SUBJECT:
Liquor License Application for The Perfect Setting,
2719 Main Street, Santa Monica, Callfornia
Introduction
This report presents information regarding a liquor license
application for The Perfect setting, 2719 Ma~n Street, Santa
Mon1ca, and recommends that the City maintain oppositlon to
unrestricted liquor license appl~cations for the Main Street
area.
Background
On April 22, 1982, Mlndy Isaacs Odegard, President of The Perfect
Setting,
Inc., made application to the California Department of
Alcoholic Beverage Control to obtain an Off-Sale Beer and Wine
license. Applications for new licenses are routinely referred to
the City for comment.
The City has taken a positlon to oppose any license applications
1n the Main Street area.
Accordingly, the Dlrector of Plannlng

forwarded a letter of oPPosltion upon notification of The Perfect
Setting's application. (see attached)
The matter was brought before Council on May 25 (eontlnued to
June 1) for discuss1on. It was further referred to Staff for
addit~onal information.

Discussion
It is the applicant's intent to sell glft baskets of flowers w1th
a wine bottle included.
The ABC lS the sole authority to grant/deny liquor license
permits and takes comments from the City (or other party) under
advisement. According to an offic1al at the Department of
Alcoholic Beverage Control, if the City wishes to withdraw lts
oppositlon with very speclfie conditions, the ABC will discuss
the matter with the appl1cant and take the Clty'S comments lnto
consideration when taking action.
If the license is issued, there is the possib1lity of transfer of
the license at a future date. If issued unconditionally, there
is little chance of preventing transfer later. Transfer of an
uncondltional 11quor license may not be in the best interest of
the Clty and the adJacent ne~ghborhood.
Staff is not opposed to The Perfect setting's particular proposed
use, i.e. sale of glft baskets with a bottle of wine lncluded.
However, withdrawal of opposltion to an unrestricted liquor
l1cense application In the Main street area is not conslstent
with the City's overall policy to reduce no~se, related police
problems, and undue concentration.

Recommendation
It is recommended that Counc~l 1) maintain its opposition to the
issuing of an unrestricted Off-Sale Beer and Wine License at The
Perfect Setting, and 2) authorlze Staff to communicate to the
Department of AlcohollC Beverage Control that we would support
the issuance of a license if the following condition is imposed:
Sale of alcoholic beverages will be limited to the sale of
bottled w~ne that is contained in a gift basket or similar
merchand1se.
If no restrictlons are lmposed, the license should not be issued.
