SUBJECT: Ordinance Amending 1979 Newsrack Ordinance
At l.ts meet1ng on December 14, 1982, the City Council
introduced for first readl.ng an ordinance to enlarge the zone
subJect to spec1al newsrack provisions. The ordinance is now
presented to the Clty Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for f1rst reading.

OF THE CITY OF SANTA MONICA ~lENDING
THE 1979 REWSRACK ORDINANCE TO ENLARGE
THE AREA OF ZONE A
WHEREAS, Ordl.nance Number 1131 (CCS) establlshed speclal
requirements for news racks located in a zone coverl.ng Wilshire
Boulevard and Fl.fth and Sixth Streets from Santa Monica
Boulevard to Wilshire Boulevard~ and
WHEREAS, Ordinance Nunber 1174 (CCS) enlarged the zone
to add Fourth Street from Wilshl.re Boulevard to Colorado
Avenue, Santa Monica Mall, Santa Monica Place, and Lincoln
Boulevard from Broadway to the Santa Monica Freeway~ and
WHEREAS, Ordinance Number 1221 (CCS) enlarged the zone
to add the area bounded Wilshire Boulevard on the north,
Second Street on the east, Colorado Avenue on the south, and
Ocean Avenue on the west, the area bounded by Colorado
Boulevard on the north, Main Street on the east, pica
Boulevard on the south, and Ocean Avenue on the west, and the
area bounded by pica Boulevard on the north, ~1ain Street on
the east, the city limits on the south, and Neilson Way and
Appian Way on the west; and

WHEREAS, the Cl.ty Council desires to enlarge the zone to
add Pico Boulevard between Main Street and the east city
limits,
NON, THEREFORE, THE CITY COUNCIL OF T~E CITY OF SANTA
MO~ICA DOES ORDAIN AS FOLLOWS:
SECTIO~ 1. Ordinance Number 1131 (CCS) is hereby
amended to replace the map of Zone A with the map attached
hereto, enlarging Zone A to add pi co Boulevard between Main
Street and the east city limits.
SECTION 2. Any provision of the Santa Monica Municipal
Code or appendices thereto lnconsistent with the provlsions of
this ordinance, to the extent of such inconsistencies and no
further, is hereby repealed or modified to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. If any section, subsection, sentence clause,
or phrase of this ordinance is for any reason held to be
lnvalid or unconstitutional by a decision of any court of
competent jur1.sd1.ction, such decision shall not affect the
valldity of the remainlng portions of the ordinance. The City
Council hereby declares that l.t would have passed this
ordl.nance and each and every section, subsectlon, sentence,
clause, or phrase not declared l.nvalid or unconstltutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.

SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of thl.S ordinance. The City Clerk
shall cause the same to be published once in the official
newspaper withln 15 days after its adoption. The ordinance
shall beco~e effective 30 days from its adoption.
