Ordinance Increasing Non-Resident Fee for
Ll.brary Cards
At its meeting on July 26, 1983, the City Councl1
Clrected the City Attorney to prepare an ordinance lncreasing
the fee for non-residents who acquire a Library Card. In
response to thl.S direction, the accompanying ordinance has
been prepared and is presented for City Council consideration.
The ordinance increases the non-resident library fee from
$20.00 to $25.00.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF Sk~TA MONICA ESTABLISHING
NON-RESIDENT LIBRARY FEES
THE CITY COUNCIL OF THE CITY OF S&~TA MONICA DOES ORDAIN
AS FOLLOWS:
SECTION 1.
All persons who are not resldents of the
Cl ty of Santa Monica except those who pay property taxes to
the C1ty of Santa r1onlca, full time students ln schools
located 1n the City of Santa Monica or attached to the Santa
Monica Un1f1ed School Distr1ct and persons who are ewoloyed In
the City of Santa Monica shall pay an annual fee of
Twenty-five ($25.00) dollars for the prlvllege of borrow1ng
books and other matter froM the public 11brary.
SECTION 2.
Sectlon 3 of Ord1nance NUMber 1098 (CCs) is
hereby repealed.
SECTION 3.
Any prov1s1on of the Santa Mon1ca Mun1c1pal
Code or append1ces thereto 1nconsistent w1th the provisions of
th1S ordinance, to the extent of such inconsistencies and no
further, 1S hereby repealed or moolfled to that extent
necessary to affect the prov1s1ons of this ordinance.
SECTION 4.
If any section, subsection, sentence,
clause, or phrase of this ordlnance is for any reason held to

be ~nval~d or unconstitut~onal by a dec~sion of any court of
competent Jur~sd~ction, such decision shall not affect the
valid~ty of the rema~n~ng portlons of the ordinance.
The C~ty
Council hereby declares that lt would have passed this
ordlnance and each and every sect~on, subsection, sentence,
clause, or phrase not declared invalld or unconstl tut~onal
wi thout regard to whether any portion of the ordinance would
be subsequently declared lnvalid or unconst~tut~onal.
SECTION 5.
The r.1ayor shall sign and the City Clerk
shall attest to the passage of th~s ordinance. The City Clerk
shall cause the same to be pUblished once in the offlclal
newspaper within 15 days after its adoption.
The ordinance
shall become effectlve 30 days from lts adoption.
