Ordlnance Amending 1979 Newsrack Ordlnance
At lts meetlng on November g, 1982, the City Council
dlrected the City Attorney to prepare an ordinance to enlarge
the zone subJect to special newsrack provisions. In response
to thlS dlrectlon, the accompanYlng ordinance is presented for
Clty Council conslderation.
RECOMMENDATION

~ ORDINARCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMENDING
THE 1979 NEWS RACK ORDINA~CE TO ENLARGE
THE AREA OF ZONE A
WHEREAS, Ordinance Number 1131 (CCS) established special
requlrements for news racks located in a zone covering Wllshlre
Boulevard and Plfth and Sixth Streets from Santa Monica
Boulevard to Wilshire Boulevardi and
WHEREAS, Ordlnance ~u~ber 1174 (CCS) enlarged the zone
to add Fourth Street from Wllshlre Boulevard to Colorado
Avenue, Santa Monlca Mall, Santa Monlca Place, and Llncoln
Boulevard from Broadway to the Santa Monlca FreewaYi and
WHEREAS, Ordinance Nu~ber 1221 (CCS) enlarged the zone
to add the area bounded Wilshire Boulevard on the north,
Second Street on the east, Colorado Avenue on the south, and
Ocean Avenue on the west, the area bounded by Colorado
Boulevard on the north, Main Street on the east, pico
Boulevard on the south, and Ocean Avenue on the west, and the
area bounded by pico Boulevard on the north, Main Street on
the east, the city limits on the south, and Neilson Way and
Appian Way on the westi and

WHEREAS, the City Council desires to enlarge the zone to
add P1CO Boulevard between Hain Street and the east Clty
limlts,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MOKICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Ordinance Kumber 1131 (CCS) lS hereby
amended to replace the map of Zone A wlth the map attached
hereto, enlarging Zone A to add P1CO Boulevard between Maln
Street and the east Clty limlts.
SECTION 2. Any provislon of the Santa Monica Municlpal
Code or appendices thereto inconsistent with the provisions of
thlS ordlnance, to the extent of such inconsistencies and no
further, lS hereby repealed or Modlfied to that extent
necessary to affect the provisions of this ordinance.
SECTIOK 3. If any section, subsection, sentence clause,
or phrase of this ordinance lS for any reason held to be
invalid or unconstitutlonal by a decislon of any court of
competent ]urisdlction, such declsion shall not affect the
valldity of the remaining portions of the ordinance. The City
Council hereby declares that it would have passed thls
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared invalld or unconstitutlonal
without regard to whether any portion of the ordinance would
be subsequently declared invalld or unconstitutional.

SECTION 4. The Mayor shall Slgn and the Clty Clerk
shall attest to the passage of thlS ordinance. The City Clerk
shall cause the same to be publlshed once in the official
newspaper wlthin 15 days after its adoptlon. The ordinance
shall become effective 30 days from ltS adoptlon.
