Sect~on 62011 of the Santa Monlca Munlcipa1 Code is hereby amended to add the followlng subsectlon C: C. Any other provlslons of this Chapter notwlthstandlng, appllcants for a masseur's permlt under Sectlon 62005 who can deillonstrate to the Chlef that they comply w~th one or more of the fo11owlng condltlons shall be exempt fro~ the examinatlon requlrernent set forth at subsect~on D of that sect~on. Noth~ng herein shall be construed to exempt any person from any other requlrement of thlS Chapter lncludlng those set forth at Sectlon 62005 thereof. 1. Sald appllcant has withln the preced~ng 12 month perlod been granted a massage techniclan's pernlt by the City of Los Angeles. 2. Sald appllcant has successfully completed the prescribed course of study at a school of massage approved by the State Superln- tendent of Pub11C Instructlon pursuant to Educatlon Code Sectlon 94311(d) and revlewed by the Superlntendent wlthln the precedlng 12 month period. Any person who, as a result of an exemption pursuant to this subsectlon, does not take the competency examinatlon shall be eDtitled to a refund as set forth in Section 62012B(1} of this Chapter. -2- e e SECTION 2. Chapter 12 of Artlcle VI of the Sa~ta Monlca MUDlelpal Code 15 hereby a~ended to add the follow1ng new seetlon: SeetlOD 62013: Varlanee Procedure Any other provlslons of thlS Chapter notwlth- standlng, the ope~ator of a massage parlor, or a person applYlng for an operator's permlt pursuant to Seetlon 62002 of thlS Chapter, may flle wlth the Chlef a request for a varlanee to be rel1eved from the requlrements set forth at Sect10n 62006H of this Chapter. The Chlef may grant such a request only If he lS satlsf1ed that all of the follow1ng condlt1ons are met: A. Although wlthln the statutory deflnlt10n of a massage parlor (Sectlon 62000D), the operator's premlses are devoted prlmarlly to the conduct of a business other than that of massage; and B. The operator would suffer unusual hardship lf forced to co~ply with the requlrements set forth at Section 62006H of thlS Chapter= and C. The bathing and tOllet faclllties provlded by the operator in lleu of those requ1red by Bectlon 62002H comply wlth appllcable requlre- ments of state and local law and are adequate to protect the publlC health, safety, and welfare. -3- e e The declslon of the Chlef to grant or to deny a request for a variance shall be flnal. However, nothlng ~ereln shall be construed to detract from the rlght of an appllcant for an operator's perrnlt to appeal a declslon of the Chlef wlth respect to the denlal or condltlonal approval of such a permlt pursuant to Sectlon 62003C of thlS Chapter. SECTION 3. ThlS ordinance lS declared to be an emergency measure adopted pursuant to the provlslons of Sectlon 615 of the Santa Manlca Clty Charter and lS necessary for preservlng the publlC peace, health, and safety, and the urgengy for ltS adoptlon as set forth in the flndlngs above. SECTION 4. Any provlslon of the Santa Monica Munlclpal Code or appendlces thereto lnconslstent herewlth, to the extent of such lnconslstencles and no further, are hereby repealed or modlfled to that extent necessary to effect the provlslons of thlS ordlnance. SECTION 5. If any provlslon of this ordlnance is held to be unconstltutlonal by any court of competent ]urlsdlctlon, lt is the intent of the Clty Counell that such port1on of such ordlnance be severable from the remalnder and that the remalnder be given full force and effect. SECTION 6. The Mayor shall slgn and the Clty Clerk shall attest to the passage of thlS ordlnance. The City Clerk shall cause the same to be publlshed once In the offlclal newspaper wlthln 15 days after lts adoption. The ordlnance shall become effectlve from and after ltS adoptlon.
