STAFF REPORT
TO: Mayor and City Counc1l

SUBJECT: Resolution Finding that Certain Charges Are
Exempt from the Provisions of the California
Environmental Quality Act
The C1ty Council has adopted resolutions relating to
bin rental and rollout fees (Resolut1on Number 6314 (CCS))
and relating to water connect1on and construction fees
(Resolution Number 6321 (CCS)). In order to ensure that the
sett10g of these fees is exempt from the provisions of the
Cal1forn1a Env1ronmental Quality Act, the accompanying reso-
lut10n has been prepared.
RECOMMENDATION
It 15 respectfully recommended that the accompanY1ng
resolution be adopted.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA FINDING THAT CERTAIN
CHARGES ARE EXEMPT FROM THE
PROVISIONS OF THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES AS
FOLLm'ilS:
SECTION 1.
The CIty CouncIl fInds that the establIshment,
~o~~flcatIon, structurIng, restruct~rlng, or approval of rates
a~d charges contaIned In Resol u t ion Numbers 6314 (CCS) (rela tlng
to OIn renta: and rollout fees) and 6321 (CCS) (relatIng to wat2r
connectIon and constructIon fees) are for the purpose of ~eetIng
operatIng eXgenses, IncludIng employee wage rates and frInge
benefIts and/or obtainIng funds for capital projects necessary to
maint~In serVIce wlt~In existIng service areas.
SECTION 2. The CIty Council hereby incorporates into this
resolution, and adopts as Its fIndIngs, the following documents
settIng forth with specIfIcity InformatIon indIcatIng that the
rates and charges are for the purpose of meetIng operatIng
expenses and/or obtaInIng funds for capital projects as set forth
in Section 1:
Staff Reported dated May 18, 1981, entitled
Recommendation for Refuse Rate Increase.
Staff Report dated June 30, 1981, entitled
Revlsed Water Rate Structure RecommendatIon
and Water Construction and ConnectIon Fee.

SECTION 3.
Pursuant to Public Resources Code SectIon
2l080(b)(8), the action Indicated 10 Section 1 was and is exempt
from the provlsldns of the CalIfornia Envlronmental Quallty Act
of 1970, PublIC Resources Code SectIon 21000 et seq.
SECTION 4. The Clty Clerk shall certIfy to the adoptlon of
