Ordinance Amending Santa Monica Municipal
Code Section 2946 to Change the Time to
Hold Program Review Hearings
On october l, 1985, the city Council requested that city
staff analyze whether public hearings to review the Community
Development Block Grant (ItCDBG") program could be held at a more
appropriate time and authorized the City Attorney to prepare any
necessary ordinance. On July 21, 1986, City staff completed its
review and requested that the City Attorney prepare an ordinance.
Accordingly, the accompanying ordinance has been prepared and is
presented to the City Council for its consideration.
The accompanying ordinance amends subdivision (c) of Santa
Monica Municipal Code Section 2946 to change the time of program
review hearings conducted by the City Council.
The current
deadline for a pUblic hearing is within the first three months of
each CDBG Program year; the proposed amendment would move this
deadline to on or before January 31st of each year. This new
hearing time is more advantageous because as proposed it would be
held in conjunction with the presentation and adoption of the
community Development Program funding rationale by the City
council.
In addition, it would provide for consideration of

comments from the public by the City Council at a time more
critical in the planning process, which is consistent with intent
of this section on program review.
RECOMMENDATION
It is respectfully recommended that the a cconpanying
ordinance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE
SECTION 2946 RELATING TO POLICIES AND PROCEDURES
FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 2946 of the Santa Monica Municipal is
amended to read as follows:
section 2946. program Review.
(a) The City Council shall be
provided
with
semi-annual
reports
containing the following information:
(1) A description of the
progress made on each program or activity
funded by the Community Development Block
Grant Program during the period covered by
the report, including a description of the
obj ecti ves that have been achieved, the
amount of service or assistance provided,
the location or area where service was
provided, the total number of persons
receiving service or assistance, and the

total number of low and moderate income
persons receiving service or assistance.
(2) The total amount of funds
expended for each program or activity
during the period covered by the report
including the amount expended for
administration.
(3) The total amount of any
allocated but unexpended Community
Development Block Grant Program funds, the
year the funds were allocated, and the
program or activity for which the
allocated funds remain unexpended.
(4) The total amount of
unexpended and unallocated Community
Development Block Grant Program funds.
(b) The reports required by this
section shall be made available to the
City Council as follows:
(1) On or before February l5
of each year covering the preceding July 1
through December 3l.
(2) On or before August l5
of each year cover ing the preceding
January 1 through June 30.
(e) On or before January 31st of
each year, the City Council shall hold a
public hearing for the purpose of

SECTION 3.
If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the ordinance.
The city Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
