Request for W~thdrawal of Llquor Llcense Protest,
Super SUShl, 2917 Main Street, CM2.
Introduction
This report transm~ts additlonal lnformatlon regardlng control of
restaurants and bars on Ma~n Street ln general and the establishment
of Super Sushi in partlcular. ThlS informatlon was requested by the
Clty Counell on August 10, 1982 in connection wlth Agenda Item IlB.
Background
On October 10, 1980 the Clty Councll adopted Ordinance No. 1179{CCS)
establishlng the CM Ma~n Street Speclal Commerclal Distrlct which in
essence reduced the Main Street Plan to ordlnance form. A key part
of this ord~nance was to llffilt the number of restaurants and bars
on Maln Street. To this end - Speclal Restrlctions Sections 9119B4d
and e were enacted as follows:
Restaurants are Ilmlted to two restaurants per block {a block
being both sldes of Maln Street and the adJacent sldes of
adJOlning side streets} * Portlons of Maln Street to be
designated "blocks" for the purpose of this section are:
Block 1: South City llmits to Marine Street~ Block 2: Marine
Street to pier Street: Block 3: Pier to Ashland: Block 4: Ashland
to Hlll; Block 5: Hill to Ocean Park~ Block 6: Ocean Park to
Hollister; Block 7: Holllster to Strand; Block 8: Strand to
PaciflC; Block 9: Pacific to Blcknell; Block 10: Blcknell to
Bay; Block 11: Bay to Plea.

Restaurants with more than 50 seats, restaurants wlth a
substantlal take-out buslness, and any second-floor restaurant
use wlll requlre a Conditional Use Perrn1t.
(Restaurants are
defined as establlshments serving a var~ety of unpackaged foods
prepared on site for consumption.)
Bars may not exceed seven in number south of Ocean Park
Boulevard nor five ln number north of Ocean Park Boulevard.
No bars shall be located on any Maln Street corners.
(For
purposes of th~s sect~on, bars are def~ned as establishments
wlth "public premises" l~quor licenses and restaurants with a
l~quor servlng facllity that is physically separate from the
dining area and 1S regularly operated durlng hours not
correspond1ng to food service hours.)
Condltlonal Use Permits
are requ~red for all bars.
The intent of these sections is clear and unmistakable, not more than
2 restaurants per block, only 7 bars south of Ocean Park Boulevard
and up to 5 north of Ocean Park Boulevard. However, the Ord~nance
also lncluded Sect~on 9ll9C9 reading as follows:
l~pplicab1l~tYI Effectiveness. Notwithstanding specific references
conta1ned herein, the provislons of this ordinance are not meant
to apply to:
"a. Current uses, regardless of. changes of ownership, unless the
eXlstlng use lS intens~fied by a floor area addition of more
than 15% or by other substantial intensiflcatlon~ such as
the introductlon of regularly scheduled entertalnment, except
that there may be no more than an incldental lncrease in the
surface area floor space of bars and restaurants; nor

lib. Changes in use which result In a use permltted under
Sect~on 9119B2 that 15 less intense than the current use.
"Exi5t~ng uses s~all co~nt !o~ard the total number of bars and
restaurants permltted withln the Distrlct.
"A current use shall be considered no longer existent if that
use is voluntarl1y changed or lS abandoned for a perlod of
one year."
Since the enactment of this ordinance only one new restaurant has
been approved on Main Street, a barbecue restaurant at 3105 Nain
Street, between Marlne and the city 1imlts, in a designated block
wlth no existlng restaurants.
There are presently 11 bars south of Ocean Park Boulevard, 4 more
than permltted under the Main Street Zonlng.
Papa Loule's and Super SUShl
These two restaurants replaced two separate restaurants previously
operating as Cafe Californla at 2917 Maln Street and Cafe Cabaret
at 2911 Main Street. Each had a separate kltchen although they
shared ownership and apparently a patio entry. Cafe Californla was
first and Cafe Cabaret added later but had to be a separate
operatlon because they were located in an unreinforced masonry
structure and the Building Code prohibits anyone restaurant wlth
more than 49 seats In an unrelnforced bUllding. After the fallure
of Cafe Callfornia and Cafe Cabaret inqulries were made regarding
two new restaurants and a physical lnspection of the propertles

lndicated the eX1stence of two separate restaurants w1th two
separate k1tchens and 1ntervenlng stores ln between. On this basis
permits for remode11ng were lssued to Papa Loule's and Super Sushl.
All applicants were informed of the City Counell's dlrectlve and
POllCY of opposing liquor llcense applicatlons on Main Street and
when notices of such appllcatlons were received letters of
oPPosltion were duly sent in each case.
Papa Louie's was the first to approach the Counc11 for reSC1SS1on
of its opposition and on the bas1s of information presented,
particularly that Super Sush1 had a llcense, the opPosltion was
wlthdrawn. When Super SUShl subsequently filed a similar request
the lssue of compllance wlth the ~41n Street plan was ralsed
part1cularly the questlon as to the attritlon of eXlsting bars and
restaurants.
Subsequent 1Dvestlgatlon has revealed that Cafe Californla and
Cafe Cabaret both operated on the same liquor license ln that ABC
considered them part of the same premises and further, that of the
two, Cafe Californla at 2917 was the "prlme" wh1le Cafe Cabaret at
2911 Maln Street was the "Spln-off". In the eyes of the ABC
2917 Ma1n Street as the origlnal address llcensee has greater
priority and a better c1a1m to a llcense than 2911 Main Street.
Alternatives
1. Deny the request and leave the letter of protest ln place.
Th1S would probably not prevent the ABC from lssu1ng the
l1cense but could cause some delay and posslbi1e economlC
hardsh1p on the operators.

2. Grant the request and withdraw the letter of protest. This
would work the least delay and econOilllC hardshlp on the
applicants but could be perceived as a weakenlng of the
Council's policy protesting llquor llcenses on Maln Street.
Nelther action would result in decreaslng the number of
restaurants on Main Street or assure reductlon in the
number of such establlshments.
Recommendat1on
It lS respectfully recommended that the Clty Council dlrect wlthdrawal
of the letter of protest and defer further action ln regard to llquor
licenses pendlng completion of studles currently being undertaken by
the City Attorney and the Department of Communlty and EconomlC
Development.
