. The fee for borrowing a book from
the Rental Collectlon for Popular New
Books shall be ten ($.10) cents per day.
D. The lnsurance fee for 16 mm fllm
loan shall be seventy flve ($.75) cents.
E. The fee for use of the audltorlum and
conference room by groups other than non-
proflt groups shall be flfty ($50) dollars
for use of the auditorlUffi when the Ilbrary
15 open, and one hundred ($100) dollars
for the use of the auditorium when the
library 15 closed, and twenty ($20) dollars
for the use of the conference room when the
library 15 open.
F. The surcharge on fine SllpS for overdue
mater1als not pa1d at the time of return
shall be flfty ($.50) cents for adults and

twenty five ($.25) cents for children.
SECTION 5.
Henceforth the L~brary Board shall
establish a schedule for fines and fees for library use,
except for the fee for non-res~dent borrowing privileges,
which shall be establlshed by ord~nance.
SECTION 6.
Any prov1s~ons of the Santa Monica
Mun~cipal Code, or append~ces thereto lncons~stent herew~th,
to the extent of such incons1stencies and no further, are
hereby repealed or mod~fied to that extent necessary to
effect the prov1s~ons of th~s ordinance.
SECTION 7. If any sect~on, subsection, sentence,
clause or phrase of this ordinance is for any reason held
to be invalid or unconst~tutional by a dec~sion of any court
of competent Jurisdict~on, such dec~s~on shall not affect
the valldlty of the remaining portions of the ordlnance.
The City Counc1l hereby declares that ~t would have passed
th~s ordinance and each and every sect~on, subsect10nr sentencer
clause or phrase not declared invalid or unconstltut~onal
w1thout regard to whether any portlon of the ordlnance would
be subsequently declared lnvalid or unconstitut1onal.
SECTION 8.
The Mayor shall Slgn and the City
Clerk shall attest to the passage of th~s ordlnance. The
City Clerk shall cause the same to be publlshed once In the
official newspaper wlthln fifteen (15) days after its
adoption. ThlS ordlnance shall become effectlve immediately
upon adoption pursuant to Sectlon 619(c) of the Clty
Charter of the Clty of Santa Monica.
