Ordinance Amendll1g 1979 Newsrack Ordinance
At ltS meetlng on January 24,
1984, the Clty Council
directed the City Attorney to prepare an ordinance to enlarge
the zone subJect to speclal news rack provisions to lnclude the
entire City.
In response to thlS dlrection, the accompanYlng
ordlnance has been prepared and lS presented for Clty Council
consideratlon.
The ordlnance requires compliance wlth special newsrack
provlsions aeeordlng to the schedule set forth in Seetlon 1.
Dlstrlct
1 consists of the area in WhlCh the speclal
requirements of Munlclpal Code Seetlon 6252 currently apply.
Dlstr icts 2,
3,
4 and 5 shall comply wlth the special
requlrements of Municipal Code Sectlon 6252 on or before the
followlng dates:
D~strlct 2: March 31, 1985.
Dlstrict 3: November 30, 1985.
Dlstrict 4: June 15, 1986.
Dlstr lct 5: December 31, 1986.

NLWSRACK ORDINANCE TO ENLARGE THE AREA
OF ZONE A TO INCLUDE THE ENTIRE CITY
WHEREAS, Ordinance Number 1131 (CCS) establ~shed spec~al
requlre@ents for newsracks located ~n a zone coverlng Wilshlre
tloulevard and Flfth and Slxth Streets from Santa Monica
Boulevard to Wl1sh~re Boulevardi and
WHEREAS, Oralnance Number 1174
(CCS) enlarged the zone
to add Fourth Street from W~lshlre Boulevard to Colorado
Avenue,
Santa Monica Mall, Santa Monlca Place, and Llncoln
Boulevard from Broadway to the Santa Monlca Freeway; and
WHEREAS, Ordlnance Nunmer 1223
(CCS) enlarged the zone
to add the area bounded by Wllshlre Boulevard on the north,
Second Street on the east, Colorado Avenue on the South, and
Ocean Avenue on the west,
and the area bounded by P~co
Boulevard on the north, Maln Street On the east, the Clty
limits on the south and Nel1son Way and Applan Way on the
westi and
WHEREAS, Ordinance Number 1264
(CCS) enlarged the zone
to add Plea Boulevard between Maln Street and the easterly
Clty 11mltSi and

enlarge the zone to encompass the entire area within the
boundarl.es of the City of Santa Mon~ca,

THEREFORE,
THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Ord1.nance Number 1131 (CCS) 1.S hereby
aQended to replace the map of Zone A w1.th the map attached
hereto, enlarg~n':J Zone A to add the ent~re area wlthln the
boundarles of the Clty of Santa Monica. Shown on the map are
five d~strlcts. Dlstr~ct 1 conslsts of the area in wh~ch the
speclal requlrements of Munlclpal Code Sect10n 6252 currently
apply. Dl.strlcts 2, 3, 4 and 5 shall comply with the special
requlrements of Munlclpal Code Sect~on 6252 on or before the
followlng dates:
Dlstrlct 2; March 31, 1985.

November 30, 1985.
D~strlct 4;
D1strict 5:
SECT ION 2.
June 15, 1986.
December 31, 1986.
Any prov~s1ons of the Santa Monica Munlclpal
Code or appendl.ces thereto inconSlstent w1th the provisions of
thls ordlnance, to the extent of such lncons~5tencles and no
further, 15 hereby repealed or modlfl.ed to that extent
necessary to affect the prov1s1ons of th1s ordinance.
SECTIO~ 3. If any section, subsectlon, sentence,
clause, or phrase of th1.s ordl.nance 1.S for any reason held to
be 1nvalld or unconstitutional by a declsl.on of any court of
competent Jur~sdl.ctl.on, such dec1s1on shall not affect the

valldlty of the remalnlng portlons of the ordlnance. The City
Councll hereby declares that lt would have passed thlS
ordlnance and each and every sectlon, subsectlon, sentence,
clause or phrase not declared lnvalld or unconstltutlonal
without re~ard to whether any portlon of the ordlnance would
be subsequently declared lnvalid or unconstltutlonal.
Si:CTION 4.
The Mayor shall slgn and the City Clerk
shall attest to the passage of thlS ordlnance. The City Clerk
shall cause the same to be publlshed once in the offlClal
newspaper wlthin 15 days after lts adoptlon.
The ordlnance
shall become effectlve 30 days from ltS adoptlon.
