TO: Mayor and City Council FROM: city Attorney SUBJECT: Ordinance Amending Santa Monica Municipal Code Section 7504 and Adding Section 7505 of the Santa Monica Municipal Code to Establish Charges for Special provisions and Plans, and Center Tie Line and Tract Map Services At its meeting on September 27, 1988, the city council directed the City Attorney to prepare an ordinance amending Santa Monica Municipal Code Section 7504 to establish charges for special provisions and plans and adding Section 7505 to the Municipal Code to establish charges for center tie line and tract map services. In response to this direction, the accompanying ordinance has been prepared and is presented to the city council for its consideration. The accompanying ordinance amends Municipal Code Section 7504 by providing for fees for plans and specifications for public works improvement projects, in lieu of a refundable deposit currently being required. Prospective bidders requesting copies of the plans and specifications will be charged a fee in the amount of the actual cost of preparing the documents. The accompanying ordinance also adds Section 7505 to the Municipal Code to establish fees for center line tie and tract map services. Such services include providing members of the - 1 - e:;-~ . . public with center line tie information in order to establish legal property line boundaries, physical checking of survey monuments, and review of underlying tracts, legal descriptions, and utility easements, all of which require many hours of City staff time. The ordinance provides that the fees charged for such services will be established by resolution of the City Council. CA:RMM:rmd783/hpca City Council Meeting 12-13-88 Santa Monica, California ORDINANCE NUMBER (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 7504 AND ADDING SECTION 7505 OF THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH CHARGES FOR SPECIAL PROVISIONS AND PLANS, AND CENTER TIE LINE AND TRACT MAP SERVICES THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Santa Monica Municipal Code Section 7504 is amended to read as follows: SECTION 7504. Engineering Documents. A fee for plans and specifications for public works improvement projects will be collected from prospective bidders in the amount of the actual cost of the plans and special provisions plus ten percent (10%) . Mailing and handling fees may be charged to the prospective bidder in appropriate amounts as determined by the City Engineer. The fees provided for in this Section shall be paid to the City Treasurer. - 1 - . . SECTION 2. Section 7505 is added to the Santa Monica Municipal Code to read as follows: SECTION 7505. Fees for Center Line Tie and Tract Map Services. A fee shall be charged for providing center line tie information and tract map approval services, including physical check of survey monuments, and review of underlying tracts, legal descriptions, and utility easements, to requesting parties. The amount of each fee shall be established, and from time to time amended, by resolution of the City Council. SECTION 3. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. SECTION 4. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared inval id or unconst i tutional wi thou t regard to whether . - 2 - . . any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This ordinance shall become effective after 30 days from its adoption.
