Every pe r so n who harbors a dog wIthIn the CIty shall pay to the CIty Clerk, LIcense DIvISIon, an annual lIcense tax In an amount to be establIshed by resolutIon of the CIty Council. The Clerk shall from tIme to time delI'ler to the person makIng such payment a license WhICh shall descrIbe the dog, together WIth a seal or metallic plate haVIng thereon the number of such lIcense, and figures IndIcatIng the year for whIch the license has been paid, provIded the person ma kIng the payment has filed WIth the Clerk a certIfIcate indJ.ca t~ng the dog has been 1 . e . vaccinated in accordance wIth this Chapter and state law; otherwise a receipt for payment shall be lsslled. Dupllcates shall be issued for lost tags for One Dollar and FIfty Cents ($1.50) upon the flllng of proof of such loss. Such metalllc tags shall be attached to a collar or harness and such collar or harness wlth the attached tag shall be kept on such dog at all tlmes, exceptlng as 10 the Code otherWlse prov1ded. In the event that any person shall fall, neglect or refuse to pay the required llcense tax before the 1st day of Apr11 of each year, a penal ty will be assessed, in addltion to the prescribed llcense fee, in the amount of $5.00 for every neutered male or spayed female dog and $10.00 for every unneutered male or llnspayed female dog. 2 -- ~ ~~~- - - - - - . . e . - . The provIsions of this section shall not apply to any dog not more than six ( 6 ) months of age. SECTION 2. Any proVISIon of the Santa MonIca Municipal Code or appendIces thereto inconSIstent wIth any provISIon of thIS ordinance, to the extent of such inconSIstencies and no further, are hereby repealed or modifIed to that extent necessary to affect the provISIons of thIS ordlnance. SECTION 3. If any section, subsection, sentence, clause, or phrase of thIS ordinance IS for any reason held to be invalId or unconstItutIonal by a decIsIon of any court of any competent JurISdIctIon, such deCISIon shall ~ot affect the valIdity ~f t~e reTLalnlng portIons of the ordInance. The CIty Council hereby declares that it would have passed thIS ordInance and each and every section, subsectIon, sentence, clause or phrase not declared invalid or unconstItutional without reg a r d to whetner any portIon of the ordInance would be subsequently declared InvalId or unconstItutIonal. 3 . e . -. SECTION 4. The Mayor shall sIgn and the CIty Clerk shall at tes t to the passage of th~s ordInance. ThIS CIty Clerk shall cause the same to be publ~shed once in the off~clal newspaper wIthin fIfteen ( 15) days after Its adoptIon.
