The reason for urgency 15 to allow the Llcenslng Department to issue renewal llcenses on ,July 1. Staff proposes to replace the "20D-hour massage school" requlrement for a masseur's permlt, Sectlon 62004(a), with a quallfYlng test to be conducted by the County Health Department. 'tasseurs holdlng current permlts would be glven six (6) months to pass the test. Operators would be qlven three (3) months to complete constructlon of regu1red facllltles. In addltlon, the grounds for denial of per~lts presently set forth at Sub- para9raphs (1) and (2) of Sectlon 62003 have been amended to conform wlth appllcable orOV1Slons of the Govern~ent Code. BACKGROUND As a cond1tlon of llcenslng, the Clty's Massage Parlor Licens~ng La~ requlres operators and masseurs to obtalD police permits SUbJect to spec1fled condlt1ons. Pursuant to Sectlon 62004, 8'CftJ ',sut 2 li ,~--t~ e e a masseur's permlt wlll not be lssued unless the appllcant has a dlploma from an accred1ted massaqe school requ1r1ng a least 200 hours of tralnlng. It is a ~lsdemeanor for a massage parlor to errploy a Plasseur ''II'ho does not have a permit. The requlrements for receint of an operator's permlt are set forth at Sect10n 62002, and Sectlon 62005 provldes strlet operat1ng procedures for licensed parlors, IncludIng the follow1ng: a) No person under 18 years of age ~ay be allowed on the Dremlses wlthout the consent of a parent or guardlan: b) Per~lts must be posted: c) L1ght1ng and ventllatlon lS requ1red to con- form to the Santa ~onlca BU1ldlng Code; d) TOllet and other faclllties must conform to speclfled standards: e) Operat1on 15 prohiblted between the hours of 12:00 ~ldnlqht and 8:00 A.~. A prel1mlnary 1n]Unct1on against the enforcement of this law was lssued by Judge Jerry Pacht on several grounds, the most slgn1f1cant be1ng that the law does not afford eX1stlng permltees adequate time to comply with the educat10nal requlre- ments. The state enabl1ng law, Government Code Sectlon 51030, et 3eg., and a recent Court of Appeal decis1on, Br1X v. C~~y of San Rafael, 92 Cal. App. 3d 47, 154 Cal. Rptr. 647 (1979), d1ctate the valldlty of the substant1ve provislons of the Massage Parlor Llcenslng Law. Sect10n 51031 of the Government Code prov1des that cit1es may speclfy reasonable standards as a condltlon of obtalnlng a llcense to operate a massaqe parlor -2- e e lncludlng, but not Ilmlted to, requlrements concernlng age, educatlon, eXperlence, sanltary conditlons and hours of operation. Accord, Brix, Supra (hours, educatlon, standards for dress and conduct of ~asseurs.) Thus, the only bar to the dlssolutlon of the lnjunctlon and enforc~ent of the ordlnance lS the lack of a "grand- father clause" that would per~lt eXlstlng permlttees to comply w1th lts requlrements. Cltv staff and attorneys recently met wlth attornevs for plalntiff massage parlors. The followlng concensus was reached as to the falr scope of requlatlon over these buslnesses: 1. As lndlcated above, the law lS valld. 2. The ZOO-hour ~assage school requirenent 1S valld, but 15 not as effectlve as the competency test used In Los Angeles, and creates the addltlona1 law enforcement problem of pollclng massage parlor schools. 3. EXlstlng perMlttees should, as a matter of due pro- cess, be afforded a falr opportunlty to meet new com- petency reqll~rements and to conform facilltles to the requlrements of the law. The SlX month period used by Los Anqeles to allow eXlsting holders of masseur's per81ts to pass the competency examlnatlon was agreed to be falr, as was a 90 day perlod for constructlon of requlred facllltles, plumblnq lnstallat1on, etc. 4. In order to facilltate enforcement of the ordinance, new and renewable pollee permlts, WhlCh are a prerequ151te to llcenslng, may be addltlonally condltloned as follows: -3- e e a. Masseur's permlts are valld only for a speclflc locatl.on. b. ~aS5eurs must wear photo ldentl.flcatlon cards when "lOrklng. c. Operators must leave thelr front door and cublcle doors unlocked durl~g all hours of oneratlon. 5. Repeated vlolatlons of permlt conditlons would sub- Ject the offender to permit and license sllspenslon or revocatlon procedures. 6. Rellance on enforcement of le~u conduct laws as a means of controlllng prostitution In massage parlors is extremely dublOUS In light of the recent Supreme Court decislon ln People v. Pryo~, 25 Ca1. 3d 328, 158 Cal. Rptr. 330 (1979), WhlCh held that consensual acts ln prlvate places do not violate Penal Code Sectlon 647 {a). 7. State and Federal agencles should be responsl.ble for enforclng Labor Code and Immlgration vlolatlons. 8. If the regulatory scheme outllned above were put l.n effect, the pendlng lawsults would be dls~lssed by st1pulrttion. The C1ty 1ssues revewal llcenses for bUslnesses l.ncludlng the operatlon of massaqe narlors on July 1 of each year. If the proposed ord1nance replaclng the "massage school" requl.re- ment wlth a competency test lS adopted, and a grandfather clause 18 approved, the la\,rSUlts w1ll be dl.Sffilssed. To be effectlve at the co~encement of the flscal year, the proposed e~ergency ordinance Must be adopted at the June 24 CO'.lllCll ~1eetlng by five affirroatlve votes. ANALYSIS Sectlon 1 deletes the deflnitlon of "recognlzed school" contalned at Sectlon 62000(9) Slnce, unless the Councll should dec1de to retaln the present requlrement of a dlploma from such a school as an alternatlve to the COMpetency examlnat10n (see Alternatlve Solutlons), th1S deflnition 1S not relevant under the proposed ordlnance. Bectlon 2 a~ends Section 62003 to delete the prov1sions contalned at subparagraphs (1) and (2) of that section ~hlCh provlde for the denlal of a per~lt upon a flndlng that any person lnvolved ln the operatlon has been convlcted of a "crlme lnvolvlng moral turpltude" or has a "bad moral character." These provislons would appear to be lmperm1sslbly vague and afford the Chlef of Pollce overbroad dlscretlon to deny a permlt. See generally, Perrlne v. ~unlclpal Court, 5 Cal. 3d -- - - ----:.. '--' 656, 662 97 Cal. Rptr. 320, 322-23 (1971). This sectlon has therefore been aMended to lncorporate the language of Section 51032 of the Government Code, ~hlCh exnressly perm1ts a Clty to refuse -5- ~ e e to llcense a massage parlor where any person lnvolved in lts operat~on has been convicted under speclfled prov~s~ons of the Penal Code or convlcted of a felony offense lnvolving the sale of controlled substances as specifled In the Health and Safety Code. Section 3 amends Sect10n 62004 WhlCh sets forth the requirements for obta1ning a masseur's permlt. The requlrement that an applicant have obtalned a d1ploma from a recognlzed massage school 1S replaced by the requirement that such an a~plicantT 90 days prior to flllng an appllcation for a perrn1t, must take and pass an exam1natlon, testlng both pract~cal competence and didactlc knowledge, to be admlnlstered by the Pollce Department or, at 1ts dele- gat1on, the County Health Department. The exam1natlon requlrement and the deta1ls of lts admlnlstration are taken from the Los Angeles llcens1ng ordinance. (A coPY of the contract under which the Clty of Los Angeles employs the County to adm~n~ster the exaMlnatlon 18 attached as an exhlb~t hereto.) In add~tlon, the Chlef of Pol~ce is authorized to place conditlons on the 1ssuance of a masseur's perm1t, ~ncludlng the requ1rement that the masseur operate at a flxed locatlon, that he or she wear a photo ~dent~f1catlon card when worklng, and that the door of cublcles 1n WhlCh massaqe 15 belng admlnlstered remaln unlocked at all t1mes. -6- e e Flnally, the fee for processing an applleatlon for a masseur's permlt has been lncreased from $5.00 to $10.00 to be cons~stent wlth the processing fee for renewal permits. Section 4 amends Sectlon 62009 concern~ng the duratlon of permlts to provlde that renewal permits may be denied and existing permits suspended or revoked for repeated violations of the permlt requirements. Bectlon 5 amends Seetlon 62010 to include a "grandfather clause" governlng eXlstlng permlttees. It provides that operator permlts shall continue ln effect and be regularly renewed I and existlng holders of a masseur's permit shall be deemed to have a condltlonal perm2t satisfying the requirements of th2S ordinance, pendlng compllance wlth the fol1owlng schedule: Holders of current masseur's perm2ts shall have SlX (6) months from the effective date of the Ordlnancel speclf2ed as July 11 1980, to obtain a new permit condltloned upon their passlng the competency examlnatlon described 2n subparagraph (6) of Section 62004. Holders of an eXlsting operator's Dermlt shall have nlnety (90) days from the effectlve date of the Ordlnance to comply w2th the requlre- ments for tal let and other facillties set forth ln Sectlon 62005. Sectlons 6, 7 and B are standard provlsions governlng in- cons2stenciesl severabllity and the mechanlcs of passage of the Ordlnance. -7- e e ALTERNATIVE SOLU~IONS The Councll may wlsh to retain the llmassage schoolll requlre~ent presently set forth In Seetlon 62004(4) (a) as an alternatlve to the proposed COMpetency examlnatlon. This re- qUlrement 15 valld, provlded only that existing permittees are given adequate tlffie to co~ply therewlth. Operators of approved massage schools have stated that requirlng completlon of a full curr1culurn by a prospectlve masseur 1S more 11kely to promote the beneflclal aspects of massage therapy than a competency test, and that passlng the test does not adequately lnsure ~he skllled practlce of Massage. On the other hand, the retentlon of the education requlrement could create an addltlonal problem for the pollce Depart~ent ln enforclng posslble abuses by massage schools. RECOM-MENDATION It lS respectfully recoNmended that the attached emer- gency ordlnance he approved and the regular ordlnance intro- duced for flrst readlng and publlC hearlng ln lts present form. Staff has no Ob]ectlon to the educatlon requlrement as ? ." an addltlonal alternatlve to the competency test. I I I I This agreement is maci.e and entered into by and between the City of Los Angeles, a municipa.l corporatlon, and the County of Los Angeles. a political subdivision of the State of California. WITNESSETH WHEREAS. the Ci~y of Los Angeles enacted Ordlnance No. 148154 for the regulation of Massage Technicians operating withln the City limits; and WHEREAS, such ordinance provides that certain examinations may be conducted by the County Department of Health Services prior to the issuance of a permit by the Board. and WHEREAS, pursuant to the provisions of Section 480 et seq. of the Health and Safety Code, the City of Los Angeles and the County of Los Angeles may enter into a contract for the County of Los Angeles to provIde these services to the City of Los Angele S i NOW, THEREFORE, the partit';s hereby agree that the County Depart~'T.ent of Health Services shall prepare, give, and judge the examinations as designated under Clty Ordmance No. 148 L 54. Article 1 - Performance by County Depart~ent of ,Health Services 1. Upon notificatLon from the City Clerk of a new application for a Massage Techmcian PermIt within the City of Los Angeles. the County Department of Health Services shall prepare and conduct an examinatlon to fairly determine the ability of the applicant to properly perform the work which the applicant would be authorized to do by the permit apphed for. and shall cover the followlng . ,:,ubJects, anatomy, physiology. hygiene, and the practice and theory of massage e - z - e as massage 1S def1ned 1n the ordinance. 2. The County Department of Health Services shall conduct such exami- nations on a continuing bas1s. as needed, at least once each month. 3. The County Department of Health Service s shall notify the City Clerk as to the results of these exa.minations. Article 2 - _Performance by City of Los Angeles 1. The City shall make prompt notifications to the County Department of Health Services upon filing of any applicatlon for a new Massage Technician permit within the City of Los Angeles. Article 3 - County Department of Health Servlces' Fee and Payment _'l}1~reof 1. A fee for the examination of a new permittee application contemplated by this contract shall be charged by the County Department of Health Services at the rate of $74.40 for each permittee application. This fee includes the cost of all notifications required under th~s agreement. The Auditor-Controller of the County of Los Angeles shall by not later than Apnl First of each fiscal year transmit the projected fee scheduled for the next fiscal year to the City Council of the CIty of Los Angeles. Unless the CIty Council of the CIty of Los Angeles exercises its right to cancel thi 5 agreement pursuant to the provisions contained hereInafter, the projected fee schedule shall be applicable for the ensuing fiscal year. Z. Payment by the City shall be quarterly upon presentation by the CO~"'1ty of an invo1ce in triphcate for all examinations given during the preVIOUS quarter. Such invoices shall be approved by an authorized representative of the City Clerk and processed for yaytnent not later than twenty (20) days subsequent to pre sentation. e - 3 . e Article 4, - Pursuant to SectIon 895.4. That neither City nor any officer or employee thereof shall be responsible for any damage or !lability occurring by reason of anythlng done or omitted to be done by County under this agreement. It is also understood and agreed that the County shall fully indem.nify. defend and hold the City. its officers and employees. harmless !:rom any liability imposed for injury occurring by reason of anythmg done or omltted to be dene by County or any officer or employee thereof under or in connection with any authority of jurudiction delegated to the County pur suant to this agreement. 2. That neither County nor any officer or employee thereof shall be responsible for any damage or liability occurrlng by reason of anything done or omitted to be done by City under or in connection with the performance of duties required by the City under thiS agreement. It is also understood and agreed that the City shall fully indemnify, defend and hold the County, its officers and employees, harmless trom any liability imposed for injury occurrmg by reason of anything done or omitted to be done by City or any officer or employee thereof under or in connection with any authority or jurisdiction delegated by the City under this agreement. Article 5 - ,Te rm of Agreement 1. The effechve date of thl s agreement shall be fron~ the date of execution, and this agreement shall remain in effect henceforth until or unless terminated by either party, which may be accomphshed by rendering sixty (60) days notice set forth In wnting. 2. This agreement may be amended by writing, setting forth the contero- plated changes and effective dates thereof.
