SUBJECT: Dog LIcense Fees and WaIver of Fees For purchasing
Animals from Animal Control Center for SenIor CItizens.
ThlS report transmIts two documents.
First, a proposed
ordInance for introduction amendIng Section 4116 of the Santa
Monica MuniCIpal Code to provide for the establishment by
resolutIon of annual dog license fees.
Second, a resolution
amendIng Resolution Number 5190 (CCS) to prOVIde that InItIal
vaccInation and placement fees for an~mals acquired from the
AnImal Control Center be waived for any senIor CItIzen purchasing
a neutered male or spayed female animal from the shelter.
These documents are responsive to the dIrectIon of the CIty
Council at its meetIng of July 28, 19B1, that purchase and
lIcense fees be waIved for Senior CItIzens with respect to
neutered or spayed dogs and cats. After the proposed ordInance
becomes effectIve to authorIze establlshment of license fees by
resolutIon, a resolutIon WIll be presented to adopt speCIfied
fees and to waIve the fees with respect to neutered or spayed
dogs owned by senIor CItizens.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING
SECTION 4116 OF THE SANTA MONICA
MUNICIPAL CODE TO PROVIDE THAT LICENSE
FEES FOR DOGS SHALL HEREAFTER BE
ESTABLISHED BY RESOLUTION
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:
SECTION 1. Section 4116 of the Santa MonIca MunIcipal Code
is amended to read as follows:
SectIon 4116. Dogs. LIcensIng. Every
person who harbors a dog wIthin the CIty
shall
pay
to
the CIty Clerk, LIcense
DIvisIon, an annual lIcense tax In an amount
to be establIshed by resolution of the City
CouncIl.
The Clerk shall from time to time
deliver to the person makIng such payment a
lIcense
which
shall
descrIbe the dog,
together with a seal or metallIC plate havIng
thereon the number of such lIcense, and
figures IndIcatIng the year for which the
license has been paid, provided the person
making the payment has filed wIth the Clerk a
certificate
IndIcating the dog has been

vaccinated In accordance with thIS Chapter
and state law: otherWIse a receIpt for
payment shall be lssued. Duplicates shall be
issued for lost tags for One Dollar and FIfty
Cents ($1.50) upon the fIling of proof of
such loss. Such metallic tags shall be
attached to a collar or harness and such
collar or harness wIth the attached tag shall
be kept on such dog at all tImes, excepting
as In the Code otherWIse prOVIded.
The license fee hereIn mentioned shall
be due and payable on the 2nd day of January
each year and shall expIre on the 31st day of
December next ensUIng. Where a dog is
acquIred after the 2nd day of January, the
lIcense fee thereon shall be due on the date
of acquisItIon of such dog fo~ such calendar
year and thereafter on the 2nd day of January
of each succeeding year.
In the event that any person shall fail,
neglect or refuse to pay the requIred license
tax before the 1st day of AprIl of each year,
a penalty WIll be assessed, In addItIon to
the prescribed license fee, In the amount of
$5.00 for every neutered male or spayed
female dog and $10.00 for every unneutered
male or unspayed female dog.

The provisIons of thIs section shall not
apply to any dog not more than SIX (6) months
of age.

SECTION 3. If any section, subsectlon, sentence, clause,
or phrase of thIS ordInance is for any reason held to be Invalid
or unconst~tutlonal by a declsion of any court of any competent
jurlsdiction, such dec~slon shall not affect the valIdIty of the
remaIning portions of the ordInance. The City CouncIl hereby
declares that it would have passed thIS ordInance and each and
every sect~on, subsectlon, sentence, clause or phrase not
declared invalid or unconstitutional wlthout regard to whether
any portlon of the ord~nance would be subsequently declared
invalId or unconstltutional.

SECTION 4. The Mayor shall sign and the C1ty Clerk shall
attest to the passage of thlS ordlnance. ThlS CIty Clerk shall
cause the same to be publlshed once In the offIcIal newspaper
Wlthln fifteen (15) days after Its adoptIon. The ordinance shall
become effective after thlrty (30) days from lts adoption.
